RESOLUTION NO. &M
WHEREAS, under date of August 30th, 1934, there appeared
in an issue of the Santa Ana Register of Santa Ana, California,
the following headlines, "Fraud Charged in Newport Beach Municipal
Election" and "Accusations are made by L. A. Lawyer "; and
WHEREAS, in the article following said headlines it was
stated that a letter had been sent to Mayor Hilmer listing certain
alleged violations of the election laws at the time of the
municipal election of April 9th, 1934, some of which alleged
violations constituted misdemeanors, and other of said alleged
violations, felonies; so it was stated in said article; and
WHEREAS, said article in said newspaper was and is the
first information that members of the City Council of the City
of Newport Beach had concerning said alleged letter, charging
said alleged violations, and the first intimation that any of
the election.laws had been,.bre..ached as therein alleged, except
that this City Council was informed by affidavit that a certain
elector of the City of Newport Beach had voted in the wrong
precinct, and upon investigation found that such was the case,
but that said elector had a.vote in another precinct of said
City, and that he had innocently voted in the wrong precinct; andl
WHEREAS, said alleged letter was anonymous in character
in that said L. A. lawyer does not name the clients whom he
purports to represent, although admitting that he does represent
certain clients in the controversy in question; and
WHEREAS, it further likewise appears from said article
in said newspaper that the charges made by said L. A. lawyer
on behalf of certain Newport Beach clients, are not specifically
made against any named individual or individuals, but on the
contrary are general charges and therefore effect everyone
connected with said election; and

investigation concerning the alleged irregularities complained
of in said article in said newspaper aforesaid, and to that end
of the City of Newport Beach
and purpose, the full law enforcement agencies /are placed at the
disposal of the office of the District Attorney of Orange County,
California.
BE IT FURTHER RESOLVED: That the Chief of Police of the
City of Newport Beach be and he.is hereby directed and instructed
to cooperate in every manner possible with the office of the
District Attorney of Orange County, California, to the end and
purpose that a full and complete investigation of the charges
made in said newspaper article aforesaid, be had, and if there
is found to be any wilful culpability on the part of any person
connected with said election, that the proper steps be taken
to bring said person or persons before the Bar of Justice.
BE IT FURTHER RESOLVED: That a copy of this Resolution
be sent by the Clerk of the City of Newport Beach, forthwith
to the Honorable S. B. Kaufman, District Attorney of Orange
County, California, for his consideration.
The above and foregoing Resolution was duly and regularly
passed and adopted by the City Council of the City of Newport
Beach, at a regular meeting thereof held on the 3rd day of
September, 1934, by the following vote, to-wits

Beach, California,. do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution Noe 840 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 3rd day of September , 19 34 by the following
vote, to wit:
