RESOLUTION NO. l pDYo
WHEREAS, the City of Newport Beach has pursuant to
proceedings had and taken in the matter of Sewer Bonds of 1936,
sold bonds of said City of Newport Beach in the sum of 2 00;00
and;
WHEREAS, the money for the sale of said bonds is now in
an account known and designated "Sewer Bond Account 1936 "; and
WHEREAS, said bonds were sold for the purpose of the
construction and maintenance of a municipal improvement, to -wit;
Additions to the municipal sewer system of the City of Newport
Beach, and the construction on said lands of a sewer disposal
plant, sewage works, pumping plants and buildings and equipment
necessary or convenient for said project, together with pipe
lines, carrying lines and discharge lines necessary or incidental
to the construction and maintenance of the sewage works heretofo
mentioned; and
WHEREAS, the Federal Emergency Administration of Public
Works, has heretofore made a grant of certain moneys to the City
of Newport Beach in connection with the work of improvement
heretofore mentioned, being project PWA Docket No. California -
1516-D (sewers); and
WHEREAS, under the terms and conditions of the Federal
Emergency Administration of Public Works it is necessary to
set up in a bank or banks which are members of the Federal
Deposit Insurance Corporation, an account or accounts to be
collectively known as the "Construction Account "; and
WHEREAS, itis further necessary to place the proceeds
from the sale of the bonds, exclusive of accrued interest, as
well as advance grant payment, the intermediate grant payments
and the final grant payment and any other moneys which shall be

required in addition -to the foregoing to pay the costs of
constructing the work of improvement heretofore mentioned promptly
uappoon the receipt thereof;in said designated "Construction Account"
WHEREAS, payments for the construction of the work of
improvement in this Resolution mentioned shall be made under said
terms and conditions of the Federal Emergency Administration
of Public Works, from the Construction Account heretofore in this
resolution mentioned, and all moneys in the Construction Account
shall be expended only for such purposes as shall have been j
previously specified in a signed certificate of purposes filed
with and accepted by the Government.
NOW, THEREFORE, BE IT RESOLVED: That J. A. Gant, City
Treasurer of the City of Newport Beach be and he is hereby
directed and instructed to forthwith deposit the said sum of
I85� 78 0.00heretofore deposited under Sewer Bond Account 1936,
into an account to be designated "Construction Account" sewer 1936,
in the Bank of America, Balboa Branch, located in the City of
Newport Beach, in Orange County, California, which said bank is a
member of the Federal Deposit Insurance Corporation.
BE IT FURTHER RESOLVED that the advance grant payment,
the intermeidate grant payments and the final grant payment and
any other moneys which shall be required in addition to the fore-
going, to pay the costs of constructing the improvement in this
resolution mentioned, shall be deposited by said City Treasurer
in the Construction Account aforesaid, promptly upon receipt
thereof.
BE IT FURTHER RESOLVED; That all moneys deposited
in said Construction Account shall be expended only for such
purposes as shall have been specified in a signed certificate
of purposes filed with and accepted by the Government.

BE IT FURTHER RESOLVED: That payments for the
construction of the work of improvement heretofore in this
resolution mentioned shall be made only from said Construction
Account.
BE IT FURTHER RESOLVED: That a certified copy of
this resolution be sent to the Federal Emergency Administration
of Public Works by the Clerk of the City Council of the City of
Newport Beach,
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the City of Newport Beach at an adjourned regular
meeting thereof held on the 30th day of November, 1936, by the
following vote, to —wit:
