• { RESOLUTION NO. P4_ .RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NENPORT BEACH, CALIFORNIA, DETERMINING THE NATURE, LOCATION AND EXTENT OF THE PRO- POSED IMPROVEMENT FOR THE CONSTRUCTION OF CERTAIN CEI:4ENT CONCRETE BULKHEAD AND APPUR- TENANCES TO PROTECT THE STREETS, AVENUES, LANES, ALLEYS AND PUBLIC WAYS AND OTHER PROPERTY IN BALBOA ISLAND, SITUATED IN NEW - PORT BAY, FROM THE OVERFL ©V BY WATER; THE CONSTRUCTION OF CERTAIN CEMENT CONCRETE SIDEWALK; THE INSTALLATION OF CERTAIN LIGHT - ING CONDUIT; THE MOVING AND REPLACING OF CERTAIN EXISTING ORNAMENTAL LIGHT POSTS OR STANDARDS; THE CONSTRUCTION OF CAST IRON PIPE STORM DRAINS; AND THE CONSTRUCTION OF FIVE WOODEN AND CELIENT .CONCRETE PIERS, TO- GETHER WITH FLOATING MOORINGS,IN AND AROUND THE SAID BALBOA ISLAND IN THE CITY OF NEW - PORT BEACH, CALIFORNIA; GENERALLY DEFINING THE BOUNDARIES OR EXTENT OF THE DISTRICT TO BE SPECIALLY ASSESSED TO PAY THE COST THEREOF; AND DETERMINING THE STATUTE UNDER WHICH IT IS PROPOSED TO CONDUCT THE PRO - CEEDINGS, PURSUANT TO THE PROVISIONS OF SECTION 2 OF THE "SPECIAL ASSESSMENT INVES- TIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931." WHEREAS, the City Council of the City of Newport Beach, California, did on the 16th day of September, 1935, instruct the City Engineer of said City to procure and prepare a written report, pursuant to Sections 2 and 3 of the "Special Assess- ment Investigation, Limitation and Majority Protest Act of 19315" as amended, and thereafter the said City Engineer presented to this City Council, on the 30th day of September, 1935, Plan No.400, consisting of 12- sheets, showing the said improvement as proposed, and also a map of the proposed • assessment district, No. 401, for consideration; and WHEREAS, pursuant to the provisions of Section 2 of the 'Special Assessment Investigation, Limitation and Majority Protest Act of 1931,t1 as amended, the City Council must by ti^ resolution or ordinance determine in general the nature, location and extent of the proposed improvement; also generally define the boundaries or extent of the district or lands to be specially assessed to pay the cost thereof, or any part of such cost, and determine the statute under which it is proposed to conduct the proposed proceedings; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, DOES HEREBY DETERIli4INE AND RESOLVE, AS FOLLOWS.: 1.. That the proposed improvement mentioned in the title of this resolution is more particularly described as follows: First: The construction of a cement concrete bulkhead and appurtenances, together with the construction of cement concrete sidewalk, in and adjacent to South Bay Front of Balboa Island, between East Bay Front and the southwesterly prolongation of the southeasterly line of Emerald Avenue, except where the said Plan No.400 shows said work to be omitted. Second: The construction of a cement concrete bulkhead and appurtenances, together with the construction of cement concrete sidewalk, in and adjacent to North Bay Front of Balboa Island, between the southwesterly line of Park Avenue and the West Promenade of The Grand Canal in said Balboa Island, except where said,'Plan No.400 shows said work to'be omitted. Third: The construction of a cement concrete .bulkhead and appurtenances, together with the construction of cement concrete sidewalk, in and adjacent to East Bay Front of Balboa Island, between the East Promenade of The Grand Canal in said Balboa Island and South Bay Front of Balboa Island, -2- 67 E Fourth: The construction of a cement concrete bulkhead and appurtenances, together with the construction of cement concrete sidewalk, in and adjacent to the East Promenade of The Grand Canal in Balboa Island, between East Bay Front and the norther- ly line of Park Avenue in said Balboa Island. Fifth: The installation of certain lighting conduit and appliances in the bulkhead to be Gor��`F'ru c'Fcq � as herein described, along and adjacent to South Bay Front, together with the moving and relocating on the top of said bulkhead of certain existing ornamental light posts or standards, as shown upon Sheet No,8 of ?Plan No.400 herein referred.to; the installation of certain lighting conduit and appliances in South Bay Front between the southeasterly line of said Emerald Avenue and the southwesterly line of said Park Avenue; the installation of certain lighting conduit and appliances in the bulkhead to be constructed as herein described, along and adjacent to North Bay Front, to- gether with the moving and relocating on the.top of said bulk- . head of certain existing ornamental light posts or standards, as shown upon Sheet No.8 of said Plan No.400 herein referred to; the installation of certain lighting conduit and appliances in the bulkhead to be constructed as herein described, along and adjacent to East Bay Front, together with the moving and re- . locating on the top of said bulkhead of certain existing ornamental light posts or standards, as shown upon Sheet No.8 of said Plan No.400 herein referred to; and the installation of certain lighting conduit and appliances in North Bay Front, between.a line 20 feet westerly from the westerly line of West Promenade in The Grand Canal and the said West Promenade; thence -3- ,. along the. West Promenade, between North Bay Front and South Bay Front; thence along South Bay Front, between West Prome- nade and a line 61 feet westerly therefrom; in East Promenade, between the northerly line of the first alley lying.northerly of South Bay Front and South Bay .Front; and thence in South Bay Front, between East Promenade and a line 91.10 feet east- erly therefrom. Sixth:.The construction of certain cast iron pipe storm drains, at the terminations in South Bay.Front of Crystal Aveni,Xe, Marine Avenue, Onyx Avenue, Amethyst Avenue, Apolena Avenue, Coral Avenue, Sapphire Avenue, Ruby Avenue, Topaz Avenue, Opal Avenue, Agate Avenue, Pearl Avenue, Garnet Avenue, Emerald Avenue and Park Avenue; the construction of certain cast iron pipe storm drains, at the terminations in North Bay Front of Park Avenue, Emerald Avenue, Garnet Avenue, Pearl Avenue, Agate Avenue, Collins Avenue, Ruby Avenue, Diamond Avenue, Sapphire Avenue, Coral Avenue, Apolena Avenue and Amethyst Avenue; the construction of certain cast iron pipe storm drains, at the terminations in East Promenade of the said Grand Canal of Crystal Avenue and Balboa Avenue; and the construction of.certain cast iron pipe storm drains at the terminations in East Bay Front of Balboa Avenue and Park Avenue. Seventh: That five (5) public piers of wooden and cement concrete construction, including piles, decks, guard rails and floating moorings, with structures and applianees necessary and convenient thereto, together with posts, wires, cables, conduits, a lighting unit and suitable and necessary appliances for the purpose of lighting said public piers, be constructed at the following locations, to -wit: sm 1P 41 _ One extending approximately 87 feet from the bulkhead • to be constructed along East Bay Front at Park Avenue; One extending approximately 107 feet from the bulkhead to be constructed along South Bay Front at Coral Avenue; One extending approximately 86 feet from the bulkhead to be constructed along South Bay Front at Opal Avenue; One extending approximately 76, feet from the bulkhead to be constructed along North Bay Front at Emerald Avenue; a nd One extending approximately 87 feet from the bulkhead to be constructed along North Bay Front at Apolena Avenue. The said construction and improvement of the aforesaid bulkheads is deemed necessary and convenient to protect the streets, public ways and other property in that certain territory of the City of Newport Beach, commonly known and referred to as Balboa Island, from the overflow by water. That each of the aforementioned public piers and mooring places is deemed necessary and convenient for the promotion or accommodation of commerce, navigation, and the protection of land within said City of Newport Beach, and for aiding and securing access to the waters of Newport Bay to the people of the State of California in the exercise of their rights to fish, and for the extension of public streets or places. 2. That the boundaries of the district or lands to be specially assessed to pay t portion of the cost of said proposed improvement are more particularly described as follows: Beginning at the northeasterly corner of Lot '1, Collins Isle, as shown upon a map �- of,Re- subdivision of Section 1, Balboa Island, recorded in Book 6, Page 30 of Miscellaneous Maps, Records of Orange County, California; running thence north-easterly in a direct line -5- . s to a point in the northerly prolongation of the westerly line of-Lot 12, Block 2 of said Re- subdivision of Section 1, which point is 110 feet northerly of the northwesterly corner of said Lot 12, Block 2; running thence east- erly in a direct line to a point in the north- erly prolongation of the westerly line of Lot 14, as shown on a map of Tract No.742, recorded in Book 23, Page 42 of Miscellaneous Maps, records of said county, which point is 150 feet northerly of the most northerly corner of said Lot 14; thence southeasterly in a direct line to a point in the easterly prolongation of the northerly line of Park Avenue, as said Park Avenue is shown on a map of Section 5, Balboa Island, recorded in Book 8, Page 9 of Miscellaneous Maps, records of said county, which point is 350 feet easterly of the southeasterly corner of Lot 13 in Block 5 of said Section 5; thence southwesterly in a direct line to a point in the southerly prolongation of the easterly line of Lot 7, Block 4 in said Section 5, which point is 140 feet southerly of the southeasterly corner of said Lot 7, Block 4; thence westerly in 'a direct line to a point in the southwesterly prolonga- tion of the southeasterly line of Topaz Avenue, as said Topaz Avenue is laid out and shown upon the map of said Re- subdivision of Section 1, Which point is 210 feet southwesterly from the southwesterly corner'of Lot 1 in Block 13 of said Re- subdivision of Section 1; thence northwest- erly in a direct line to a point in the south- westerly prolongation of the southeasterly line of Emerald Avenue, as said Emerald Avenue is laid out and shown on a map of said Re- subdivision of Section 1, which point is 320 feet south- westerly of the southwesterly corner of Lot 1 in Block 3 of said Re- subdivision of Sectiom 1; thence northerly in a direct line to the point of beginning, excepting from said district all public streets, avenues, alleys, public ways, tide, submerged and overflowed lands. A map of said district, No. 401, indicating by a d , boundary line the extent of the territory included within the proposed assessment district, is on file in the office of the City Engineer of the City of Newport Beach. Reference is hereby made'to said.map for a further, full and more complete description of the said assessment district, and the said W . CO map so on file shall govern for all details as to the extent of the said assessment district. 3. That a portion of the cost of said improvement shall be assessed against the lands to be benefited thereby and herein described. 4. That the said proposed improvement shall be made under t he.provisions of the "Improvement Act of 1911," approved April 7th, 1911, and amendments thereto. And that serial bonds bearing interest at the rate of seven per cent (7%) per annum, shall be issued to represent each assessment of Twenty -five Dollars (25.00), or more, remaining unpaid for thirty (30) days after the date of.the warrant. Said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October fifteenth following their date. Said bonds to be issued under and pursuant to the provisions of the said "Improvement Act of 1911."
