RESOLUTION NO.
WHEREAS, Sierra Service Organization, searchers of
records, have ascertained from the public records that approxi-
mately ten (10) years ago there was deposited by the City of
Newport Beach with the Clerk of the County of Orange, the sum
of approximately $1500.00, which deposit was made pursuant to
law in action No. 13707 in the Superior Court of the State of
California, in and for the County of Orange; and
WHEREAS, said suit has been determined and the City
has for a number of years been entitled to the refund of said
money; and
WHEREAS, said money was deposited during another
administration and there are no officers of the City of Newport
Beach of said administration now in office who might or do have
knowledge of said deposit; and
WHEREAS, the present City Council and the officers
of the City of Newport Beach were not aware of the fact that
said money had been so deposited in said action, or that the
City was entitled thereto; and
WHEREAS, said searchers of records discovered said
fact and did on or about the 10th day of July, 1933, submit to
said City Council of the City of Newport Beach, a proposition
to the effect that they had discovered certain moneys due and
owing to said city, and that they would obtain the same for said
city, or notify said city how the same might be obtained, for a
commission of one -third (1/3) of the amount recovered; and
WHEREAS, said city accepted said proposition of said
Sierra Service Organization, provided, however, that the
recovery of said money would not involve said city in litigation

or in any way affect citizens or tax payers of said city in so
far as litigation was or.is concerned, and further that said ci
could lawfully and legally pay a commission for the recovery of
said money; and
WHEREAS, it is the belief of the City Council of
the City of Newport Beach that said money[ would not have been
recovered had it not been for said searchers of records, and
further that said searchers of records have met the requirements
of the city of Newport Beach in respect to the matters and
things hereinbefdre mentioned.
NOW, THEREFORE, BE IT RESOLVED: That upon the
recovery of said money in said action aforesaid, without litiga-
tion or expense to the said City of Newport Beach, that the City
of Newport Beach will, upon proper demand made therefor, pay to
the said Sierra Service Organization aforesaid, an even one -thir
(1/3) of all moneys by them recovered or obtained in said action
No. 13707 aforesaid.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach, at a regular meeting
thereof held on the 6th day of November, 1933, by the following
vote, to -wit:

said City Council held at the regular meeting place thereof, on
