1b 3 WHEREAS, wave action and currents in Newport Harbor
4 have caused the protecting banks of Newport Harbor from Lot 40
5 to Lot 43 inclusive, and a portion of "N$ Street, all in tract
6' No. 756 in the city of Newport Beach, to be eroded and washed
7 away; and
8 WHEREAS, Central Avenue, a public street in the City
9 of Newport Beach, fronting on said lots, is in danger of being
10 injured and damaged by the action of the waters of Newport
11 Harbor; and
12
WHEREAS,
it has become necessary to erect and construct
13
a groin along the
Northwesterly side of Lot 40 of said Tract No.
14
7560 in order to protect the lots fronting on said Bay, and said
15
Central Avenue, a
public street; and
16
WHEREAS,
it is necessary that work be commenced
17
immediately in the
protection of said street and the properties
18
fronting thereon,
and the City of Newport Beach has not time in
19
which to call for
bids as required by law for the doing of said wo
20
of improvement; and
21
WHEREAS,
in the opinion of the City Council of the City
22 of Newport Beach it is necessary that said work of constructing
23 said groin be commenced immediately in order to safeguard life,
24 health and property and by reason of the foregoing facts, the
25 City Council finds and determines that an emergency exists.
26 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
27 OF THE CITY OF NEWPORT BEACH that the public interest and
28 necessity demand the immediate expenditure of public money for
29 the purpose specified in this resolution, in order that life,
30 health and
property in the city of Newport Beach may be safe -
31 guarded and protected.

BE IT FURTHER RESOLVED: That the City Council of the
City of Newport Beach appropriate the sum of Twelve Hundred Dollar
($1800.00) for the following improvement, to -wit, the construction
and erection of a wooden sheep pile groin approximately 150 feet
in length along the Northwesterly side of Lot 40 in Tract No. 756.
BE IT FURTHER RESOLVED: That the City Council of the
City of Newport Beach does not have sufficient time to call for
bids for the doing of the work or improvement mentioned in the
previous paragraph and that the public interest and necessity
demand the immediate expenditure of public money for the acquisi-
tion and construction of saidwork, in order to safeguard life,
health and property in the City of Newport Beach.
BE IT FURTHER RESOLVED: That the sum of $1200.00
appropriated by said City of Newport Beach, be appropriated
out of the ordinary annual income and revenue of said City, and
out of that portion of the revenue of said City budgeted to harbor
improvement, and that the same be used for the purpose of paying
for the necessary materials and labor to be performed and furnish -�
ed in the acquisition and construction of said groin aforesaid,
all in accordance with the plans and specifications heretofore
approved by the City Council of the City of Newport Beach,
which plans and specifications are on file with the City Engineer
of the City of Newport Beach and by reference thereto are made a
part hereof.
BE IT FURTHER RESOLVED: That said work be done under
the supervision and direction of R. L.
of the City of Newport Beach, and that
authorized, directed and instructed to
materials at the best price obtainable
that he hire sufficient additional lab
construction aforesaid.
