HomeMy WebLinkAbout335 - Abalone Avenue & Other Abandonments• RESOLUTION NO. • A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO VACATE, CLOSE -UP AND ABANDON FOR PUBLIC STREET PURPOSES CERTAIN PORTIONS OF ABALONE AVENUE AND CERTAIN ALLEYS IN BLOCKS 8 and 9, AND A CERTAIN PORTION OF THE ALLEY IN BLOCK 7, SECTION 5, BALBOA ISLAND, WITHIN SAID CITY. _ _ _ = = 0 = = = = = The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION I. It is the intention of the Board of Trustees of the City of Newport Beach to order those portions of the public street and alleys hereinafter described,within said City, to be closed -up, vacated and abandoned for public street purposes; the said portions of said street and alleys to be closed -up, vacated and abandoned for public street purposes, are described as follows, to -wit: All that portion of Abalone Avenue from the northerly line of Central Avenue to the northerly termination of said Abalone Avenue; and all of that portion of the first alley lying westerly of and parallel with Abalone Avenue extending northerly and southerly through Block 8, of Section 5, Balboa Island, from the northerly line of Central Avenue to the southwesterly line of the first alley northerly of Central Avenue; and all that portion of the first alley lying easterly of and parallel mith Abalone Avenue, extending northerly and southerly through a portion of Block 9, of Section 5, Balboa Island, from the northerly line of Central Avenue to the southresterly line of the first alley north- easterly. of Central Avenue; all that portion of the alley extend- ing northwesterly through Block 9, of Section 5, Balboa Island, from the northerly line of Central Avenue to the easterly line of Abalone Avenue; and all that portion of the first alley northerly of Central Avenue extending northwesterly and southeasterly through • Block 8, of Section 5, Balboa Island; from the westerly line of • Abalone Avenue to the westerly line of Block 8, of Section .5, Balboa Island, and all that portion of the all erly and southerly through Block 7, of Section from the southerly line of Central Avenue to a the southeasterly corner of Lot 7, Block 7, of Island, to the southwesterly corner of Lot 22, Block 7, Section 5, Balboa Island. SECTION II. ,y extending north - 5, Balboa Island, line drawn from Section 5, Balboa of the aforesaid That,the public work herein provided for is the closing up of the portions of the street and alleys herein described in Section I, and it appearing to the Board of Trustees that there are no costs, damages or expense occasioned by or arising out of said work, and that no assessment is necessary to pay the costs, damages or expenses of said work, and that therefore no ass.essment district of lands to be affected or benefited by said work or im- provement are necessary. SECTION III. The Street Superintendent of the City of Newport Beach is hereby directed to cause to be conspicuously posted along the line of said contemplated improvement, at not more than three hundred feet in distance apart upon said street, and not less than three in all upon said street, notices of the passage of this Resolution, said notice to be headed, "NOTICE OF PUBLIC TORK ", in letters not less than one inch in length and stating the fact of the passage of this Resolution, its date and briefly the work of •• improvement proposed, being that of vacating the portions of Abalone Avenue and alleys herein described, and the,said Notice shall refer to this Resolution for further particulars; the said Street Superintendent shall also cause a similar notice to that herein,described to be published by four successive insertions - 2 - daily newspaper so printed, published and circulated in said City). SECTION IV. The City Clerk shall certify to the passage of this Resolution, and cause a minute thereof to be recorded in the min- utes of the meeting of the Board of Trustees at which this Reso- lution eras passed.
