RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH CALLING SPECIAL MUNICIPAL ELECTION TO BE HELD IN
SAID CITY OF NEWPORT BEACH ON THURSDAY , THE a

DAY OF SEPTEMBER , 1934, FOR THE PURPOSE OF SUBMITTING
TO THE QUALIFIED ELECTORS OF SAID CITY CERTAIN PROPOSI-
TIONS NUMBERED TO CONSECUTIVELY, FOR
THE GRANTING TO 'iH � ITED S T S OF AMERICA CERTAIN TIDE
LANDS AND SUBMERGED LANDS, BE ONGING TO THE SAID CITY,
FIXING THE PRECINCTS AND POLLING PLACES FOR THE HOLDING
OF SAID ELECTION, AND APPOINTING OFFICERS FOR SAID ELECTION,
AND FIXING THEIR COMPENSATION.
WHEREAS, the United States of America, by and through
its proper governmental authorities, contemplates the improvement
of Newport Harbor, in the city of Newport Beach, in Orange County,
California; and
WHEREAS, said improvement of Newport Harbor by the
United States of America, contemplates in part the dredging of
portions of Newport Harbor and the repair, conditioning, con-
struction and reconstruction of the East and West Jetties in said
city; and
WHEREAS, in order to properly carry out the said im-
provements of Newport Harbor, it is necessary that certain tide
lands and submerged lands belonging to the said city be deeded
to the United States of America; and
WHEREAS, the City of Newport Beach is authorized and
empowered to grant all or any portion of tide lands and /or sub-
merged lands hereinafter in this Resolution more particularly
described; and
WHEREAS, the said United States of America intends to
use said tide lands and submerged lands hereinafter described,
for public and governmental (including military and naval)
purposes of the United States, in connection with the said
improvement of the said Newport Harbor, in the city of Newport
Beach, Orange County, California; and

HEREAS, the tide lands and submerged lands belonging
to the said city of Newport Beach, and which were - acquired
(except as hereinafter stated after Parcel "B "), by the city of
Newport Beach from the State of California, are described as
follows, to =wit:
All that certain real property situated in the city
of Newport Beach, County of Orange, State of California, and
described as follows, tc —wit:
PARCEL "A"
Beginning at the southwesterly corner of Lot 14, Block
"E ", Tract 518., as shown on a map recorded in Book 17, pages
33 to 36 inclusive, of Miscellaneous Maps, Records of Orange
County, California; running thence easterly along the north-
erly line of Lot J of said Tract 518, 381.38 feet to the north-
easterly corner of said Lot J; thence south 150 OOSEast along
the easterly line of said Lot J and the southerly prolongation
of said easterly line, a distance of 266.33 feet; thence due
West to an intersection with the ordinary high tide line of the
Pacific Ocean; thence northwesterly along said ordinary high
tide line of the Pacific Ocean to an intersection with a line
which bears south 270 001 West from the point of intersection
of the southerly prolongation of.the Westerly line of Lot 14,
Block "E", of said Tract 518 with the southerly line of said

westerly corner of Lot 1, Block P of said Tract 518; running
thence North 750 009.East 70 feet to a point in the United
States Bulkhead line between U. S. Station 107 and U. S.
Station 108, as said bulkhead.line is laid out and shown upon
a map of Newport Bay showing harbor lines, and approved by the
U. S. year Department, January 18th, 1917, and on file in the
office of the U. S. District Engineer in Los Angeles, California;
running thence south 150 001 East along the said bulkhead line

And, WHEREAS, the City of Newport Beach may not, under the law
make the grants herein specified to the said United States of
America, until the same shall be authorized and approved by a
vote of a majority of the electors of the city of Newport Beach
voting upon the proposition of making such grants, and each of
them, at an election to be held in said city, at which election
the propositions herein mentioned shall be submitted; and
WHEREAS, the tide lands and submerged lands in this
Resolution described were heretofore by legislative act of the
State of California, granted to the City of Newport Beach, except
however, such portion of said Parcel "B" which was heretofore
granted to said city by said deed from Joseph Ferguson and wife.
NOW, THEREFORE, the City Council of the city of Newport
Beach does resolve as follows:
Section 1. That a special municipal election be held,
and the same is hereby called to be held, in the city of Newport
Beach, in Orange County, California, on Thursday , the 20th
day of September_, 1934, for_ the purpose of submitting
thereat, to the qualified electors of the said city, the question
of whether or not the grants herein described shall be made by
the city of Newport Beach to the United States of America, for
public and governmental (including military and naval) purposes
of the United States.
Section 2. That said propositions to. be voted on at
said special election so to be held as aforeeaid, are in this
Resolution hereinafter, to -wit, in Section 4, of this Resolution,
more particularly set forth in the form of Ballot described
particularly in said Section 4.
Section 3. That the polls for said election must open
at six. o'clock A. M. of the date of said election, and must be
kept open until seven o'clock P. M. of the same day, when the

polls shall be closed, provided, however, that if at the hour of
closing there are any other voters in the polling place or in the
line at the door who are qualified to vote and have not been able
to do so since appearing, the polls shall be kept open a
sufficient time to allow them to vote, but no one who shall arrive
.at the polling place after seven o'clock P. M. shall be entitled
to vote, although the polls may be open when he appears.
Section 4. That the Ballots to be used at said election

Shall the City of Newport Beach grant to the United
States of America, for public and governmental (including
military and naval) purposes of the United States of America,
those certain tide lands or submerged lands situated in the
City of Newport Beach, and more particularly described as
follows, to -wit:
Parcel "A"
All that certain land situated in the city of Newport
Beach, County of Orange, State of California, described as
follows, tc -wit:
Beginning at the southwesterly corner of Lot 14, Block
"E", Tract 518, as shown on a map recorded in Book 17, pages 33
to 36 inclusive, of Miscellaneous Maps, Records of Orange County,
California; running thence easterly alongthe northerly line of
Lot J of said Tract 518, 381,32 feet to the northeasterly corner
of said Lot J; thence south 150001 East along the easterly line
of said Lot J and the southerly prolongation of said easterly
line, a distance of 266.33 feet; thence due West to an inter-
section with the ordinary high tide line of the Pacific Ocean;

Opposite each of the said propositions and to the right.,
thereof on said ballot the words "Yes" and "No" shall be printed
on separate lines with voting squares opposite the same, and the
said ballots shall be so printed as to give each voter a clear
opportunity to designate by stamping a cross (x) in the blank
enclosed space on the right of and after each of said words "Yes"
and "No", his wish or choice upon said propositions, and said
ballots shall be printed substantially in the following form:

INSTRUCTIONS TO VOTERS:
To vote on the first proposition and for the grant by the
City of Newport Beach to the United States of America, electors
shall stamp a cross (x) in the voting square opposite the word
"Yes" on the ballot, and to vote against said grant by the city
of Newport Beach fo the United States of America, the electors
shall stamp a cross (x) in the voting square opposite the word
"No" thereon.
To vote on the second proposition and for the grant by
the City of Newport Beach to the United States of America,
electors shall stamp a cross (x) in the voting square opposite
the word NYes" on the ballot, and to vote against said grant by
the city of Newport Beabh to the United States of America, the
electors shall stamp a cross (x) in the voting square opposite
the word "No" thereon.
To vote on the third proposition and for the grant by
the City of Newport Beach to the United States of America,
electors shall stamp a cross (x) in the voting square opposite
the word "Yes" on the ballot, and to note against said grant by
the city of Newport Bdamh, to the United States of America, the
electors shall stamp a cross (x) in the voting square opposite
the word "No" thereon.

the City of Newport Beach go the United States of America,
electors shall stamp a cross (x) in the voting square opposite
the word "Yes" on the ballot, and to vote against said grant
by the city of Newport Beach to the United States of America,

opposite the word "No" thereon.
