RESOLUTION NO /7
A RESOLUTION OF THE BOARD. OF TRUSTEES OF THE CITY OF
NE17PORT BEACH AWARDING THE CONTRACT FOR CERTAIN WORK
ON CERTAIN PORTIONS OF OCEAN AVENUE WITHIN THE SAID
CITY.
WHEREAS, the Board of Trustees of the City of Newport Beach
did on the 3rd day of April, 1922, duly adopt a Resolution No.
1643 ordering the following work to be done;
That that portion of Ocean Avenue
lying between the northerly line of
said Ocean Avenue and a line 12 fed
southerly of and parallel with the
northerly line of said Ocean Avenue
and extending from a line which is 61
feet easterly of and Parallel with the
easterly line of 19th Street to the
southerly prolongation of the westerly
line of 9th Street, including all street
and alley intersections, be improved
by the construction of a board sidewalk
r on vile bents. Said board sidewalk to be
constructed to the ofa,fal line and
grade, and according to Plan No. 257,
on file in the OMce of the City Engi-
neer of Newport Beach, and in further
accordance with Specifications No. 26,
adopted by Resolution No. 65 of the
Board of Trustees of the City of New.
Port Beach, and on file in the office of
the City Clerk of said C,ty.
That the said contemplated work or -
improvement in the opinion of said
Board of Trustees is of more than lo-
cal or ordinary Public benefit, and - - -
said Board of Trustees makes the ex-

Assessment District, for the improve-
ment of Ocean Avenue, approved by
the Board of Trustees of said City on
the 6th day of March 1922, and now on
file in the office of the City Clerk, on
which the exterior boundaries of said
District are Indicated by red border
lines.
It is hereby determined and notice
is hereby given. that serial bonds to
represent nnpaid assessments and
bear interest at the rate of seven per
cent per annum will be issued here-
under in the manner provided by the
Improvement Bond Act of 1915, the
last installment of which bonds shall
mature fourteen years from the 2nd
day of dnly next succeeding nine
months from their date.
Except as hereinbefore stated, all
the proceedings for the aforesaid
work and improvements shall be had
and taken under and in accordance
with the provisions of an Act of the
Legislature of the State of California
known and designated as the "Im-
proement Act of 1911;' as amended.
That in the construction of Said improvement, certain partt
of the Said work are to be done at grades other than the previously
existing official grades for Said Street, and Said previously exist-
ing official grades of certain portions of Said Street have been
modified and changed as follows;
The official grade of Ocean Avenue from the southerly prolonga-
tion of the easterly line of 19th Street to the southerly prolonga-
tion of the westerly line of 9th Street has been changed So that
instead of said existing official grades the Same Shall conform to
the following elevations, to -wit:

All elevations hereinbefore giv-
en are for the top of the board side-
walk, are in feet, and are above the
_ City Datum Plane, as heretofore
adopted and established. At all points
between consecutive designated points
on the same grade line, the grade shall
conform to a true and uniform grad-
tent along the northerly line of said
Ocean Avenue, between said consecu.
tive points.
For further particulars as to such
changes of grade and such proposed
grades, reference to hereby made to
the above mentioned plane and speed
fications, which plane Show the eiist-
Ing official grades of the portion of
said Street herembefore described,
and the grades at which the Said wort
to proposed to be done.
AND WHEREAS, by said Resolution the City Clerk was directed
to publish and post a notice inviting proposals for doing said work
as required by law, and the time for opening said bids was fixed at
the hour of 7:30 o'clock P.M. of the 34th day of April, 1922, and
the said Board did in open session on the said 24th day of April,
1922, publicly open, examine and declare all sealed proposals or bids
Offered for the aforesaid work;

NOW THEREFORE, be it resolved by the said Board of Trustees
• that the said Board hereby rejects all of said bids except the
next herein mentioned and hereby awards the contract for said
work, to the lowest, regular, responsible bidder therefor, to-

AND BE IT FURTHER RESOLVED, that the City Clerk is hereby
directed to return to the respective bidders all checks accompany-_
ing said rejected bids, and he is also hereby directed to post
notice of the award conspicuously for five days on or near the
Council Chamber Door of the Board of Trustees of said City, and to
publish said notice by two insertions in the Newport News, a week-
ly newspaper, printed, published and circulated within said City,
and which is hereby designated for that purpose.
