A RESOLUTION OF THE BOARD OF TRUSTEES OF
THE CITY OF NEWPORT BEACH ADOPTING SPECIFICA-
TIONS NO. 35 FOR CLAY AND69.4YBLSURFACING OF
STREETS WITHIN THE CITY OF NEWPORT BEACH.

The Board of Trustees of the City of Newport Beach do
resolve as follows:
That the following specifications to be known as Spe-
cifieations No. 35, for clay and g191'-4 surfacing of streets in the
City of Newport Beach, Galifornia, be adopted.

PLANS, ETC.
The work herein provided for is to be done in accordance
with the plans, profiles and cross- seotions on file in the office
of the City Engineer of the City of Newport Beach, and all work
shall, during its progress and on its completion, conform to the
lines and levels which may, from time to time, be given by said
City Engineer.
SUB - GRADE:

The sub -grade for the roadway shall be six (6)
inches below the surface of the finished work, unless otherwise
shown on the above mentioned plans, profiles or cross - sections.

GRADING.
Grading shall include all filling, the removal of all
earth, stone or all other material, of whatever nature it may be,
that may be encountered in preparing the street; and shall also
include all trimming and shaping required to bring the surface of
the street to grade and cross- section.
When mud or other soft material is encountered, it shall

be taken out and the space filled with good sound earth, which
shall be rolled until the surface of the foundation ceases to sink
under or creep in front of the roller. The Contractor, however, will
not be required in such cases to excavate the mud or other soft
material to a greater *epth than two feet below sub - grade.
All filling shall be done with sand or good sound earth.
The embankments shall be carried up in horizontal layers, not to
exceed one foot each in thickness, and the teams shall be made to
travel as evenly as possible over the whole surface of each layer,
going and coming. The formation of well defined ruts is especially
prohibited. No material of a spongy nature shall be used for
filling, The space over which fills are to be made shall first be
cleared of all brush, timber and debris.
All fills over two feet in depth shall to brought up in
uniform layers as above specified and each layer shall be rolled
with a roller having a compression of not less than 200 pounds per
inch width of tire, except that when the fill is made with sand it
shall be compacted by thoroughly wetting the sand fill.
The width of the street to be graded, unless otherwise
specified in the plans, resolution of intention or ordinance, shall
be held to mean the entire width of street from property line to
property line; but the roadway between the curbs and the spaces
between the curbs and property lines shall each be finished for its
use as specified herein.
After the street, or section of street, has been brought
to sub -grade and cross - section as above specified, the surface
shall be thoroughly moistened and rolled with a roller weighing
not less than four hundred pounds per lineal inch of tire until
it is unyielding, except that when the sub -grade is sand it shall
be compacted by thoroughly wetting the sand.

Depressions made by the rolling shall be leveled up with good
earth and again rolled. Such portions of the street as cannot be
reached by the roller, and all places excavated below sub -grade
and refilled, and all pipe trenches and other places that cannot
be properly compacted by the roller, shall be tamped solid, and in
case of wet weather or soft or muddy ground, making use of the
roller unsafe or impractical, the rolling shall not be undertaken
until the ground has become sufficiently dry.
The Contractor shall notify the City Engineer when the
street or section of street has been brought to sub- grade, whereupon
it shall be tested for grade, cross - section and condition, and if
the work is found to be in accordance with the specifications and
.grades given, the Contractor shall proceed as hereinafter mentioned.

SURFACING MATERIAL.
The surfacing material shall be a natural mixture of clay
and JJ Q,116ithat will thoroughly cement and compact by sprinkling and
rolling. The mixture shall contain not less than 20% nor more than
40% of clay.

CONSTRUCTION.
Upon the sub -grade prepared as hereinbefore specified
shall be spread a uniform layer of surfacing material not to exceed
five (5) inches in thickness, this layer shall be rolled with a
tandem roller weighing not less than five tons. The surface shall
then be shaped with a grader then sprinkled and harrowed with a
spike tooth disc harrow. Upon the surface prepared as above spe-
cified sufficient surfacing material shall be placed to bring the
surface to grade, after being sprinkled and rolled. This layer
shall be thoroughly sprinkled then rolled until the surface is
thoroughly compacted. Any depressions left after rolling must be

• roughened by a pick or other suitable tool, then thoroughly sprinkled,
• filled and rolled as hereinbefore mentioned.
The finished surface must show a surface true to cross-
section, 8ree from humps, sags or other inequalities. When tested
with a level or a template of the cross - section, the surface at no
place shall vary more than three - fourths (3/4) of an inch from the
cross - section shown on the plans.
GENERAL REQUIREMENTS.
WORK. The Contractor shall, for the price bid, furnish
all the materials and perform all the labor necessary to execute
the work in every respect in a thorough, workmanlike manner, in
accordance with the plans and specifications and to the satisfaction
of the Street Superintendent.
MATERIALS AND SAMPLES: All materials must be of the
specified quality and fully equal to samples when samples are re-
quired. The Contractor shall furnish to the City Engineer for test,
whenever called for and free of charge, samples of all the materials
proposed to be used in the work.. Rejected materials must be imme-
diately-removed fro$ the work by the Contractor.
LABOR. Any overseer, superintendent, laborer or other
person employed on the work by the Contractor, who shall perform his
work in a manner contrary to these specifications shall be dis-
charged immediately, and such person shall not again be employed on
the work.
EXAMINATION OF GROUND: Bidders must examine and judge
for themselves as to the location of the proposed work, the nature
of the excavation to be made and the work to be done.
SETTING STAKES: The Contractor shall give twenty -four
(24) hours' notice in writing when he will require the services of
the City Engineer for laying out any portion of the work.

• He shall dig all stake holes necessary to give lines and
• levels. The Contractor shall preserve all stakes set for the lines,
levels or measurements of the work in their proper places until
authorized to remove Ahem by the City Engineer, and any expense in-
curred in replacing said stakes which the Contractor or his subor-
dinates may have failed to preserve shall be borne by the Contractor.
PLANS AND SPECIFICATIONS: The Contractor shall keep upon
the work a copy of the plans and specifications, and access thereto
shall, at all times, be accorded the Engineer.
The Contractor shall prosecute work only in
the presence of an engineer or an inspector appointed by the Street
Superintendent, and any work done in the absence of said engineer
or inspector will be subject to rejection. The Contractor shall
furnish the engineers and inspectors reasonable facilities for ob-
taining such information as may be necessary to give them full in-
formation at all times respecting the progress and manner of the
work and the character of the materials.
PRESERVATION OF MONUMENTS: The Contractor shall not
disturb any monuments or stakes found on the line of the improve-
ments until ordered by the City Engineer, and he shall bear the
expense of resetting any monuments or stakes.which may be dis-
tur bed without orders.
REMOVING OBSTRUCTIONS: The Contractor shall remove all
trees, stones, debris, and other obstructions that may be encoun-
tered in making said improvements.
OBSERVING CITY ORDINANCES: The Contractor shall reserve
all the ordinances of the City of Newport Beach in relating to the
ve obstruction of streets, keeping open passageways and protecting
the same where they are exposed or dangerous to travel.
BARRIERS, LIGHTS, ETC: The Contractor shall take all
necessary measures to protect thw work and prevent accidents during
construction. He shall provide and maintain all necessary guards,

• barriers, temporary bridges, watchmen and shall place and maintain
a red light at least every one hundred fifty (150) feet along the
line of the work, and at all street and alley intersections from
sunset to sunrise.
CROSS STREETS: No more than one cross street shall be
closed at any one time.
PUBLIC UTILITIES: In case it should be necessary to move
the property of any owner of a public utility or franchise, such
owner will, upon proper application by the Contractor, be notified
by the Street Superintendent to move such property within a
specified reasonable time, and the Contractor shall not interfere
with said property until after the expiration of the time specified.

DEFECTIVE WORK: No work which may be defective in its
construction, or deficient in any of the requirements of these
specifications, will be considered as accepted in consequence of
the failure of any officer of the City or Inspector connected with
the work to point out said defects or deficiency during construc-
tion, and the Contraotor shall correct any imperfect work, when-
ever discoNered, before the final acceptance of the work.
0 PROTECTION OF 'CORK AND ®LEANING UP: The Contractor shall
care for all work until final completion and acceptance. He shall
remove all surplus material and rubbish from the work after its
completion and before he makes application for the acceptance of
the work.

FINAL INSPECTION: The Contractor shall notify the Street
Superintendent when he desires a final inspection of the work,
when the latter.will, as soon as possible, male the necessary
examination, and if the work is found in compliance with these
specifications, the Street Superintendent will furnish the Con-
tractor with a certificate to that effect.
ALLOWABLE VARIATION: When, in the specifications, a
maximum and minimum, either in size, percentage or thickness, or
relating to quality or character or other matter, is'allowed or
prescribed, the work shall be accepted as in compliance therewith
if within such maximum or minimum.so allowed hereby.
DEFINITION: Whenever the word „City„ is used in these
specifications, it refers to the City of Newport Beach, California.
When the word "Contractor" is used in these specifications,
it refers to the party or parites of the second part in the agree-
ment for the construction of the work herein specified.
Whenever the words "Street Superintendent" or "City
Engineer" are used in these specifications, they refer, respectively,
to the Street Superintendent or the City Engineer of the City of
Newport Beach, or their authorized agents or inspectors.
