CALIF. 0 RESOLUTION NO. —=--�— A.RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEVIP(R T BEACH DECLARING ITS INTENTION TO ORDER THE CLOSING UP AND ABANDONMENT OF A PORTION OF THAT CERTAIN 'STREET KNO17N AS OCEAN BOULEVARD; DECLARING IT TO BE FOR THE PUBLIC INTER- EST AND CONVENIENCE, AND FIXING THE TIME AND PLACE FOR 'HEARING OBJECTIONS TO SAID PROPOSED IMPROV`r.MER T, AND SPEC- IFYING THE EXTERIOR BOUNDARIES OF THE DISTRICT OF LANDS TO BE AFFECTED OR BENEFITED BY SAID WORK OR IMPROVEMENT AND TO BE ASSESSED TO PAY THE DAMAGES, COST AND EXPENSES THEREOF. The City Council of the City of Newport Beach, pursuant to the provisions of an act of Legislature of the State of California, known as "Street Opening Act of 1889 ", approved March 6th, 1889, and amendments thereto, does resolve and declare as follows: Section 16 That the public interest and convenience requires the closing up and abandonment of a certain portion of that certain street known as Ocean.Boulevard in the city of Newport Beach, and it is the intention of the City Council of the city of Newport Beach to order the following described portion of said Ocean Boulevard in said City to be closed up and abandoned, to -wit: Ocean Boulevard: All that portion of Ocean Boulevard, as said Ocean Boulevard' is laid out and shown upon a map of resubdivision of Corona Del Mar, recorded in Book 4, page 67 of Miscellaneous Maps, Records of Orange County, California, described as follows, to wit: Beginning at the point of intersection of the southwesterly I line of said Ocean Boulevard, with the southwesterly prolongation, of the northwesterly line of Carnation Avenue, formerly known as 30th Avenue, as said 30th Avenue is shown on said Map of Corona Del Mar; running thence southeasterly along the said southwest- erly line of Ocean Boulevard 93 feet; thence northerly in a direct line to a point in the southwesterly prolongation of the northwesterly line of said Carnation Avenue, which point is 56 feet from the point of beginning;, thence southwesterly along the said southwesterly prolongation of the northwesterly line of Carnation Avenue, 56 feet to the point of beginning. Section 2. That the exterior boundaries of the district or lands to be affected or benefited by said work or improvement and to be assessed to pay the damages, cost and expenses thereof, are particularly described as follows, to -wit: Dbginning at a point on the southerly line of Ocean Avenue, as said Ocean Avenue is laid out and shown upon a map of Corona Del Saar, recorded in Book 3, pages 41 and 42, Miscellaneous Sups, Records of Orange County, California, said point being the point of intersection of the south- erly line of Ocean Avenue with the southerly prolongation of the easterly line of Narcissus Avenue, formerly known as 40th Avenue, as said Narcissus Avenue and 40th Avenue are laid out and shown upon a map of Corona Del S?ar, • recorded in Book 3, pages 41 and 42, Miscellaneous Raps, Records of Orange County, California; running thence in a northerly direction along the easterly line of Narcissus Avenue io the intersection with the southerly line of Seaview Avenue, formerly known as 51st Place, assaid Seaview Avenue and 51st Place are laid out and shown upon a map of Resubdivision of Corona Del &tar, recorded in Book 4, page 67, 11iscellaneous Naps, Records of Orange County, California; running thence in a westerly direction along the southerly line of Seavieu Avenue to an inter- section with the westerly line of Carnation Avenue, formerly known as 30th Avenue, as saidCarnation Avenue and 30th Avenue are laid out and shown upon a map of Resubdivision of Corona Del 1,ar, recorded in Book'4, page 67, Viscellan- eous Maps, Records of Orange County, California; running thence in a southerly direction along the westerly line of Carnation Avenue to an intersection with the line of ordinary high tide of the Pacific Ocean in Newport Bay, as described in Court Case No. 23688 of the Superior Court of the State of California, in and for the County of Orange, a certified copy of the Court Decree being recorded in Book 185, page 363, Official Records of said County; running thence in a southerly and southeasterly direction along said ordinary high tide line to an intersection with the southerly line of Ocean Avenue; running thence in an easterly direction along the southerly line of Ocean Avenue to the point of beginning. Section 3. That the said proposed work or improvement is for the closing up and vacating of a certain portion of Ocean Boulevard hereinabove more particularly described, and it appears to the said City Council of the city of Newport Beach that no assessment is necessary. That the proceedings for the closing up of the aforesaid portion of Ocean Boulevard, shall be had and taken under and in accordance with an act of the Legislature of the State of California, designated and known as "An Act to Provide for laying out, opening, extending, widening, straightening or closing up in whole or in part any street, square, lane, alley, court or place within municipalities, and to condemn and acquire any and all land e,nd property necessary or convenient for that purpose ", approved Larch 6th, 1889, and amendments thereto. Section 5. The Street Superintendent of the city of Wewport Beach shall cause to be conspicuously posted along the line of said contemplated work and improvement and at not more than three hundred (300) feet in distance apart, but not less than three (3) in all,. notices of the passage of this resolution, in the form and manner asxequired by law; and he shall also cause a notice similes in substance, for a period of four successive 4meks, to be published irtthe °NEWPORT NEWS", a weekly newspaper published and circulated and of, general circulation in the city of Newport Beach,.CaliVwnia, which said newspaper is hereby.designated for that purpose by the said City Council of the city of Newport Beach, containing statement of the fact of the passage of this resolution of intention, the date hereof, and briefly, describing the work or improvement proposed and referring to this Resolution for further particulars. Section 6. That any person interested, objecting to said work or improvement or to the extent of the district or lands to be affected or benefited by said work or improvement, and to be assessed to pay the cost and expenses thereof, may &aak� written objections to the same, within ten (10.) days after the expiration of the time of the publication of said notice mentioned in Section 5 hereof, which objections shall be delivered to the Clerk of the City Council, who shall endorse ROLANO THOMPSONI ATTORNEY AT LAW SANTA ANA. CALIF. thereon the date of its.reception by him, and at the next meeting of the City Council, after the expiration of said ten (10) days, lay said objections bafore said City Council who shall fix a time for hearing said objections, not "less than one (1) creek thereafter. The City Clerk shall thereupon notify the persons making such objections by depositing a notice thereof in the Post Office of the.oity of Newport Beach, postage prepaid thereon, addressed to such objector. I hereby certify that the foregoing Resolution was duly and regularly introduced, passed and adopted by the City Council of the city of Newport Beach, at a regular meeting thereof, held on the 2nd day of Larch, 1936, by the following vote, to —wit: ST 0A ` <.
