EOFY RESOLUTION NO. 60 i:OFY
AWARDING CONTRACT FOR CERTAIN WORK ON CERTAIN PORTIONS OF FIRST
STREET SECOND STREET, THIRD STREET, FOURTH STREET, BAY AVENUE,
MONTER6 AVENUE, ANADE AVENUE, ISLAND AVENUE AND LINDO AVENUE IN
THE CITY OF NEWPORT BEACH
WHEREAS, the Board of Trustees of the City of Newport
Beach did on the 24th, day of July, 1916, duly adopt a Resolution
No. 57 ordering the following work to be done:
1st, That
FIRST STREET
from the northerly line of Surf Avenue to the southerly line of
Central Avenue; and also that
SECOND STREET
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that
THIRD STREET
from the northerly line of Surf Avenue to the southerly line of
Bay Avenue; and also that
FOURTH STREET
from the northerly line of Surf Avenue to the southerly line of
Central Avenue; and also that
BAY AVENUE
from the westerly line of Alavrado Street to the westerly line of
Third Street prolonged northerly across said Bay Avenue; and also
that
MONTERO AVENUE
from the northerly line df Bay Avenue to the southerly line of
Buena Vista Boulevard; and also that
ANADE AVENUE
from the northerly line of Bay Avenue to the southerly line of
Buena Vista Boulevard; and also that
ISLAND AVENUE
from the northerly line of Central Avenue to the southerly line of
Buena Vista Boulevard; and also that

LINDO AVENUE
from the northerly line of Bay Avenue to the southerly line of
Buena Vista Boulevard; including all street and alley intersection ,
to be graded and paved to the official grade in accordance with
plans, profiles and cross- sections numbered 3, 6, 71 8, 91 11,
12, 13, 14, 1OG1, and in further accordance with special specifi-
cations number 25 for the construction of the concrete pavements
in the City of Newport Beach, California. 4ihich said special
specifications were adopted as special specifications for said
work by the Board of Trustees of the City of Newport Beach by
Resolution No. 53 of said City.
2nd: That a cement curb be, constructed along both lines
of the roadway of First Street from the north line of Surf Avenue
to the southerly line of Central Avenue; and also that a cement
curb be constructed along both lines of the roadway of Second
Street from the northerly line of Surf Avenueto the southerly
line of Bay Avenue; and also along both lines of the roadway of
Third Street from the northerly line of Surf Avenue to the south-
erly line of Bay Avenue; and also along both lines of the roadway
of Fourth Street from the northerly line of Surf Avenue to the
southerly line of Bay Avenue; and also along the northerly line
of Bay Avenue from the westerly line of Alvarado Street to a line
eight feet westerly from and parallel with the easterly line of
Buena Vista Avenue, prolonged southerly across Bay Avenue, and
along the southerly side of Bay Avenue from the westerly side of
Alvarado Street to a line eight feet westerly from the easterly
line of Fourth Street, prolonged northerly across Bay Avenue; and
also along both lines of the roadway of Montero Avenue, from the
northerly line of Bay Avenue to the southerly line of Buena Vista
Boulevard; and along both lines of the roadway of Anade Avenue
from the northerly line of Bay Avenue to the southerly ,line of
Buena Vista Boulevard; and also along both lines of the roadway

of Island Avenue from the northerly line of Central Avenue to the
southerly line of Buena Vista Boulevard; and also along both lines
of the roadway of Lindo Avenue from the northerly line of Bay
Avenue to the southerly line of Buena Vista Boulevard; including
curb returhs at all street and alley intersections and termination
(excepting along such portions of said roadway upon which a ce-
ment curb has already been constructed and now is to the official
line and grade) in accordance with plans, profiles and cross -
sections numbered 3, 61 7, 81 9, 11, 12, 13, 14, 1OC1, and in
further accordance with specifications numbered 21 for the con-
struction of cement curbs in the City of Newport Beach, California
Which said specifications were adopted as special specifications
for said work by t1B Board of Trustees for the City of Newport
Beach by Resolution Numbered 53 of said City.
3rd: That a cement walk five (5) feet in width be con-
structed along both lines of the roadway of First Street from the
northerly line of Surf Avenue to the southerly line of Central
Avenue; and also that a cement balk five (5) feet in width be con-
structed along both lines of the roadway of Second Street from the
northerly line of Surf Avenue to the southerly line of Bay i:venue;
and also that a cement walk five (5) feet in width be constructed
along both lines of the roadway of Third Stre et from the northerl
line of Surf Avenue to the southerly line of Bay Avenue; and also
that a cement walk five (5) feet in width be constructed along
both lines of the roadway of Fourth Street from the northerly line
of Surf Avenue to the southerly line of Bay Avenue; and also that
a cement walk five (5) feet in width be constructed along the
northerly line of Bay Avenue from the westerly line of Alvarado
Street to a line seven and one half (72) feet westerly from and
parallel with the easterly line of Buena Vista Avenue, prolonged
southerly across Bay Avenue and along the southerly line of the
roadway of said Bay Avenue from the westerly line of Alvarado stre

to a line seven and one -half UP feet westerly from the easterly
line of Fourth Street, prolonged northerly across Bay Avenue; and
also that a cement walk five (5) feet in width be constructed
along both lines of the roadway of Montero Avenue from the north-
erly line of Bay Avenue to the southerly line of Buena Vista Boul
vard; and also that a cement walk five (5) feet in width be con-
structed along both lines of the roadway of Anade Avenue from the
northerly line of Bay Avenue to the southerly line of Buena Vista
Boulevard; and also that a cement walk five (5) feet in width be
constructed along both lines of the roadway of Island Avenue from
the northerly line of Central Avenue to the southerly line of Bay
Avenue; and also that a cement walk five (5) feet in width be con
structed along both lines of Lindo Avenue from the northerly line
of Bay Avenue to the southerly line of Buena Vista Boulevard;
(excepting along such portions of said streets and avenues upon
which a cement sidewalk has already beer, constructed and now is t
the official line and grade) and that all of said cement side-
walks shall be constructed in accordance with plans, profiles,
and cross - sections numbered 3, 61 71 81 91 ill 12, 13, 14, loci,
and in further accordance with specifications numbered 20 for the
construction of cement sidewalks in the City of Newport Beach,
California. Which said specifications were adopted as special
specifications for said work by the Board of Trustees of the City
of Newport Beach by Resolution Number 53 of said City.
That the said contemplated work or improvement, in�the
opinion of said Board of Trustees of the City of Newport Beach,
is of more than local or ordinary public benefit, and said Board
of Trustees hereby declares that the district in the said City of
Newport Beach benefited by said work or improvements and to be
assessed to pay the costs and expenses thereof is described in
the Resolution of Intention for said work or improvement and ref-
erence to whichis made for a description of said district.

The Board of Trustees of the City of Newport Beach de-
termines that serial bonds shall be issued to represent assess-
ments of twenty -five ($25.00) Dollars, or over, for the cost of
said work or improvement; said serial bonds shall extend over a
period ending nine (9) years from and after the second day of Ja
uary next succeeding the date of said bonds, and an even annual
proportion of the principal sum thereof shall be payable, by
coupon, on the second day of January every year after their date
until the whole is paid; and the interest shall be payable semi-
annually, by coupon, on the second days of January and July,
respectively, of each year, at the rate of seven (7) per cent
per annum on all sums unpaid, until the whole of said principal
and interest are paid. Said bonds shall be issued in accordance
with the provisions of an act of the legislature of the State of
California, entitled, "An Act to provide a system of street im-
provement bonds to represent certain assessments for the cost of
street work and improvement within municipalities, and also for
the payment of such bonds," approved February 27, 1893, and of
all acts supplementary thereto or amendatory thereof.
That the proceedings for the aforesaid improvement shall be had
and taken under an act of the Legislature of the State of Cali-
fornia, entitled, "An Act to provide for work upon streets, lanes,
alleys, courts, places and sidewalks, and for the construction of
sewers within municipalities," approved March 18th, 1885 (commonly
known as the Vrooman Act), and under all acts supplementary there-
to or amendatory thereof.
AND WHEREAS, by said Resolution the City Clerk was
directed to publish and post a notice inviting proposals for loin
said work, as required by law and the time for opening said bids
was fixed at 7;3C P.M. of Monday, the 4th day of September, 1916.
AND WHEREAS, the Board of Trustees of the said City of
Newport Beach in open session on the 4th day of September, 1916

has publicly opened, examined and decbred all sealed proposals
or bids offered for the aforesaid work.
NOW THEREFO E, beit resolved by the said Board of Tru
that the said Board hereby rejects all of said bids except the
next herein mentioned and hereby awards the contract for said wor
to the lowest, regular, responsible bidder therefor, to wit:
To JOHNSON -SHEA COMPANY at the prices specified in their proposal
on file for said work, to wit:
Paving and grading, per square foot of paving and grading,
eleven cents (11�)
Curb, per lineal foot of cement curb, thirty -four cents (34¢)
Sidewalk, per square foot of cement sidewalk, ten cents (1W
AND BE IT FURTHER RESOLVED, That the City Clerk is here-
by directed to post notice of this award conspicuously for five
days on or near the Council Chamber floor of the Board of Trustees
of said City, and also to publish said notice by one insertion
in the Newport News, a weekly newspaper, printed, published and
circulated in said City, and hereby designated therefore.
Passed by the Board of Trustees of the City of Newport
Beach at their regular adjourned meeting held on the 11 day of
September, 1916.
