RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, DETERMINING
THE NATURE, LOCATION AND EXTENT OF THE PRO-
POSED IMPROVEMENT FOR THE CONSTRUCTION (F A
STEEL SHEET PILE BULKHEAD AND APPURTENANCES
TO PROTECT CHANNEL ROAD AND OTHER PROPERTY
IN SAID CITY, GENERALLY DEFINING THE BOUND-
ARIES OR EXTENT OF THE DISTRICT TO BE SPEC-
IALLY ASSESSED TO PAY THE COST THEREOF; AND
DETERMINING THE STATUTE UNDER WHICH IT IS
PROPOSED TO CONDUCT THE PROCEEDINGS, PURSU-
ANT TO THE PROVISIONS OF SECTION 2 OF THE
"SPECIAL ASSESSMENT INVESTIGATION, LIMITA-
TION AND MAJORITY PROTEST ACT OF 1931."
WHEREAS, the City Council of the City of Newport
Beach, California, did on the 10th day of August, 1936,
instruct tl)e City Engineer of said City to procure and prepare
a written report, pursuant to Sections 2 and 3 of the "Special
Assessment Investigation, Limitation and Majority Protest Act
of 1931," as amended, and thereafter the said City Engineer
presented to this City Council, on the 2�5r`{ day of
1937, Plan No. 403, showing the said improvement, and also a
map of the proposed assessment district, No. 402, for considera-
tion; and
WHEREAS, pursuant to the provisions of Section 2
of the "Special Assessment Investigation, Limitation and Majority
Protest Act of 1931," as amended, the City Council must by
the boundaries or extent of the district or lands to be specially
assessed to pay the cost thereof, or any part of such cost, and
resolution
or
ordinance determine in general
the nature, location
and extent
of
the proposed improvement; also
generally define
the boundaries or extent of the district or lands to be specially
assessed to pay the cost thereof, or any part of such cost, and

0 determine the statute under which it is proposed to conduct
the proposed proceedings;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE,
AS FOLLOWS:
1. That the proposed improvement mentioned in the
title of this resolution is more particularly described as
follows:
The construction of a steel sheet pile bulkhead
and appurtenances and appurtenant work adjacent and contiguous
to the easterly line of Lot M of Block P of Tract No. 518, as
per map recorded in Miscellaneous Map Book 17, Pages 33 to 36
inclusive, Records of Orange County, California, between the
easterly prolongation of the southerly line of Lot 3 of said
Block P and the easterly prolongation of the northerly line
of Lot 15 of said Block P, all within the City of Newport
Beach, California. The said construction and improvement of
the aforesaid bulkhead is deemed necessary and convenient to
protect the streets, public ways and other property in the
City of Newport Beach from overflow by water.
Reference is hereby made to Plan No. 403, on file
in the office of the City Engineer, showing in detail the
proposed improvement.
2. That the boundaries of the district or lands
to be specially assessed to pay the cost of said proposed
improvement are more particularly described as follows:
Beginning at the northwesterly corner
of Lot 15 of Block P of Tract No. 518, as
per map thereof recorded in Book 17, Pages
33 to 36 inclusive, of Miscellaneous Maps,
Records of Orange County, California; thence
easterly along the northerly line of said
Lot 15 and. the easterly prolongation of the

said northerly line, a distance of 110 feet;
thence southerly along a line parallel to the
easterly line of said Tract No. 518, to an
intersection with the easterly prolongation of
the southerly line of Lot 3 of said Block P;
thence westerly in a direct line to the south-
westerly corner of said Lot 3; thence northerly
along the westerly line of said Block P to the
point of beginning.
A map of said district, No. 402, indicating by a
boundary line the extent of the territory included within the
proposed assessment district, is on file in the office of
the City Engineer of the City of Newport Beach. Reference
is hereby made to said map for a further, Hill and more
complete description of the said assessment district, and the
said map so on file shall govern for all details as to the
extent of the said assessment district.
3. That the entire cost of said proposed improve-
ment shall be assessed against the lands to be benefited
thereby and herein described.
4. That the said proposed improvement shall be
made under the provisions of the "Improvement Act of 1911,"
approved April 7th, 1911, and amendments thereto. And that
serial bonds to represent unpaid assessments and bearing
interest at the rate of seven per cent (7 %) per annum, shall
be issued hereunder in the manner provided by the "Improvement
Bond Act of 1915," approved June 11, 1915, and acts amendatory
thereof and supplementary thereto, the last installment of
which bonds shall mature nine (9) years from the second day of
July next succeeding ten (10) months from their date.
