RESOLUTION NO. 853.
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NEWPORT BEACH, DECLARING THEIR INTEN-
TION TO ORDER THE IMPROVEMENT OF OCEAN BOULE-
VARD AND CERTAIN OTHER STREETS, AVENUES AND
ALLEYS IN TRACT N0, 518 AS PER MAP THEREOF RE-
OORDED IN MISCELLANEOUS MAPS BOOR 17, PAGES
33, 34, 35 AND 36, RECORDS OF ORANGE COUNTY,
CALIFORNIA_, WITHIN SAID CITY UNDER THE IMPROVE-
MENT ACT OF 1911 AND THE AMENDMENTS TO SAID ACT.
The Board of Trustees of the City of Newport Beach do
resolve as follows:
SECTION I.

That the public interest and convenience require and
it is the intention of the Board of Trustees of the City of Newport
Beach, California, to order the construction of the following de-
scribed work and improvement in said city, to -wit:
1. That concrete pavement, concrete sidewalk, concrete
curb and granite concrete ornamental lighting poste, conduits,
wires and appurtenances for the successful operation of an orna-
mental lighting system be constructed upon the following streets:
(a). Upon that portion of Central Avenue as laid out
and shown upon a map of Tract No. 518, as recorded in Miscellaneous
Maps Book 17, Pages 33, 34, 35 and 36, Records of Orange County,
California, from the northerly prolongation of the westerly line of
Block A of the aforesaidr2ract No. 518 to the northerly prolongation
of the easterly line of Lot E of the aforesaid Tract No. 518.
(b). Upon Plaza Del Norte from I Street to L Street.
(c). Upon Plaza Del Sur from I Street to L Street.

(d). Upon Miramar Drive from Central Avenue to
Channel Road.
(e). Upon Ocean Boulevard from G Street to Channel'Road.
(f). Upon G Street from Central Avenue to the northerly
lines of Lots F and G of the aforesaid Tract No. 518.
(g). Upon L Street from the northerly lines of Lots H
and I of the aforesaid Tract No. 518 to Central. Avenue.
(h). Upon M Street from the northerly lines of Lote T.`
and J of the aforesaid Tract No. 518 to the southerly line of'*" '
N of the aforesaid Tract No. 518'.
(i). Upon Channel Road from the northerly line of Lot J
to the northerly termination of said Channel Road, as,sad Lot J
and Channel Road are laid out and shown upon the aforesaid Tract

$. That concrete pavement, concrete sidewalk and grani
concrete ornamental lighting posts, conduits, wires and appurtenances
for the successful operation of an ornamental lighting system be con—

of Lots G and H of the aforesaid.Traot No. 518 to Central Avenue,
except where concrete pavement is already constructed to the official
line and grade.
3. That concrete curbs and a surface of clay and gravel be
constructed upon the alley in Block J of the aforesaid. Trac* No. 518
from I Street to Miramar Drive,- and upon the alley in B2a0k0 of the
aforesaid Tract No. 518 from Channel Road to X Street.`
4. 'That a clay and gravel surfacing be constructed upon the
.fol-lowing described alleys:
(a). Upon the alley in Block L of the aforesaid T
No. 518 from L Street to I Street:

(b). Upon the alley in Block R of the aforesaid Tract
No. 518 from L Street to I Street.
(c). Upon the alley in Blocks F. G, H and I of the afore-
said Tract Not 518 from G Street to Channel Road.
(d). Upon the alley in Blocks B. C, D and E of the afore-
said Tract No. 518 from G Street to Channel Road.
5. That pipes, hydrants and other appliances and,appurte-
nances for supplying and distributing domestic water and for fire
protection in certain portions of the following described streets .`
and alleys.
(a). In Central Avenue between the northerly prolongs-
tion of the westerly line of Block A of the aforesaid Tract No.
518 and Miramar Drive.
(b). In G Street between Central Avenue and the northerly
lines of Lots F and G of the aforesaid Tract No. 518.
(c). In I Street between Central Avenue and the northerly
lines of Lots G and H of the aforesaid Tract No. 518.
(d). In L Street between Central Avenue and the northerly
lines of Lots H and I of the aforesaid Tract No. 518.
(e). In M Street between the first alley northerly of
Miramar Drive and the northerly lines of Lots I and J of the afore-
said Tract No. 518.
(f). In Channel Road between the northerly line of Lot J
of the aforesaid Tract No. 518 to the northerly termination of said
Channel Road, as said Channel Road is laid out and shown upon the
aforesaid Tract No. 518.
(g). In Miramar Drive between Central Avenue and the alley
in Block J of the aforesaid Tract No. 518, terminating in ilixaisTwF:,.

(h). In the alley in Block L of the aforesaid Tract No.
518 between L Street and I Street.
(i). In the alley in Block J of the aforesaid Tract No,
518 between I Street and Miramar Drive.
In the alley in _Block K of the aforesaid Tract 'No,
518 between L Street and I Street.
(k). In the alley in Blook o of the aforesaid Tract No.
518 between Channel Road and 11 Street.
(1). In the alley in Blocks F, G, H and I of the"-'afore-
said Tract No, 518 between G Street and Channel Road.
(m). In the alley in Blocks B. C, D and E of the afox# .
Said Tract No.' 518 between G Street and Channel Road.
6. That cement pipe sanitary severe, together With manholes,
junction chambers, east.iron. frames and covers, lampholes, flush -
tanks, and other appurtenances. be constructed on the grades , "at the
elevations and along the lines of said sewers in the following .
locations:
(a). In G Street between the northerly lines of Lots
F and G of a map of Tract No, 518 as recorded in Miscellaneous Maps
Book 17, Pages 33, 34, 35 and 36, Records of Orange County, California,
and the sewer now in place along thd'iciortherly line of Central Avenue.
(b). In the alley in Block S of the aforesaid Tract No,
516 between I Street and L Street.
(o). In the alley in Block.J of the aforesaid Tract No,
518 between Miramar Drive and I Street.
(d):: In Mira,ear Drive from the proposed sewer in the alley
in Block J hereinbefore described to the sewer already in place along
the northerly line of Contra! Avenue.
(e). In the alley in Blocks B. G, D and E of the aforesaid
Tract No. 518.between Channel Road and G Street.

• Me In Channel Road between Ocean Boulevard and the
northerly termination of said Channel Road as said Channel Road
is laid out and shown upon the aforesaid map of Tract No. 518.
(g0. In the alley in Blocks I, R, G and F of the afore -
said Tract Noe 518 between G Street and Channel Road.
(h). In M Street between the first alley southerly of
Miramar Drive and the first alley northerly of Miramar Drife.
(i). In the alley in Block 0 of the aforesaid Tract Noe
518 between M Street and Channel Road.
(j). In the alley in Block L of the aforesaid Tract Noe
518 between I Street and L Street.
W. Is L Street between Miramar Drive and the sewer al-
ready in place along the northerly line of Central Avenue.
All of the hereinbefore described streets and alleys shall
be graded to the official grade in accordance with the plans, profiles
and cross sections hereinafter referred to.
All of the foregoing work and improvement is fully set
forth, delineated and described on plans, profiles, cross sections
and detailed drawings No. 283, 284, 285, 286, 233, 234, 235, sad, 236
on file in the office of the City Engineer of said city heretofore'
approved` by the Board of Trustees of the City of Newport Beach on
the /0' 0 day of 1923, by Resolution No. 252 and in
Specifications Noe 27, adopted by Resolution Nov 97 as said speoi-
fioations Noe 27 are amended by Resolution Noe 131 and Specifications
Noe 33, adopted by Resolution No. 165, and Specifications Noe 23,
adopted by Ordinance Noe 118, and Speoifications Noe 32, adopted by
Resolution Noe 186, and Specifications Noe 34, adopted by Resolution
No. 251 of the Board of Trustees of said city and on file in the
office of the City Clerk of said city. The said plans, profiles,
cross sections, detailed drawings and specifications are hereby

referred to for the full and detailed description of the said
,-proposed work and improvement.
SECTION Z.
That the Board of Trustees- also determines and deo"s
that serial bonds bearing interest at the rate of seven per cent
(7%) per annum shall be issued to represent each assessment of
Twinty-five (x$5.00) Dollars or more remaining unpaid for twenty
days after the date of the warrant. Said serial bonds shall
tend over a period ending nine (9) years from the second day 44�i
January next succeeding the fifteenth (15th) day of the next No.vem-
ber following their date. Payments on the principal of unpaid
assessments and interest shall be made by property owners to the
City Treasurer and the same shall be disbursed
by him, all as pro -
vided in the said improvement Act of 1911.
SECTION 3.
That the contemplated work and improvement hereinbefore
mentioned ie.,, in the opinion of said Board of Trustees, of more than
local or ordinary public, benefit, and t he expense of said work and
improvement is made chargeable upon the district hereinafter described
and said Board of Trustees does hereby. declare said'district -be
the district benefited by said cork and improvement and to be' assess -.
ed to pay the costs and expenses thereof, which district is bounded
and described as follows, to-wit.,
Beginning at the southwesterly corner of Lot 8, BI.o0k At
of a map of Tract Not 518 as recorded in Miscellaneous )[sups Book 17-
Pages W. 34,'35 qnd 36, Records of Orange County, California; thence.,

easterly along the northerly lines of Lots F, G, H, I and J of the
aforesaid Tract No. 518 to the northeasterly corner of the last
mentioned Lot J; thence north 15 degrees, west 281.71 feet tot he
southwesterly corner of Lot 1, Block P. of the aforesaid Tract No.
518; thence northeasterly along the southeasterly line of the last
mentioned Lot 1 to the southeasterly corner thereof; thence north-
westerly along the northeasterly line of the last mentioned Lot 1
and along the northeasterly line of Lot M of the aforesaid Tract No.
518 to the most northerly corner of the last mentioned Lot M; the
south a distance of 584.82 feet to the northeast corner of Lot B of
the aforesaid Tract No. 518; thence west along the northerly lines
of Lots B, R and C of the aforesaid Tract No. 518 and the westerly
prolongation of the northerly lines of said Lots, a_dista6te of 924
feet to a point in the easterly line of Section 2, Township 7 South,
Range 10 West, San Bernardino Base and Meridian; thence due north
along the easterly line of the aforesaid Section 2 a distance of
660 feet to the northeasterly corner of the aforesaid Section 2;
thence due west along the northerly line of the aforesaid Section 2,
to its intersection with the southerly prolongation of the easterly
line of L Street; thence northwesterly to the intersection of the
westerly line of L Street and the northerly line of Central Avenue;
thence westerly along the northerly line of Central Avenue to its
intersection with the northeasterly prolongation of the north-
westerly line of Block A of the aforesaid Map of Tract No. 518; thence
southwesterly along the northeasterly prolongation of the northwester-
ly line of the last mentioned Block A and along the northwesterly
line of the last mentioned Block A to the place of beginning, excepting
therefrom any lands forming any part of any public street or alley.

The above description is general only. A plat or map of
said district No. 287 adopted by Resolution No. 252 of the Board of
Trustees of said city, indicating by a boundary line the extent of
the territory included in the proposed district, is on file in the
office of the City Clerk. Reference is hereby made to said plat or
map for a further Pull and complete description of the said asseve-
ment district. The said map or plat so on Pile shall govern for
all details as to the extent o£ the said assessment district.
SECTION 4.
Notioe is hereby given that on Monday, the let day of
October, 1923, at 7.30 o'clock P. M., in the Council Chamber of iu
City Hall of the said City of Newport Beach, any and all persons
having any objections to the proposed work or improvement or to the
extent of the district, or both, may appear before the said Board of
Trustees and show cause why said proposed improvement should not be
carried out in accordance with this resolution.
SECTION 5.
The Newport News, a weekly newspaper, published and oireu-
laced and of general circulation in the City of Newport Beach, is
hereby designated as the newspaper in which this Resolution of Inten-
tion shall be published, and the City Clerk of said city is hereby
directed to cause this Resolution of Intention to be published_by
two insertions in said newspaper in the mariner and form required by
law. The Board of Trustees does not deem it advisable that the Clerk
mail copies of the notice of improvement to owners Or reputed owners
and he is not required to mail the same.

SE -tea CTION 6.
The Street Superintendent of said city shall, after the
adoption of said Resolution of Intention, cause to be conspicuously
posted along the lines of said contemplated work or improvement and
along all the open streets within the hereinbefore. described aseese-
ment dietriot, notices of the passage of this Resolution of Intention
in the manner and form required by law.
SECTION 7.
All the proceedings for the aforesaid work and improvement..
shall be had and taken under and in accordance ;with the provisions
of an Act of the Legislature of the State of California, °'deei ®hated .
as the °Improvement Act of 191111, approved April 7th, 1911.0 and
amendments thereto.
