RESOLUTION NO.,OW
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NEWPORT BEACH DECLARING THEIR INTENTION
TO ORDER THE IMPROVEMENT OF CERTAIN PORTIONS OF
COAST BOULEVARD AND OTHER STREETS WITHIN SAID
CITY, UNDER THE IMPROVEMENT ACT OF 19111 AND
THE AMENDMENTS TO SAID ACT.

The Board of Trustees of the City of Newport Beach do
resolve as follows:
. SECTION I.
That the public interest and convenience require, and
it is the intention of the Board of Trustees of the City of
Newport Beach, California, to order the construction of the
following described work and improvement in said City, to -wit:
That metal lighting standards, conduits, wires and
appurtenances for the successful operation of an ornamental street
lighting system be constructed upon certain portions of Coast
Boulevard from the northeasterly prolongation of the southeasterly
line of Avocado Avenue to the northeasterly prolongation of the
southeasterly line of Lot 64, of Block At of Tract No. 673, as per
map thereof recorded in Miscellaneous Maps, Book 20, pages 17 and
18, Records of Orange County, California; also that cement concrete
sidewalk be constructed along the southwesterly and westerly side
of Coast Boulevard from the northeasterly prolongation of the
southeasterly curb line of Avocado Avenue to the northeasterly
prolongation of the southeasterly line of Lot 64, Block At of the
aforesaid Tract No. 673, excepting that no cement concrete side-
walk shall be constructed along the aforesaid southwesterlyland
• westerly side of Coast Boulevard from a line 79.86 feet north-
westerly of and parallel to the northwesterly line of that part of
Fernleaf Avenue lying immediately westerly of Coast Boulevard to a
line fifty (50) feet northwesterly of and parallel to the afore-
said northwesterly line of Fernleaf Avenue, including the

construction of cement concrete sidewalk on both sides of

Marguerite Avenue from the southwesterly line of Coast Boulevard
to a line, which line is 10 feet southwesterly of and parallel
to the southwesterly line of Coast Boulevard; and the construction
of cement concrete sidewalk along the northeasterly and easterly
side of Coast Boulevard from a line 92 feet northwesterly of and
parallel with the northwesterly line of that part of Carnation
Avenue lying immediately westerly of Coast Boulevard to the north-
easterly prolongation of the southeasterly line of Lot 64,
Block A, of the aforesaid Tract Ho. 673; and the construction of
cement concrete curb along both sides of the roadway of Coast
Boulevard from a line drawn at right angles through a point in the
southwesterly line of said Coast Boulevard, which point is 105.02
feet southeasterly of the intersection of the southeasterly line
of that part of Hazel Drive lying southwesterly of Coast Boulevard
and the southwesterly line of said Coast Boulevard (measured along
the southwesterly line of said Coast Boulevard), to the north-
easterly prolongation of the southeasterly line of Lot 64, Block
A, of the aforesaid Tract Po. 673.
The grades to which the work provided for shall be
done and the improvement made upon the portions of Coast Boulevard
and Marguerite Avenue are the grades of the cement concrete
curbs now in place along said portions of said streets, except
where no cement concrete curbs are now in place along a certain
portion of Coast Boulevard, the grades to which the work provided
for shall be done and the improvement made upon said portion of
Coast Boulevard, which are provided for in this Resolution, are the
grades shown on the profiles therefor on file in the office of the
City Engineer, to which said profiles reference is hereby made for
• the description of said grades.

All of the foregoing work and improvement is fully set
forth, delineated and described on plans, profilee, cross- sections
and detailed drawings No. 344, on file in the office of the City
Engineer of said City, heretofore approved by the Board of Trus-
tees of the City of New/port.Beach on the 16tbp day of May, 1937, 44
by Resolutlon.No. L and in Specifications No. 39, adopted
by Resolution No. 346, and in Specifications No. 42, adopted
by Resolution No.-II.2 -f of the Board of Trustees of said ".City
and on file in the office of the City Clerk of said City. The
said plans, profiles, dross- sections, detailed drawings and spe-
oifications are hereby referred to for the full and detailed
description of the said proposed work and improvement.
SECTION II.
That the Board of Trustees also determine and declare
that serial bonds bearing interest at the rate of seven per cent
(74,) per annum shall be issued to represent each assessment of
Twenty -five (25.00) Dollars, or more, remaining unpaid for twenty
(20) days after the date of the warrant. Said serial bonds shall
extend over a period ending nine (9) years from the seoond day of
January next succeeding the fifteenth (15th) day of the next
November following their date. Payments on the principal of unpaid
assessments and interest shall be made by property owners to the
City Treasurer and the same shall be disbursed by him, all as
provided in the said Improvement Act of 1911.
SECTION III.
That the contemplated work and improvement hereinbefore
mentioned is, in the opinion of said Board of Trustees, of more
• than local or ordinary public benefit, and the expense of said
work and Improvement is made chargeable upon the district herein-
after described and said Board of Trustees do hereby declare said

district to be the district benefited by said work and improvement,
and to be assessed to pay the costs and expenses thereof, which
district includes all of the following described pieces or parcels
of land:
Lots 1, 2, 3, 4, 5, and 6 of Tract No. 682, as per map
thereof recorded in Miscellaneous Maps, Book 20, page-19, Records
of Orange County, California; all of Blocks A, B, C and H, of
Tract No. 470, as per map thereof recorded in Map Book 17, page
28, Records of Orange County, California; all of Blocks D, E, F,
G, H, I, J, L, M, N. 0, P, Q, R, 8, T. U, V, W, A, Y, Z, AA, and
BB, of Tract No. 323, as per map thereof recorded in Map Book
14, pages 40 and 41, Records of Orange County, California,and
Lots 1, 2, 59, 60, 61, 62, 63 and 64, of Block A, of Tract No.
673, as per map thereof recorded in Miscellaneous Maps, Book 20,
pages 17 and 18, Records of Orange County, California, and tote
50, 51, 52, 53, 54, 55 and 56, of Block B, of the aforesaid
Tract No. 673, and all of that portion of Pacific Drive vacated
by Resolution No. 413, of the Board of Trustees of the City of
Newport Beaoh,.lying southwesterly of and adjacent to Block J,
of the aforesaid Tract No. 323; and all that portion of Electric
Way Street heretofore vacated and lying northeasterly of and ad-
jacent to Lots 1 and 2, Block..Y„ of the aforesaid Tract No. 323,
and Lot 1, Block 343, of Corona del Mar, as per map thereof
recorded in Miscellaneous Maps, Book 3, pages 41 and 42, Records
of Orange County, California; and all of that certain street
heretofore vacated and lying southwesterly of and adjacent to the
last mentioned Lot 1; and all of that certain street heretofore
vacated and lying northwesterly of and adjacent to the aforesaid
Lot I.
The above description is general only. A plat or map
of said District No. 345, adopted by Resolution No. 114_,2G , of

the Board of Trustees of said City, indicating by a boundary line
the extent of the territory included in the proposed district, is
on file in the office of the City Clerk. Reference is hereby
made to said plat or map for a further full and complete de-
soription of the said assessment district. The said map or plat
so on file shall govern for all details as to the extent of the
said assessment district.
SECTION IV.
Reference is hereby made to2the Patent License Agreement
of the Union Metal Company, as the selling agent and representative
of the Union Metal Manufacturing Company and the General Electric
Company, dated May 9th, 1927, and on file in the office of the
City Clerk of the City of Newport Beach, for Union Metal Manufac-
turing Company's lighting standards and the General Electrlo
Company's Novalux Units for ornamental street lighting.
SECTION V.
Notice is hereby given that on Monday, the 6th day of
June, 1927, at 7:30 olol6ck, P.M., in the Council Chamber of the
City Hall of the said City of Newport Beach, any and all persons
having any objections to the proposed work or improvement or to
the extent of the district, or both, may appear before the said
Board of Trustees and show cause why said proposed improvement
should not be carried out in accordance with this Resolutioh.
SECTION VI.
The Newport News, a weekly newspaper printed, published

and circulated in the City of Newport Beach, is hereby
designated
as the newspaper in which this Resolution
of Intention
shall be
published, and for the publication of all
other notices,
resolu-
tions, orders or other matter required to
be published
by the
provisions of the Improvement Act of 1911,
hereinafter
referred to,
and the City Clerk of said City is hereby
directed to
cause this

Resolution of Intention to be published by two insertions in said
newspaper in the manner and form required by law. The Board of
Trustees do not deem it advisable that the Clerk mail copies of the
notice of improvement to owners, or reputed owners, and he is not
required to mail the same.
SECTION VII.
The Street Superintendent of said City shall, after the
adoption of said Resolution of Intention, cguse to be conspicuously
posted along the lines of said contemplated work or improvement,
and along all the open streets within the hereinbefore described
assessment district, notices of the passage of this Resolution of
Intention, in the manner and form required by law.
SECTION VIII.
All the proceedings for the aforesaid work and improvement
shall be had and taken under and in accordance with the provisions
of an Act of the Legislature of the State of California, designated
as the "Improvement Act of 191111, approved April 7th, 1911, and
Amendments thereto.
