RESOLUTION NO. WHEREAS, the City Attorney of the city of Newport Beach has this day presented to the City Council of the City of Newport Beach a grant deed, without warranty, dated the let day Of June 1936, from the city of Newport Beach, a Municipal corporation of the sixth class, to Newport Harbor Poet No. 291 of the American Legion, a California corporation, of that certain real property situated in the city of Newport Beach, County of Orange, State of California, and more particularly described as follows: Beginning at the intersection of the Easterly line of Tenth Street with a line 120 feet northerly of and parallel with the Northerly line of Central Avenue (North Drive) as said Tenth Street and Central Avenue (North Drive) are shown on the Map of Section B, Newport Beach, recorded in Book 4, page 27 of Miscellaneous Maps, Records of Orange County, California; running thence Easterly along a line which is 120 feet Northerly of and parallel with the North - erly.line of said Central Avenue (North Drive), said line being the northerly line of the alley in Block 109, as shown on said Map of Section B, Newport Beach, 324.89 feet to an intersection with the northerly prolongation of the Westerly line of Lot Five (5), Block One Hundred Nine (109) of said Section B, Newport Beach; thence Northerly along the northerly prolongation of the Westerly line of said Lot Five (5) 90 feet to an intersection with a line 210 feet Northerly of and parallel with the Northerly line of said Central Avenue (North Drive); thence Westerly along said line, which is 210 feet northerly of and parallel with the Northerly line of said Central Avenue (North Driven, 324.89 feet to an intersection with the Easterly line of Tenth Street, as said Tenth Street is described ancydedicated by Ordinance No. 390 of the city of Newport Beach, adopted November 3rd, 1930; thence southerly along the said Easterly line of Tenth Street 90 feet to the point of beginning. Excepting therefrom the portion thereof conveyed to Newport Harbor Poet No. 291 of the American Legion by deed from the city of Newport Beach dated September 8th, 1924, recorded in Book 539, page 228 of Deeds, in the office of the County Recorder of Orange County, California, to which record reference is hereby made for the description thereof. (This parcel is hereinafter referred to as Parcel 1) And WHEREAS, Newport Harbor Poet No. 291 of the American Legion did, at its sole cost and expense, pursuant to its prior V' 06 2' 3' 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 agreement with the City of Newport Beach hereinafter mentioned, caused to be prepared a bill for presentation to the 1935 Legislature of the State of California, known as Assembly Bill No. 1486, for permission for the City of Newport Beach to bring an action against the State of California to quiet title to said Parcel 1 and a tract of land (hereinafter referred to as Parcel 2) approximately 159.28 feet North and South and 384.99 feet East and West, lying adjacent and Northerly of said Parcel 1 and extending to the United States Bulkhead Line of Newport Bay, and said Legislature, at the instance of said Newport Harbor Post No. 291 of the American Legion, did enact said Bill, and thereafter said Newport Harbor Post No. 291 of the American Legion, at its sole cost and expense, pursuant to said agreement, prosecuted an action in behalf of the city of Newport Beach against the State Of California, in the Superior Court of Orange County, California, And obtained a final decree of said Court establishing the title of the city of Newport Beach to said Parcel 1 and Parcel 2 against all adverse claims of the State of California. And WHEREAS, said Newport Harbor Post No. 291 of the American Legion did, pursuant to said agreement, dedicate to the City of Newport Beach, for street purposes, all of its right, title and interest in and to the southerly fifty (50) feet of sa Parcel 2, which fifty (50) foot strip is hereinafter referred to as Parcel 3. And WHEREAS, the said Newport Harbor Post No. 291 of American Legion did, at the time of said dedication heretofore mentioned, have a long term lease upon the real property dedica for street purposes as aforesaid, which said leasehold interest does not expire until the 8th day of September, 1949, and had certain buildings located upon said fifty (50) foot strip. And WHEREAS, the City Council of the city of Newport Beach did, on or about the 20th day of December, 1934, agree with ROLANO TNOMPSON fl ATTORNEY AT LAW SANTA ANA.
