RESOLUTION N0. y�3.
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NE9PPORT BEACH DECLARING VACANT FOR
PUBLIC STREET PURPOSES CERTAIN PORTIONS OF
SANTA ANA AVENUE WITHIN SAID CITY.
WHEREAS, the Board of Trustees of the City of Newport
Beach, on the 3rd day of January, 1929, at a regular meeting of said
Board held on that date, duly passed and adopted a resolution,
being Resolution No. 404, entitled, "A Resolution of the Board of
Trustees of the City of Newport Beach declaring their intention
to vacate, close -up and abandon for public street purposes certain
portions of Santa Ana Avenue, within said City "; and
WHEREAS, the Street Superintendent of the City of Newport
Beach after the passage of said Resolution caused to be conspicuously
posted along the line of said contemplated improvement at not more
than three hundred (300) feet in distance apart, upon said street,
and not less than three (3) in all upon said street, notices of
the passage of said Resolution, said notice being headed, "Notice of
Public Work ", in letters not less than one inch in length and stating
the fact of the passage of said Resolution, its date, and briefly
the work of improvement proposed, being that of vacating the above
named street as hereinafter described, and the said notice herein
mentioned referred to said Resolution for further particulars;
said Street Superintendent having also caused a notice similar to
that hereinbefore referred to to be published by four (4) successive
insertions in the Newport News, a adi ►weekly newspaper printed,
published and circulated in said City of Newport Beach (there being
no daily newspaper so printed, published and circulated in said City),
and more than ten days after the expiration of the time of publica-
tion of said notice having elapsed and no objections to the said
improvement have been delivered to the City Clerk of the City of
Newport Beach, and the said Board of Trustees having acquired
jurisdiction to order the vacation of said street as hereinafter

described,
THEREFORE, the Board of Trustees of the City of Newport
Beach do ordain as follows:
SECTION I.
That that portion of the public street hereinafter de-
scribed within the said City be closed -up, vacated and abandoned
for public street purposes, as follows:
All that portion of Santa Ana Avenue described as
beginning at a point in the present northwesterly line of said
Santa Ana Avenue, which point of beginning is South 68 degrees
49 minutes west 116.70 feet (measured along the present north -
westerly line of Santa Ana Avenue) from a point which is South
59 degrees 49 minutes west 291.14 feet (measured along the present
northwesterly line of Santa Ana Avenue) from the most easterly
oorner of Lot 1, Block C, of First Addition to Newport Heights,
as per map thereof recorded in Miscellaneous Maps, Book 4, page
94, Records of Orange County, California; thence northwesterly
around a circular curve with a radius of 87.86 feet concave to
the northeast, a distance of 9.81 feet to a point; thence westerly
around a circular curve with a radius of 43.80 feet concave to
the South, a distance of 61.51 feet to a point in the present
northwesterly line of said Santa Ana Avenue; thence North.68
degrees 49 minutes East, a distance of 64.68 feet, to the place of
beginning; and
Also that portion of Santa Ana Avenue described as
beginning in the present southeasterly line of said Santa Ana
Avenue, which point of beginning is South 68 degrees 49 minutes
West, a distance of 146.10 feet from the intersection of the
northeasterly line of 10th Street and the.northeasterly prolonga-
tion of the southeasterly line of that part of Santa Ana Avenue
lying westerly of 10th Street; thence southwesterly around a cir-
cular curve with a radius of 83.40 feet concave to the northwest,

a distance of 52.81 feet to a point in the southeasterly line of
said Santa Ana Avenue; thence North 68 degrees 49 minutes East,
Ank, - - a distance of 51.91 feet, to the place of beginning.
SECTION Jr.
That the public work herein provided for is the
closing -up of the street herein described in Section I, and it
appearing to the Board of Trustees that there are no costs,
damages or expense occasioned by or arising out of said work, and
that no assessment is necessary to pay the costs, damages or ex-
penses of said work, and that therefore no commissioners shall
be appointed to assess benefits and damages.
SECTION III_
The City Clerk shall ceztify to the passage of this
Resolution and shall cause the same to be published by one in-
sertion in the Newport News, a weekly newspaper printed, published
and circulated in said City, and which is hereby designated for
that purpose.
