RESOLUTION NO.
WHEREAS, there has tliis day been presented to the City
Counci the City of Neraport Beach an Agreement dated the llQ.-
day of. anuA w 1933 by and between the City of
Newport Beach, as the party of the first part, and C.E. McFarland,,
as the party of the second part; and
17HEREAS, said Agreement specifies that the party of the
first part is the owner of two certain piers or wharfs extending
out into the Pacific Ocean, one being at Newport Beach and the
other at Balboa; and
WHEREAS, the party of the second part is the owner of
stationary fishing barges anchored ordinarily vithin the three
mile limit of the shore line of the City of Newport Beach; and
WHEREAS, the party of the first part desires to regulate
the loading and unloading of passengers and patrons going to and
from said fishing barges anchored in the Pacific Ocean aforesaid,
in so far as said loading and unloading of passengers is done on
said piers or wharfs; and
WHEREAS, said party of the first part desires to grant
to the party of the second part the exclusive license for a per
of one year from the date of said agreement, to load and unload
passengers and patrons as aforesaid from said piers or wharfs to
said fishing barges, upon the terms and conditions in said
agreement set forth; and
:AREAS, it is for'tha best interests of the City of
Newport Beach that said %Aidnse be granted,
NOW, THEREFORE, BE IT RESOLVED: That said agreement be,
and the same is hereby approved as written by the City Council
of the City of Newport Beach, and the Mayor of said City and the
City Clerk of said city of Newport Beach shall, and they are
hereby authorized and directed to sign the same on behalf of the
City of Newport Beach, and the Clerk is directed to have the par
