A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEiPORT BEACH CALLING A SPECIAL MUNICIPAL ELECTION
TO BE HELD IN SAID CITY OF NEVIPORT BEACH ON FRIDAY,
THE 5th DAY OF MAY, 1933, FOR THE PURPOSE OF SUB-
MITTING TO THE QUALIFIED ELECTORS OF SAID CITY TWO
CERTAIN PROPOSITIONS, FIXING THE PRECINCTS AND
POLLING PLACES, FOR THE HOLDING OF SAID ELECTION,
AND APPOINTING OFFICERS FOR SAID ELECTION, AND
FIXING THEIR COMPENSATION.
WHEREAS, certain citizens of the City of Newport Beach
have requested that Ordinance No. 52 of said city be repealed,
and a new ordinance substituted in its place and stead, providing
for the holding of boat raoes.in the course of which unmuffled
engines may be used by the contestants, upon the waters of the
open ocean and the waters of Newport Bay, within the city limits
of the City of Newport Beach, along and over a course to be
designated, defined and described by the City Council of the City'
of Newport Beach, and providing that. permits granted for said
racing, shall be for a period of time not to exceed three (3)
hours, and the entire period of time for which such special
permit is to be granted, to fall between the hours of eight
o'clock A. ME and five o'clock P. M., and
WHEREAS, a petition signed by the requisite number of
qualified electors of the City of Newport Beach, under the law
as provided for in Statutes of 1911, page 599, and known as the
Local Option Law, has been duly presented to the City Council
of the City of Newport Beach; and
WHEREAS, under the law it is provided that upon the
presentation of such petition, certified by the Clerk of said
City as being sufficient, it is incumbent upon said 'city to
call an election within six (6) months and not lessthan forty
(40) days before the holding of the neat general State or general

Municipal election in said city, and if no general state or
general municipal election is to be held, it is the duty of said
city council of said city to call a special election to vote upon
the propositions hereinafter stated, to -wit, the proposition of
whether or not the sale of alcoholic liquors shall be licensed
in the City of Newport Beach.
NOW2 THEREFORE, THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DO RESOLVE AS FOLLOWS:
Section 1. That a special municipal election be .held
and the same is hereby called to be held in the City of Newport
Beach on Friday, the 5th day of May, 1933, for the purpose of
submitting to the qualified electors of said city the propositions
hereinafter stated and set forth.
Section 2. That said propositions to be voted upon
at said election so to be held as aforesaid, are as follows:
FIRST PROPOSITION
Shall the sale of alcoholic liquors be
licensed in this city, to -wit, theCity
of Newport Beach?
SECOND PROPOSITION
Shall Ordinance No. 52 of the City of
Newport Beach be repealed and a new
ordinance enact @d, permitting boats to
race with unmuffled engines within the
waters of Newport Beach, upon the con-
ditions and restrictions stated in said
new proposed ordinance?
Section 3. That the polls for said election must be
opened at seven o'clock A. M. of the date of said election, and
must be kept open until seven o'clock P. M. of the same day,
when the polls shall be closed, provided, however, that if at the
time of closing there are any other voters in the polling place,
or in line at the door, who are qualified to vote, and $rave not
able to do so since appearing, the polls shall be kept open a
sufficient time to enable them to vote, but no one who shall av
at the polling place after seven o'clock P. m. shall be entitled
vote, although the polls may be open when he arrives.

Section 4, That the ballots to be used at said
election shall contain the following propositions to be voted
upon by the qualified electors of said city of Newport Beach,
at such election so called to be held on the 5th day of May,
111933, in said city, to -wit:
FIRST PROPOSTION
Shall the sale of alcoholic liquors be

SECOND PROPOSITION
Shall Ordinance No, 52 of theCity of Newport
Beach be repealed and a new ordinance enacted,
permitting boats to race with unmuffled engines
within the waters of Newport Beach, upon the
conditions and restrictions stated in said new
proposed ordinance?
Opposite the first proposition and to the right
of such first proposition shall be printed the words "Yes" and
"No ". Such two words shall be printed on separate lines with
voting squares opposite the same, and opposite the second
proposition shall be printed the words "Yes" and `tNc". Such two
words shall be printed on separate lines with voting squares
opposite the same, and said ballots shall be so printed as to
give each voter a clear opportunity to designate by stamping a
cross W in the blank enclosed space on the right of, and after
each of said words "Yes" and "Noh, his wish or choice upon said
propositions, and said ballots shall be printed substantially
in the following form:

INSTRUCTIONS TO VOTERS
To vote on the first proposition and for license,
electors shall stamp a cross (x) in the voting square opposite
the word flyes" on the ballot, and to vote against license, the
electors shall stamp a cross (x) in the voting square opposite
the word "No" thereon.
To vote for the second proposition, electors shall
stamp a cross (x) opposite the word "Yes" on the ballot, and to
vote against the second proposition, the electors shall stamp
a cross (x) opposite the word 'Non thereon.
All marks except the cross (x) are forbidden. All
distinguishing marks or erasures are forbidden and make the
ballot void.
If you wrongly stamp, tear or deface this ballot,
return it to the Inspector of Election and obtain another.
The voter is instructed that he or she may vote for

Section 7. The judges and inspectors of such
election shall immediately upon closing the polls, count the
ballots, make up and certify the returns of the ballots cast
at the respective polling places as quickly as practicable in
the manner provided by the laws of this State, and deposit all
of said returns with the Clerk of said City of Newport Beach.
Section 8. That the compensation to be paid to
each of said officers of election for all services by each of
said officers to be xendered at said special municipal election
shall be, and'the same is hereby fixed at the sum of Five
.Dollars (05.00).
Section 9. That said special municipal election
shall be held in every manner, other than herein specifically
set forth, wholly in accordance with the election laws of the
State of California, in so far as said election lams are appli-
cable to municipal elections in cities of the sixth class of
the State of California.
Section 10. That the City Council of the City of
Newport Beach shall meet at its usual place of business on Monday,
the 8th day of May, 1933, at the hour of seven o'clock P. M. and
proceed to open and canvass the returns of said election and
declare the result thereof; and immediately upon the completion
of such canvass, cause a report thereto to be made and entered
upon its minutes, showing the whole number of vote cast and the
number of Yes Votes cast on the first proposition and the number
of Yes Votes cast on the second proposition, and if it shall
appear from a canvass of said votes on said proposition No. 1
that a majority of the votes cast are in favor of license, it
shall thereupon be declared by said City Council that said City
of Newport Beach shall cease to be No License Territory within
the meaning of the Local Option Law. if it shall appear from a
canvase.of the votes that a majority of the votes are in favor of
