RESOLUTION N0._
WHEREAS, certain owners of property in the Assessment
District covered by Resolution of Intention No. 3 I 7 Q , have
failed to pay their taxes and assessments to the City of Newport
Beach; and
WHEREAS, under said Resolution of Intention No. -170
as aforesaid, there was due and payable on July 2nd, 1932,
certain installments of principal and interest on the bonds
issued under the Bond Act of 1915; and
WHEREAS, in the past said City of Newport Beach has
transferred funds to said Assessment District for the purpose of
taking oare of delinquencies therein, but does not at this time
have funds available for that purpose, for the reason that
approximately $100,000.00 of the funds of said City of Newport
Beach are tied up in certain banks in the City of Newport Beach,
which are now in course of liquidation; and
WHEREAS, the district covered by said Resolution of
Intention No. 3 % Q , as aforesaid, owes taxes and assessments
to the City of Newport Beach, aggregating approximately the sum
of 0, Lr ry : and
WHEREAS, the interest and principal payments on said
bonds issued under the 1915 Bond Act in said district covered
by said Resolution of Intention No. 2 70 , are now in
default; and
WHEREAS, one -half of the net receipts of the Motor
Vehicle Fund is appropriated and under the law, shall be paid
from the Motor Vehicle Fund to the counties of this State in
proportion to the number of vehicles registered in such counties
as determined by the places of residence of the owners to whom
the registration certificates are issued; and

WHEREAS, the Board of Supervisors of this County may in

their discretion, expend any portion of such sums so received from
•

said Motor Vehicle Rind in the construction, maintenance and re-
4
pair of streets, bridges and culverts, within those incorporated
5
cities therein the legislative bodies of which by ordinance or
6
resolution authorise such work of construction, maintenance and
7
repair; and

MWREAS, certain cities of the County of Orange have from
9
time to time received from the Board of Supervisors of the
to
County of Orange, a portion of said funds for the purpose of
11
construction, maintenance and repaar of certain streets within
12
their incorporated limits; and

F1iiEREAS, the City of Newport Beach has not since the
14
establishing of said fund, received any money whatsoever from
15
said fund; and
16
TAEREAS, the City of Newport Beach is desirous of paying
17
the interest on said bonds in default, known as the Corona Del
18
Mar bonds, to the end that their credit may not be impaired; and
19
WHEREAS, the City of Newport Beach believes that they are
20
entitled to their just proportion of said motor vehicle fund so
21
received by the County of Orange, and that an appropriation by
22
the County of Orange should be wade to tine City of Newport Beach
23
for the maintenance, and repair of their streets,and more
24
particularly those streets which are used by great numbers of
25
residents of said County of Orange, within said City of Newport
26
Beach.

NOW, THEREFORE, BE IT RESOLVED: That the City Clerk of
28
tge City of Newport Beach be authorised, directed and instructed
•
29
to request of the Board of Supervisors of the County of Orange,
30
an appropriation from the Motor VehioDle Fund, in the sun of
31
"$25,200.00, for the maintenance and repair of the streets of the
32
City of Newport Beach, for the fiscal year ending March 1, 1933.

BE IT FURTHER RESOLVED: That a certified copy of this
resolution accompany said request from said City, for said stem
of 0250200,00.
BE IT FURTER RESOLVED: That if said Board of Super-
viser8 of the County of Orange, are unable to grant the full
amount requested that they make such appropriation to said City
of Newport Beach from the Motor Vehicle Fund for the purpose
stated, as they are at this time able to make, from the funds
atrailable.
I hereby certify that the foregoing Resolution was duly
and regularly passed by the City Council of the City of Newport
Beach at a regular meeting thereof held on the 4th day of July,
