• RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING THEIR INTENTIONS TO
VACATE, CLOSE UP AND ABANDON FOR PUBLIC STREET
PURPOSES, A CERTAIN PORTION OF OCEAN DRIVE, A
CERTAIN PORTION OF TUSTIN AVENUE, A CERTAIN
PORTION OF 10TH STREET, A CERTAIN PORTION OF
FULLERTON AVENUE, A CERTAIN PORTION OF IRVINE
AVENUE, CERTAIN ALLEYS AND CERTAIN PORTION
OF ALLEYS WITHIN THE SAID CITY.
The City Council of the City of Newport Beach, do resolve
as follows;
SECTION I.
It is the intention of the City Council to order those certain
portions of public streets, drives and avenues, and those certain
alleys and certain portion of alleys, hereinafter described, within
the said city, to be closed up, vacated and abandoned for public

street purposes; the said portions of said streetsYavenues and
alleys to be closed up, vacated and abandoned for public street
purposes are described as follows, to wit:
(a) All that portion of Ocean Drive within said
city as said Ocean Drive is laid out and
shown upon a map of the First Addition to
Newport Heights, as recorded in Miscellaneous
Maps Book 4 Page 94, records of Orange County,
California, from the southwesterly prolongation
of the southeasterly line of Riverside Avenue
southerly to the southwesterly prolongation
of the northwesterly line of Tustin Avenue, and
all that portion of Ocean Drive from the west-
erly line of Tustin Avenue southerly of 12th
Street, westerly, southwesterly, southerly and
easterly to the northwesterly line of Irvine
Avenue.
(b) All that portion of Tustin Avenue within said
city as said Tustin Avenue is laid out and shown
upon said map of the First Addition to Newport
Heights, from the northwesterly prolongation of
the southwesterly line of 12th Street southerly
to the northerly line of Ocean Drive and the
southwesterly prolongation of the northwesterly
line of El Modena Avenue.
(c) All that portion of Fullerton Avenue within said
city, as said Fullerton Avenue is laid out and
shown upon said map of the First Addition to
Newport Heights from the southwesterly line of

Ocean Drive, southwesterly to the northeasterly line
of 10th Street.
(d) All that portion of 10th Street within said city,as
said 10th Street is laid out and shown upon said map
of the First Addition to Newport Heights, from a line
which bears South 28 °591 30" West from the southeasterly
corner of Lot 2 Block "A" of the said First Addition to
Newport Heights, southeasterly to the southwesterly
prolongation of the Northwesterly line of Irvine Avenue.
(e) All that portion of Irvine

(f) All that portion of that certain 16 foot alley within
said city in Block 16 of the said First Addition to
Newport Heights, from the southwesterly line of 12th
Street, southerly to the northwesterly lineof E1 Modena
Avenue.
(g) All that portion of that certain 15 foot alley within
said city in Block 17 of the said First Addition to
Newport $eights, from the southeasterly line of E1 Modena
Avenue southeasterly to the northwesterly line of Aliso
Avenue and from the southeasterly prolongation of the
southwesterly line of Lot 7 of said Block 17, north-
easterly to the southeasterly prolongation of the
northeasterly line of said Lot 7.
(h) All that portion of that certain 15 foot alley within
the said city, in Block 18 of the said First Addition to
Newport Heights, from the southeasterly line of Aliso
Avenue, southeasterly to the Northwesterly line of
Fullerton Avenue and from the southeasterly prolongation
of the southwesterly line of Lot 7 of said Block 18,
northeasterly to the southeasterly prolongation of the
northeasterly line of said Lot 7.
(1) All that portion of that certain 16 foot alley within
the said City in Block 19 of the said First Addition to
Newport Heights, from the southeasterly line of Fullerton
Avenue, southeasterly to the northwesterly line of Irvine
Avenue and from the southeasterly prolongation of the
southwesterly line of Lot 7 of said Block 19, northeasterly
to the southeasterly prolongation of the northeasterly
line of said Lot 7.
(j) All that portion of that certain 16 foot alley within
the said city, in Block 16 of the said First Addition to
Newport Heights from the westerly lineof Tustin Avenue,
westerly and northwesterly, to the southerly line of Ocean
Drive.
(k) All that portion of that certain 15 foot alley within the
said city in Block 26 of the said First Addition to Newport
Heights from the northwesterly line of Austin Avenue, north-
westerly to the southeasterly lineof Riverside Avenue.

SECTION II.
That the public work herein provided for is the closing
up of the portions of the street ,3 and. all eysherein described in
Section 1 and it appearing to the City Council that there are no
costs, damages or expenses occasioned by or arising out of said
work and that no assessment is necessary to pay the costs, damages
or expenses of said work and that, therefore, no assessment district
of lands to be effected or benefitted by said work or improvement
is necessary.
SECTION III.
The Street Superintendent of the City of Newport Beach is
hereby directed to cause to be conspicuously posted along the
line of said contemplated improvement, at not
hundred feet in distance apart upon said strei

in letters not less than one inch in and stating the
fact of the passage of this resolution, its date and briefly the
work of improvement proposed, being that of vacating the portions
of Ocean Drive, Tustin Avenue, Fullerton Avenue, 10th Street,
Irvine Avenue and certain alleys herein described, and the said
notice shall refer to this,resolution for further particulars;
the said Street Superintendent shall also cause a similar notice
to that herein described, to be published by four successive
insertions in the Newport News, a weekly newspaper, printed,
published and circulated in said City of Newport Beach (there
being no daily newspaper so printed published and circulated in
said City).

SECTION 17.
The City Clerk shall certify to the passage of this Resolution
and cause a minute thereof to be recorded in the minutes of the
meeting of the City Council at which this resolution was passed.
Passed by the City Council of the City of Newport Beach
