RESOLUTION N0. 2 A
WHEREAS, there has this day been presented to the
City of Newport Beach, a certain agreement dated the 4th day of
November, 1931, by and between the Pacific Electric Railway
Company, a corporation, in said agreement termed "Licensor", and
the City of Newport Beach, a Municipal Corporation, in said
ment termed "Licensee "; and
WHEREAS, in said agreement the Pacific Electric
Railway Company grants to the City of Newport Beach, the
Privilege to construct, maintain and operate an eight inch (811)
water pipe for the purpose of conveying water, said water pipe
in said agreement being termed "Structure ", to be placed be-
neath the right of way and under the tracks of said Licensor, at
or near Engineer's station 1936 4 04.13 near Cedar Street, Newpor
Beach station, Newport Beach Line, County of Orange, State of
California, said structure to be of the description and specifi-
cations as set forth in paragraphs 7 and 8 of said agreement
herein referred to.
NOW, THEREFORE, BE IT RESOLVED: That the terms
of said agreement heretofore mentioned be approved and that said
lease be accepted as presented; and
BE IT FURTHER RESOLVED: That the Mayor of the
City of Newport Beach be, and he is hereby authorized and
directed to sign said agreement in duplicate on behalf of said
City of Newport Beach, and that the Clerk of the City bf.Newport
Beach be, and he is hereby authorized and directed to attest said
agreement and affix the seal of said City of Newport Beach there-
to, said agreement so executed to be sent by the Clerk of said
City of Newport Beach to said Pacific Electric Railway Company for
their signature, and upon the return of said agreement duly
executed, by the Pacific Electric Railway Company, the same to be
