HomeMy WebLinkAbout464 - Pacific Electric Railway Right-of-Way• 1 • 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 • 23 24 25 26 27 29 30 31 32 RESOLUTION N0. ,Ii A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, RECOGNIZING THAT A CERTAIN RIGHT -OF -WAY, BETWEEN THE PACIFIC ELECTRIC RAILWAY COMPANYIS TRACTS AND PRESENT PAVEMENT OF CENTRAL AVENUE, BETWEEN ALVARDO STREET AND "B" STREET, IS A PART OF THE RIGHT -OF -WAY OF THE PACIFIC ELECTRIC RAILWAY COMPANY, A COR- PORATION. WHEREAS, on June 23rd, 1928, the City of Newport Beach, was granted permission by the Pacific Electric Railway Company, a corporation, to spread oil and No. 4 rock along the portion of the right -of -way of the Pacific Electric Railway Company between Pacific Electric Railway Companyls tracts and present pavement of Central Avenue between Alvardo Street and "B" Street with the understanding that with the granting of said permit, the rights of the Pacific Electric Railway Company to the property above mentioned would not be jeopardized thereby. NOW, THEREFORE, BE IT RESOLVED: That the City Engineer of said City of Newport Beach be authorized and instructed to spread oil and No. 4 rook along that portion of the right -of -Tray of the Pacific Electric Railway Company lying between the Pacific Electric Railway Company's tracts and present pavement of Central Avenue, between Alvardo Street and "B" Street in said City of Newport Beach. BE IT FURTHER RESOLVED: That the rights of the Pacific Electric Railway Company in and to said described property shall in no way be jeopardized by the granting of said permission and that the said described land is a part of the right -of -way of the Pacific Electric Railway Company. BE IT FURTHER RESOLVED: That if the City shall not purchase said right -of -way as contemplated by Ordinance No. 333 . 1 • 2 3 4 5 6 7 8 9 10 11 12 13 19 15 16 17 18 19 20 21 22 23 24 25 26 r� 27 28 29 30 31 32 r of the City of Newport Beach, then the city agrees to place the right -of -way in its former condition, that is to say, in the oonditi the same was prior to the spreading of oil and rock as aforesaid. I hereby certify that the foregoing Resolution was duly and regularly passed by the City Counoil of the City of Newport Beach at a regular meeting thereof, held on the 2nd day of July, 1928, by the following vote, to -wit: AYES, TRUSTEES: <Y� NOES, TRUSTEES: ABSENT, TRUSTEES: ..__..
