WHEREAS, Section 3897d of the Political Code of the
State of California, provides among other things, that whenever
any property has been deeded for delinquent taxes and /or
assessments to the State of California, and said property has
also been deeded for delinquent taxes and /or assessments to any
municipality, the governing body of said municipality may enter

into an agreement with the Board of Supervisors in the County
i
in which said property is situated, subject to the approval
of the State Controller, for the purchase of, or for the option
to purchase the property so held by the State, or any part or
parts thereof; and
WHEREAS, all of the four hundred and fifty -one (451)
lots hereinafter mentioned and described in Exhibit "A" dated
December 7th, 1936, hereto attached, are wholly within the City
limits of the City of Newport Beach, in the County of Orange,
State of California, and are now delinquent for city taxes and
for county taxes, and for public improvement assessments of the
City of Newport Beach, and further, all of said lots hereafter
described in exhibit "A" aforesaid, have been deeded to the State
of California for non - payment of County taxes, and have been
deeded to the City of Newport Beach for non - payment of City taxes
and /or assessments. All of said taxes, city and county, as
well as said assessments, are past due for more than five (5)
years; and
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a plan dated November
25th, 1936, under which it is expected to return to the City tax
rolls and to the County tax rolls all that certain real property

WHEREAS; there has also been presented to the City

Council of the City of Newport Beach, an agreement dated the 7th

day of December, 1936, wherein the Board of Supervisors of the

County of Orange, State of California, acting under the authority
9
granted to it by Section 3897d of the Political Code of the
10
State of California, therein designated as the Seller, and the
11
City Council of the Oity.of Newport Beach, acting under the
12
authority granted to it by Section 3897d of the Political Code
13
of the state of California, is designated as the Buyer, wherein
14
the said Buyer agrees, among other things, to purchase said
15
delinquent tax lots heretofore mentioned and more particularly
16
described in said agreement, for the sum of Four Hundred Fifty —one
17
Dollars ( #451.00), cash, lawful money of the United States of
18
America, said agreement, however, to be subject to the approval
19
of the State Controller of said State, and subject and pursuant

in all respects to Section 3897d of the Political Code of the

State of California.

NOW, THEREFORE, BE IT RESOLVED: That the City Council,

of the City of Newport Beach approves the Plan No. 4, dated

November 85th, 1936, submitted to it for the purpose of placing

said delinquent tax property back on the tax rolls of the city

of Newport Beach , and orders the same to be attached to this

resolution and filed as a permanent record with the City Clerk

of the City of Newport Beach; and

PLAN NO. 4
PLAN OF THE CITY OF NEWPORT BEACH COVERING
THE FOURTH PURCHASE OF TAR DELINQUENT PROPERTY
Plan of the City of Newport Beach, Orange County,
California, to return to the City Tax rolls and to the County
tax rolls, 451 lots all within the city limits of the said city
of Newport Beach, and being the property as listed on Exhibit "A"
as attached to an agreement dated December 7th, 1936, between
the Board of Supervisors of Orange County, California, and the
City Council of said City of Newport Beach, California.

At the present time all such lots or parcels of
property as shown on said Exhibit "A" have been deeded to the
State of California, and are at present completely off of the
assessment rolls of the city of Newport Beach and the County of
Orange, and will produce NO TAR revenue until some effective
plan is worked out to get the taxes and assessments paid up to
date and the property back in the hands of new owners, who will
pay the current taxes and assessments as they become due.

All of the lots in question are in Tract No. 772 and
Seashore Colony Tract, These two tracts cover very low land at
the foot of the bluff, just north of the Coast Boulevard, about
one mile west of the Arches and adjoining the Santa Ana River.
The streets in Tract No. 772 have never been opened on the ground,I
they are not graded or improved through this tract. The Santa Anal
River borders this tract on three sides and haft overflowed this
property on several occasions.

4his tract No. 772 is one of the economic mistakes of
the 1920 Real estate boom. More than 95% of the lots in said
Tract No. 772 are now tax delinquent and the company holding the
fee title has been liquidated by the State Building and Loan
Commissioner,

In addition to delinquent city and county taxes, this
group of lots is covered by a 1915 Act Assessment Bond for sewer
system. These assessments are nearly all now six payments past
due and with two more payments to be made. All property within
the City Limits, is being assessed to pay the delinquency on
these bonds and will also have to make up the payments for the two
payments due in the future.

This plan in general is as follows;
(a) The City of Newport Beach will purchase from the
County of Orange, under Section 3897d of the Political Code, the
tax title now held by the State of California, subject, however,
to the approval of the State Controller. At this point the
state tax title and the city tax title will both be vested in
the City of Newport Beach.
(b) The City of Newport Beach proposes to offer to
the record owner of each lot so purchased from the County, a
small sum of money in cash, for a quitclaim deed to such lot.
If the amount offered is not accepted, then the city proposes to
,quiet title -on all properties owned by it and mentioned in
paragraph (a), Section 5, of this plan.
(c) Where quitclaim deeds to the lots involved in
this group are not secured.quickly and at a very small cost, the
City will immediately institute a court action to quiet title to
Ilsuch lots.

(d) Upon the Court decree, granting title to the
city (it is expected that most parties will default, by failing
to answer the city's complaint) the City will then hold good title
and will then cancel all taxes and penalties outstanding against
these lots, and then sell said lots to the best advantage of the
city.
(e) It is not too early to start now to have this
group of lots ready for sale to the public at the earliest
possible time. Any and all lots owned by the City may be offered
for sale at any time hereafter at a price whereby they may be
sold on the open market. If it is found that some of these lots
cannot be sold for the full amount of the improvement bonds
against them, it is the present intention of the City of Newport
Beach to make such sales at the best prices obtainable, at the
then present market, in order that said property may be placed on
the assessment tolls of both the city and county.

Section 4 of Assembly Bill 1129, being Chapter No. 396
of the Statutes of 1935, is pertinent to this case and reads as
follows:
"The facts constituting such necessity are as follows:
Due to the depression which has existed in the past several
years many landowners have been unable to meet the taxes and
assessments levied by the State, political subdivision, agencies
reclamation, drainage and levee districts, with the results that
their lands have been sold to the State and such taxing and
assessing agencies. The heavy penalties assessed by law have
made it impossible for the landowners to redeem their lands,
hence thousands of acres of land (together with thousands of
lots the last item added) have been sold for the non - payment
of such taxes and assessments, and deeds have been executed
thereon to the state and such taxing and assessing agencies.
That as long as such lands (or lots p remain State lands the
same are non- assessible for tax purposes, and the tax and
assessment burden becomes heavy upon the paying lands, causing
more delinquencies and losses. - - - The Legislature hereby
declares that the welfare of the State requires that such land
be placed in private ownership as promptly as possible so that
such land henceforth bear its just proportion of current
taxation and assessments."

hereby agree to sell and said Buyer does hereby agree to purchase
all of the property shown on and described in said Exhibit "A"
for the eum of Four Hundred and Fifty -one Dollars (0451.00),
payable as follower Cash upon delivery of a deed for said
property from the County Tax Collector.
Seller agrees to cause its Tax Collector to sxeoute
and deliver to Baer a Deed for said property as provided in said
section 30"d of the Political Code of California,
