RESOLUTION NO.
PRELIMINARY DETETRMINATION OF LEGISLATIVE
BODY UNDER °SPECIAL ASSESSMENT INVESTIGATION,
LIMITATION AND MAJORITY PROTEST ACT OF 19311
AND AMENDMENTS THERE(DO.
BE IT RESOLVED by the City Council of the City of
Newport Beach that certain improvements are proposed to be
done and made within the boundaries of the proposed assess-
ment district hereinafter described. In connection there-
with said City Council hereby finds and determines as
follows, to -wit:
1. That the nature of the proposed improvements
consists of a wooden bulkhead to protect Channel Road and
other property in the City of Newport Beach from overflow
by water.
2. The location and extent of the proposed improve-
melts will involve the construction of the above described
improvements upon the following described tide lands or
submerged lands owned by the City of Newport Beach, within
the boundaries of the proposed assessment district herein-
after described, to -wit:
Adjacent to and easterly of the easterly line of
Lot M, as shown on a map of Tract No. 518, as recorded in
Book 17, pages 33 to 36 inclusive of Miscellaneous Maps,
Records of Orange County, California, and the easterly line
of Lot 1 of Block P of said Tract No. 518 and extending from
a line parallel with and 14.50 feet southerly of the easterly
prolongation of the northerly line of Lot 16 of said Block P
to the easterly prolongation of the southerly line of Lot 1
of said Block P.
3. All of the proposed improvements are shown on the
plans, profiles and cross sections for the improvement of

certain tide lards and submerged lands in the said city,
being Plan No. 399, consisting of one sheet, on file in
the office of the City Clerk of said city and described in
the specifications for the improvement of certain tide lands
and submerged lands in the said city, heretofore approved
' • by the City Council of said city, and reference is hereby
made to the said plans, profiles, cross- sections and spe-
cifications for a further, full and more particular des-
cription of the said improvement and by reference thereto
the same are incorporated herein and made a part hereof.
4. The boundaries of the district of lauds proposed
to be specially assessed to pay the costs and expenses of
sw h proposed work and improvement are generally defined
as follows, to -wit:
Beginning at the northwest corner of Lot 16 of
Block P, as shown on a map of Tract No. 518, recorded in
Book 17, pages 33 to 36 inclusive, of Miscellaneous Maps,
Records of Orange County, California, running thence easter-
ly along the northerly line of said Lot 16 and the easterly
prolongation of the said northerly line, a distance of 110
feet; thence southerly along a line parallel to the easterly
line of said Tract No. 518 to an intersection with the eas-
terly prolongation of the southerly line of Lot 1 of said
Tract No. 518; thence westerly along the last mentioned
easterly prolongation and the southerly line of said Lot 1
to the most southerly corner of said Lot 1; thence northerly
along the westerly line of said Block P to the point of be-
ginning.

assessment district, numbered 398, approved by the City
Couhnil on the 4th day of June, 1934 is on file in the
office of the City Clerk of said city. Reference is here-
by made to said plat, so on file for a further, full and

duct proceedings for the proposed improvement is the "Im-
provement Act of 191111, approved April %, 1911 and Amend-
ments thereto, with serial bonds bearing interest at the
rate of seven per cent ( % %) per annum to be issued to re-
present each assessment of twenty -five and no /100 ($25,00)
dollars, or more remaining unpaid for thirty (30) days
after the date of the warrant, said serial bonds shall ex-
tend over a period ending nine (9) years from the second
day of January next succeeding the fifteenth day of the
next November follorrIng their date. Payments on the princi-
pal of unpaid assessmeats and interest shall be made by
the property owners to the City Treasurer, and the same
shall be disbursed by him, all asprovidedin the "Improve-
ment Act of 19111' hereinbefore referred to.
I hereby certify that the foregoing resolution
waa duly and regularly adopted by the Countil of the
City of Newport Beach at a regular meeting thereof,
