r S • RESOLUTION N0. 7040 RESOLUTION ORDERING IMPROVEMENT ©oK�� T/i65�6 ll -a8 -3r �gis -D WHEREAS, the City Council of the City of Newport Beach on the first day of June, 1931, passed its Resolution of Intention No. 688 to order the hereinafter described improvement to be made and public work to be done in the City of Newport Beach; and WHEREAS, after the passage and adoption of Resolution of Intention No. 688, the Street Superintendent of the City of Newport Beach conspicuously posted along the line of the contem- plated work and improvement at not more than three hundred (300) feet in distance apart, and :_in all, notices of the passage of said Resolution of Intention, headed NOTICE OF PUBLIC WORK, in the manner, form and substance as required by law, aid said Street Superintendent also caused a notice similar in substances to be published by four (4) consecutive insertions in NEWPORT NEWS, a weekly newspaper published and circulated and of general circulation in the City of Newport Beac4, California, and named by said City Council in said Resolution of Intention, as the paper in which said notice should appear, all as appears from the affidavit of Sam Meyers, owner, printer and publisher of said weekly newspaper, and which affidavit was filed in the office of the Clerk of the City of Newport Beach on the day of �� ��, 1931, and is now on file therein; and WHEREAS, the Street Superintendent of the City of Newport Beach commenced the posting of the notices hereinbefore referred nG to on the day of —J,,,.7 -e , 1931, and fully completed the posting thereof on the F- day of —6w n L , 1931, as appears from the affidavit of John A. Siegel, Assistant Street Superintendent 1 0 of the City of Newport Beach, and more than ten (10) days having expired after the expiration of'the time of the publica- tion of said notice within which protests or objections to • the proposed work or improvement might be made by any person interested objecting to said work or improvement, nr to the extent of the district or lands to be affected or benefited by said work or improvement and to be assessed to pay the costs and expenses thereof; and WHEREAS, at the next meeting of the City Council after the expiration of said ten days after the expiration of the time of the publication of said notice,.and no objection to said work or improvement having been made or on file, why said proposed improvement should not be carried out in accordance with said Resolution of Intention, the City Council of the City of Newport Beach having now acquired jurisdiction to order the proposed improvement: IT IS HEREBY RESOLVED AND ORDERED: That the public interest and convenience requires the work hereinafter described and the City Council of the City of Newport Beach hereby orders thefollowing work to be done and improvement made in the City of Newport Beach, as follows: That the following portion of that certain street and public right of way in said City be closed up and abandoned, which street and public right of way to be abandoned are described as follows, to -wit: (a). All that portion of Washington Street as said Washington Street is laid out and shown upon a Map of Bayside, re- corded in Book 3, page 38 of Miscellaneous Maps records of Orange County, California, described as follows, tc-wit: • Beginning at the most southerly corner of Lot 6, Block B, of said Bayside running thence north 34432100" East along the southeasterly line of said Lat 6 and 7 of said Block B, 112.93 -2- V 'r feet tp the most easterly corner of Lot 7 of said Block B; thence • south 51022108" east along the southeasterly prolongation of the northeasterly line of said Lot 7, 2.01 feet; thence south 34032100" West 112.79 feet to an intersection with the southeasterly pro- longation of the southviestaly line of said Block B; thence north 5,5b�8k00'l west along the last mentioned southeasterly prolongation 2 feet to the point of beginning. (b). All that portion of that certain right of way for public street purposes for ingress and egress to the waters of Newport Bay lying southeasterly of and adjacent to the lands adjudged and decreed to belong to John C. Tuffree and Mabel C. Tuffree in court decree case No. 23679 of the Superior Court d the State of California, in and for Orange County, described as follows, to -wit: Beginning at the most easterly corner of Lot 7, Block B of "Bayside" as shown upon a map recorded in Book 3, page 38 of Misfellaneous Maps, Records of Orange County, California, running thence north 34032900" east along the northeasterly prolongation of the northwesterly line of Washington Street, 39.43 feet to an intersection with the mean high tide line of the Pacific Ocean in Newport Bay as described in said Court decree Case No. 23679; thence south 51020113" east along said mean high tide line, 2.01 feet; thence south 34032100" west 39.43 feet to an intersection with the southeasterly prolongation of the northeasterly line of Lot 7 of said Block B; thence north 51022109" west along the last mentioned southeasterly prolongation, 2.01 feet to the point of beginning. All of which is more clearly shown on a certain Map • approved and adopted by the City Council' of the City of Newport Beach for said abandonment by Resolution No. 697, on the first day of June, 1931. -3- • The public v,ork ordered and the improvement to be made is for the purpose of closing up and abandoning a. portion of the hereinbefore described street and public right of way, and for that reason no district is chargeable therewith. All of the herein proposed work dull be done in pursuance of an Act of the Legislature of the State of California, designated "Stree"t Opening Act of 188911, and amendments thereto. For further particulars reference is hereby made to said Resolution of Intention No. 688, which is dated the first day of June, 1931, and or file tith the Clerk of the City of Newport Beach. The Clerk of the City of Newport Beach is herewith instructed to. record a copy of this Resolution Ordering Improve- went in the Office of the County Recorder of the County of Orange, State of California.
