RESOLUTION NO. 90
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH, ORDERING CERTAIN WORK TO BE DONE UPON CERTAIN PORTIONS
OF SURF AVENUE IN SAID CITY.
Be it resolved by the Board of Trustees of the City of
Newport Beach, as follows:
Section 6ne.
That the said Board deems it to be rwquired by the public
interestand convenience, and hereby orders, that the follGwing
work bedone, to wit:
That Surf Avenue within the said City from the westerly
line of the Alley situated between Block 2 of the Newport Bay
Tract as recorded in Map Book 4, page 16, Records of Orange
County, California, and Block 4 of the Balboa Tract as recorded
in Map Book 4, page 11, Records of Orange County, California,
and the southerly proplongation of the said westerly line of
said Alley to a line which is 180 feet easterly of and parallel
with the easterly line of E- Street, by the construct ion of a
board walk on wooden pile bents on that portion of said Surf
Avenue lying between the northerly line of said Surf Avenue and
a line twelve (12) feet southerly of and parappel with the said
northerly line of Surf Avenue, including all streets and alley
intersection, be constructed to official line and grade, in
accordane with Plans No.1C4 and 105 and on file in the office
of the City Engineer of said City of Newport Beach, and in
further accordane with specification numbered 26, adopted by
Resolution No. 65of the Board of Trustees of the City of New-
port Beach and on $le in t he office of the City clerk of said
City.
Section Two.
What thesaid contemplated work or improvement of the portion
of said Surf Avenue, is, in the opinion of the said Board of
Trustees of the City of Newport Beach, of more than local or
ordinary public benefit and they declare that the exterior
boundaries of the lands to be benefited by said improvement
and to be assessed to pay the costs and exepenses of said im-
provement shall be as follows:
Beginning at a point, which point is at the intersection of
the northerly prolongation of the westerly line of Lot 5, Block
2 of a Map of the Newport Bay Tract, as recorded in Map Book 4,
page 16, Records of.Grange Coucty, California, and the center ling
of the Alley imnsaid Block 2 of the Newport Bay Tract; thence
easterly along the center line of the aforesaid alley to the
intersection of said center line with the center line fo the alley
situated between the aforesaid Block 2 of Newport Bay Tract and
"lock 4 of the Balboa Tract as recorded in Map Book 4, page 11,
Recorde of Orange County, California; the ce southerly along
the center line of the last mentioned alley to a point which
is1CG feet northerly of the northerly line of Surf Avenue, as
said Surf Avenue is shown and laid out upon a Map of the Balboa
Tract, as hereinbefore described; thence easterly in a straight
line 1CG feet northerly of and parallel with the aforesaid
northerly line of Surf Avneue to a point in the center line of
A- Street; thence easterly ina straight line to the northwesterly
corner of Lot 15. Block 14 of the aforesaid Map of the Balboa Tr-
act; thence easterly in s straight line to a point in the center
line of B- Street, which point is 1G4.C5 feel southerly of the

center line of Central Avenue, and measured along the center
line of the aforesaid B- Street; thence northerly along the center
line of B- Street to its intersection with the center line of
Central Avneue; thence easterly along the center line of Central
Avenue to a point at the intersection with the northerly pro-
longation of the easterly line of Lot 61 Block 22 of the afore-
said Map of the Balboa Tract; thence southerly along the northerl
prolongation of the aforesaid easterly line of said Lot 6, and
along the easterly line of said Lot 61 and the southerly pro-
longation of the said easterly line of said Lot 6 to its inter-
section with the southerly line 6f.SurfAvenue; thence westerly
along the southerly line of said Surf Avenue to the intersection
of the southerly prolongation of the westerly line of Lot 51
-Olock 2 of the aforesaid Map of the Newport Bay tract; thence
northerly along the southerly prolongation of the aforesaid
westerly line of Lot 5, Block 2, and along the westerly line of
said Lot 5, and along the northerly prolongation of the said
westerly line of Lot 5 to its intersection with the center
line of the aforesaid Alley in Block 2 of the aforesaid Map of
Newport Bay Tract, the place of beginning; excepting therefrom
any portion of any public street or alley.
Section Thhee
The City Engineer is hereby directed to make a diagram of the
property effected or benefited by the proposed work or improve-
ment asdescribed in this Resolution and to be assessed to pay the
expenses thereof, said diagram to be made as required by law.
Section Four
The said Board of Trustees determines that serial bonds shall
be issued to represent each assessment of $25.00 or nore for the
costa of said work or improvement; said serial bonds shall extend
over a period of nine years from the 2nd day of January next
succeeding the date of said bonds and shall bear interest at the
rate of seven per centum per annum, and an even annual proportion
of the principal sum thereof shall be payable by coupon on the
2nd. dqg of January of each year after their date, until the
whole is paid, and the interest shall be payable semi - annually
by coupon on the second days of January and July.respectively
of each year at the rate of seven per centum per annum on all
sums unpaid until the whole of said principal and interest have
been paid.
Section Five.
All of the proveedings for the aforesaid improvemehtiand for
the issuance of said bonds shall be taken under and in accordance
with the provisions of an Act of the Legislature of the State of
California, known and designated as the "Improvement Act of
1911," and all acts amendatory thereof.
Section Six
The City Clerk is hereby directed to publish a notice invi-
ting proposals for doing laid work, and referring to the speci-
fications posted and on file, twice in the Aewport News, a
weekly newpaper, printed, published and circulated in said City
and hereby designated for that purpose, and he is also direeted
to post said notice, with specifications, conspicuously for
five days on or near the council chamber door of said Board of
Trustees. The time in said notice for the opening of bids
shall be at the hour of eight o$clock P.M. of the 4th day of
February,1918.

Section Seven
The City Clerk shall certify to the passage of this resol-
ution and shall cause a nimute of the passage thereeof to be
entered on the records of the Board of Trustees at which it
was passed and also shall keep the same onfile in his office.
Passed by the Board of Trustees of the City of Newport
Beach this 7th day of January, 1918.
