A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING THEIR INTENTION TO ORDER
THE CLOSING UP AND ABANDONMENT OF A PORTION OF A
CERTAIN STREET KNOWN AS WASHINGTON STREET AND A
CERTAIN PUBLIC RIGHT -OF -WAY BETWEEN THE NORTHERLY
END OF WASHINGTON STREET AND THE MEAN HIGH TIDE
LINE OF THE PACIFIC OCEAN IN THE CITY OF NEWPORT
BEACH, DECLARING IT TO BE FOR THE PUBLIC INTEREST
AND CONVENIENCE, AND FIXING THE TIME AND PLACE FOR
HEARING OBJECTIONS TO SAID PROPOSED IMPROVEMENT.

The City Council of the City of Newport Beach pursuait
to the provisions of an Act of the Legislature of the State of
California, known as "Street Opening Act of 198911 approved March
6, 1889 and amendments thereto, do resolve and declare as follows:
Section 1. That the public interest and convenience
requires the closing up and abandonment

corded in Book 3, page 38 of Miscellaneous Maps records of Orange
County, California, described as follows, to -wit:
Beginning at the most southerly.corner of Lot 6, Block
B of said Bayside running thence north 34932100" east along the
southeasterly line of said Lot 6 and Lot 7 of said Block B, 112.93
feet to the most easterly corner of Lot 7 of said B1ock.B; thence
south 5102210.911 east.along the southeasterly prolongation of the
northeasterly line of said Lot 7, ?.O1 feet; thence south 3k032'00"
west 112.79 feet to an intersection with the southeasterly pro-
longation of the southwesterly line of said BLock.B; thence north
55028100" west along the last mentioned southeasterly prolongation
2 feet to the point of beginning.

• (b). All that portion of that certain Right -of -way
for public street purposes for ingress and egress to the waters
of Newport Bay lying southeasterly of and adjacent to the lands
adjudged and decreed to belong to John C. Tuffree and Mabel C.
Tuffree in court decree case No. 23679 of the Superior Court of
the State of California, in and for Orange County, described as
follows, to -wit:
Beginning at the most easterly corner of Lot 7, Block B
of "Bayside" as shown upon a Map recorded in Book 3, page -38 of
Miscellaneous Maps, Records of Orange County, California; running
thence north 34032100" east along the northeasterly prolongation
of the northwesterly line of Washington Street, 38.43 feet to an
intersection with the mean high tide line.of the Pacific Ocean in
Newport Bay as described in said Court decree Casa No. 23679;
thence south 51020113" east along said mean high tide line, 2.01
feet; thence south 34032100" west 38.43 feet to an intersection
with the southeasterly prolongation of the northeasterly line of
Lot 7 of said Block B; thence north 51022108" west along the last
mentioned southeasterly prolongation, 710feet to the point of
beginning.
All of which is more clearly shown on a certain Map
approved and adopted by the City Council of the City of Newport
Beach for said abandonment by Resolution No. 6Cr% , on the / s
day, of.�.h<-1931.
SEction 2. That the said City Council of the City of
Newport Beach dDes further declare that the lotp lands or premises
• affected by the closing up and abandonment of the hereinbefore des-
cribed street and benefited by said improvement are those certain
parcels of real property described asfollows, to -wit:

• Lots Six (6) and Seven (7) in Block B,
"Bayside" Tract and tide lands between the Morth-
easterly line of said L&t Seven (7), and the mean
high tide line in Newport Bay. Lot One (1) re-
subdivision of Block Nine (9), Balboa Tract. Lot
One (1) in Block "G" of Bay Front Tract and tide
lands between the northeasterly line of said Lot
One (1) and the mean high tide line in Newport Bay.
Section 3. That the proceedings for the closing up of
the aforesaid street shall be had and taken under and in accordance
with an Act of the Legislature of the State of California, desig-
nated and known as "An Act to Provide for Laying Out, Opening, Ex-
tending, Widening, Straightening or Closing up in Whole or in Part
of any Street, Square, Lane, Alley, Court or Place within Municipal -
ities, to Condemn and Acquire any and all Land and Property Necessary
or Convenient for that Purpose ", approved March 6, 1889, and amend-
ments thereto.
Section 4. The Street Superintendent shall cause to be
conspicuously posted along the line of said contemplated work
and improvement and at not more than 300 feet in distance apart,
but not less than three in all, notices of the passage of this
resolution, in the form and manner as required by law; and he shall
also cause a notice similar in substance, for a period of five (5)
successive weeks, to be published in the Newport News, a weekly news-
paper, published and circulated and of general circulation in the City

of Newport Beach, California, and hereby designated for that purpose
by the City Council, containing.a statement of the fact of the passage
of this resolution of intention, the date thereof, and briefly describd
the work or improvement proposed and referring to this resolution for
• further particulars.
Section 5. That any person interested, objecting to said
work or improvement, or to the extent of the district or lands to be
affected or benefited by said work and improvement and to be assessed
to pay the costs and expenses thereof, may make written objections
to the same, within ten I( 10)days after the expiration of the time of

the publication of said notices, which objections shall be de-
livered to the Clerk of the City Council of the City of Newport
Beach.
I hereby certify that the foregoing Resolution was
duly and regulaTIiy introduced, passed and adopted by the City
Council of the City of Newport Beach, at a regular meeting
thereof, held on the 1 day of �A �, 1931, by the following
