RESOLUTION NO.
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a certain Agreement
dated the day of July, 1936, wherein the City of Newport
Beach is referred to as the party of the first part, and the
firm of O'Melveny, Tuller & Myers, a co— partnership, is referred
to as the party of the second part; and
WHEREAS, said agreement provides that the party of the
second part will assist the party of the first part in preparing
all necessary resolutions, ordinances and other proceedings
relating to the calling and holding of a municipal election in
the city of Newport Beach, at which election will be submitted
the proposition of authorizing $300,000.00 of bonds for sewer
purposes; and
WHEREAS, second party further agrees that in the event
said bonds are authorized to be issued at said municipal bond
election, that second party will thereafter render its opinion
upon the validity of said bond issued and
WHEREAS, said agreement further provides that the
city of Newport Beach will pay to the second party the sum of
$600.00, said sum to be due and payable at the time said bonds
are issued and paid for, and in case said bonds shall fail to
carry at said proposed election, the city of Newport Beach shall
pay to second party the sum of $300.00 for second party's services;'
and
WHEREAS, it is deemed to be for the best interests of
said City of Newport Beach that said second party be retained
as above set forth at the fee stipulated;
NOSY; THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the City of Newport Beach be and they are hereby

1 authorized, directed and instructed to execute said agreement
2 in duplicate, on behalf of the City of Newport Beach, and the
3 City Clerk is directed to deliver a duly executed thereof
4 to the party of the second part,

7 I hereby certify that the above and foregoing Resolution
8 was duly and regularly passed and adopted at an adjourned regular
meeting of the city council of the City of Newport Beach held on
9
the 20th day of July, 1936, by the following vote, to -wit:
