A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NEWPORT BEACH, ADOPTING SPECIFICATIONS
NO. 26 FOR THE CONSTRUCTION OF BOARD WALKS ON
PILE BENTS IN THE CITY OF NEWPORT BEACH.
Be it resolved by the Board of Trustees of the City of
Newport Beach that the following Specifications to be known as
Specifications No. 26 for the construction of board walks on pile
bents in the City of Newport Beach be and the same are hereby
adopted.
1. The work herein provided for is to be done in accor-
dance with the plans, profiles and cross - sections on file in the
office of the City Engineer of the City d'f;Newport Beach, and all
work shall, during its progress and on its completion, conform to
the lines and grades which may from time to time be given by said
City-- EUgineer.
2. PILES- All piles of whatever kind shall be cut from
growing trees, free from wind or heart shakes, large or unsound
knots., decay or other defects which would impair the strength or
durability of the pile. Only butt cuts, cut about the ground swell
of the tree, and with both ends square, will be accepted. They
shall be peeled of bark and the knots trimmed, and the specified'
sizes shall be, after peeling, straight and uniformly tapering.
The piles shall be of the variety commonly called Oregon or Wash-
ington fir, and may be the yellow or red variety. It shall ndt
have at any point of its length and at any edge sap wood more than
two (2) inches in width, and shall be free from knots over 1i inch
diameter.
6%hen the piles are being driven the large end must be
j cut off square so that the hammer will strike it square and solid
and the head of the pile protected by means of rings to keep it
from splitting or brooming. The bottom end of the piles must be
perfectly square if they are driven with a square end, or if
pointed, the point must be true and in the center of the pile.
The piles must be of a length as shown on the detail plans, and

ill after being driven and sawed off as required, must conform to the
211 length designated on the plans, and must not show any splitting or
3 11 brooming.
411 3. All timber for caps, joists, floor - planking and
5[j spreaders shall be of the grade commonly known as "Merchantable ",
6 lumber, dry and thoroughly seasoned, of strong and sound lumber,
7 free from loose or rotten knots, knot - holes, splits, shakes, wane,
8 rot, pitch seams (open on both sides of piece) or other defects
9 that will materially impair the strength of the piece, well manu-
10 factured and suitable for good and substantial construction pur-
11 11 poses. The timber shall be of the variety and dimensions as des-
12 ignated on the plans and details.
13 4. All work shall be executed in every respect in a
14 thorough and workmanlike manner, in accordance with the details
15 plans. The Contractor shall preserve all stakes set for lines,
16 levels or measurements of the work iXi their proper places until
17 authorized to move them by the City Engineer, and any expense in-
18 curred in replacing said stakes which the contractor or his sub -
19 ordinates may have failed to preserve shall be borne by the Con -
20 , tractor.

perform all labor necessary to
execute the work in

every respect
in a thorough and workmanlike
manner in accordance

with the plans
and specifications and to the
satisfaction of the
25
Street Superintendent.

The
Contractor shall observe all the
ordinances of the
271i City of Newport Beach in relation to the obstruction of streets,
28 keeping open passageways and protecting the same where they are
29 exposed or dangerous to travel.
30 The contractor shall notify the Superintendent of Streets
31 when he desires a final inspection of the work, when the latter
32 will, as soon as possible, make the necessary examination, and if

1 the work is found in compliance with these specifications, the
2 Superintendent of Streets will furnish the Contractor with a cer-
3 ( tificate to that effect.
4 Any overseer, superintendent, laborer, or other person
5 employed on the work by the Contractor, who shall perform his work
6 in a manner contrary to these specifications shall be discharged
q immediately, and such person shall not again be employed on the
8 work.
9 Bidders must examine and judge for themselves as to the
10 location of the work and the nature of the same.
11 The Contractor shall keep upon the work a copy of the
12 plans and specifications, and access thereto shall at all timesbe
13 accorded the Engineer.
14 The Contractor shall prosecute work only in the presence
15 of an engineer or inspector appointed by the engineer and any work
16 done in the absence of said engineer or inspector will be subject
17 to rejection. The Contractor shall furnish the engineers and in-
18 spectors reasonable facilities for obtaining such information as
19 may be necessary to give them full information at all times re-
20 specting the progress and manner of the work and the character of
21 the materials.
22 The contractor shall take all necessary measures to pro -
23 tect the work and prevent accidents during construction. He shall
24 provide and maintain all necessary barriers, guards, temporary
25 bridges, watchmen and lights.
26 All loss or damage arising from any unforseen obstructio
27 or difficulties either natural or artificial which may be encoun-
28 tered in the prosecution of the work, or from any action of the
29 elements prior to final acceptance of the work, or from any act or
3011 omission not authorized by these specifications on the part of the
3111 Contractor or any agent or person employed by him shall be sus-
32 + tained by the Contractor.

No work which may be defective in its construction, or
deficient in any requirements of these specifications, will be con-
sidered as accepted in consequence of the failure of any officer of
the City or inspector connected with the work to point out said
defects or deficiency during construction, and the contractor shall
correct any imperfect work whenever discovered before the final ac-
ceptance of the work.
The Contractor shall care for all work until final:com-
pletion and acceptance. He shall remove all surplus material and
rubbish from the work after its completion and before he makes ap-
plication for the acceptance of the work.
When in the specifications a maximum or minimu;`either
in size, percentage or thickness, or relating to quality or char-
acter or other matter is allowed or prescribed, the work shall be
accepted as in compliance therewith if within such maximum or min-
imum so allowed hereby.
Whenever the word ficity" is used in these specifications
it refers to the City of Newport Beach, California.
4then the word "Contractor" is used in these specificati
it refers to the party or parties of the second part in the agree-
ment for the construction of the work herein specified.
Whenever the words f[City Engineer" or "Superintendent of
Streets" are used in these specifications, they refer respectively
to the City Engineer and Street Superintendent of the City of New-
port Beach, or their authorized agents or inspectors.
5. The City Clerk shall certify to the passage of this
resolution and shall cause the same to be entered in the Book of
Resolutions and a minute of the passage thereof in the records of
the Board of Trustees of the meeting at which it was passed.
