RESOLUTION NO. 648.
• MEREAS, the City of Newport Beach is contemplating
in connection with the County of Orange, and State of California,
the separation of grades at F point known as the "Arches "; and
7FEREAS, in consideration of certain concessions
made by the Southern Pacific Railroad Company, a Corporation, to
the City of iiewport Beach, the City of Dewport Beach has agr_ed
to convey to the Southern Pacific Railroad Company, a Corporation,
the real property hereinafter described;.and.
7:HME11�.-, it satisfactorily appearing to the City
Council of the City of Newport Beach that it is for the benefit
and best interests of the City of Newport Beach to dispose of
said real property hereinafter described, for the reasons
herein set forth; and
JT-MAS, it further satisfactorily appearing to scAri
City Council that s ^.id real property is vacant and unsuitable,
and unnecessary for use by ss.id City, ---nd is not now bean; used
by said city; and
l_'HEREAS, said property is not, noi/is any portion
of the same, tide 1-=nds or harbor front; and
" /HEREeiS, the City Council of the City of Newport
Beach deems.that an adequate and sufficient consideration has
been offered to the City of Newport Beach by the Southern
Pacific Railroad Company, corporation.
NOCi, THMEFORE, RE IT RESOLVED; That it woul.i be
for the benefit and best interests of the City of Newport Beach
that the City of ldenpoit Beach grant to the Southern Pacific
Railroad Company, r, corporation, by grant deed, all th.t cer-
tain real property flituate in the County of Or ,-nge, State of
California, and more nartitcularly described as follows, to —nit:
Beginning at the most easterly corner/of the
parcel of land as conveyed to the City of Newpott Beach by
decd recorded in Deed Book 403, pale 137, Records of said
• Orange County, which point is in the westerly line of the
Southern Pacific Railroad Company's right of way; thence
from said point of beginning S. 170 3 ?_' W. along the said
westerly right of way line of Southern Pacific Railroad
Company, which line is also the east line of said parcel of
land conveyed to the City of Newport Beach, a distance of
151.75 feet, more or less, to the southeast corner of sri d
oarcel of land as conveyed to the City of Newport Beach;
thence North 6021' '.;., along the southerly line of the said
parcel of land as conveyed to the City of Newport Beach, a
distance of 30.29 feet to a line distant 30 feet westerly
measured at right an;;les from and parallel to the said
west line of railroad right of way; thence N. 170 32' E.,
along said parallel line, a distance of 151.73 feet, more or
less, to a point in a northerly line of said parcel of land
as conveyed to the City of Newport Beach; thence S. 500 21'
E., along said northerly line, = distance of 30129 feet to
the point of beginning.
Subject to reservations, restrictions and easements
of r;cord in Orange County, California.
That the Mayor and City Clerk of the City of Newport
Beach are hereby directed, authorized and instructed to txecute
said dded on behalf of the City of Newport Beach, conveying
to the Southern Pacific Railroad Company, a Corporation, the
real property hereinbefore described, and the whole thereof.
I hereby certify that the foregoing Resolution was
duly an^ regularly passed by the City Council of the City of
Newport Beach at a regular meeting thereof held on the 12th
day of January, 1931, by the followinm vote, to -wit;
AYES, COUNCILMEN: Fulmer, Claire, Ellsworth, Garfield
and Johnson.
