RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, DETERMINING
THE NATURE, LOCATION AND EXTENT OF THE PRO-
POSED IMPROVEMENT FOR THE INSTALLATION OF
CERTAIN ORNAMENTAL LIGHT POSTS OR STANDARDS
IN AND ADJACENT TO SOUTH BAY FRONT, NORTH
BAY FRONT, EAST BAY FRONT AND EAST PROMENADE
OF THE GRAND CANAL ON BALBOA ISLAND, IN THE
CITY OF NEWPORT BEACH, CALIFORNIA; GENERALLY
DEFINING THE BOUNDARIES OR EXTENT OF THE
DISTRICT TO BE SPECIALLY ASSESSED TO PAY THE
COST THEREOF; AND DETERMINING THE STATUTE
UNDER WHICH IT IS PROPOSED TO CONDUCT THE
PROCEEDINGS, PURSUANT TO THE PROVISIONS OF
SECTION 2 OF THE "SPECIAL ASSESSMENT INVES-
TIGATION, LIMITATION AND MAJORITY PROTEST
ACT OF 1931 ".
WHEREAS, the City Council of the City of Newport
Beach, California, did on the 7th day of June, 1937, instruct
the City Engineer of said City to procure and prepare a written
report, pursuant to Sections 2 and 3 of the "Special Assess-
ment Investigation, Limitation and Majority Protest Act of
1931," as amended, and thereafter the said City Enginee
presented to this City Council, on the I� day of �_,
1937, Plan No. 404, consisting of one (1) sheet, showing the
said improvement as proposed, and also a map of the proposed
assessment district, No. 405, for consideration; and
WHEREAS, pursuant to the provisions of Section 2 of
the "Special Assessment Investigation, Limitation ad Majority
Protest Act of 1931," as amended, the City Council must by
resolution or ordinance determine in general the nature, location
and extent of the proposed improvement; also generally define
the boundaries or extent of the district or lands to be
specially assessed to pay the cost thereof, or any part of such
cost, and determine the statute under which it is proposed to
conduct the proposed proceedings;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE,
AS FOLLOWS:
1. That the proposed improvement mentioned in the
title of this resolution is more particularly described as follows:
That certain ornamental lighting posts or
standards, together with wires, cables, lamps and other suitable
And necessary appliances for street lighting purposes, be in-
stalled on top of the existing concrete bulkhead in and adjacent
to.South Bay Front of Balboa Island between East Bay Front and
Park Avenue, in and adjacent to North Bay Front of Balboa Island
between Park Avenue and the northerly prolongation of the
westerly line of West Promenade of the Grand Canal, in and
adjacent to East Bay Front of Balboa Island between the northerly
prolongation of the easterly line of East Promenade of the
Grand Canal and the South Bay Front.
That an ornamental lighting post or standard,
together with cement concrete base, lamp and other suitable
and necessary appliances for street lighting purposes, be
installed in the East Promenade of the Grand Canal on Balboa
Island, at a locations Z :_ feet northerly of the northerly
line of Balboa Avenue.
Reference is hereby made to Plan No. 4&, on file
in the office of the City Engineer, showing in detail the
proposed improvement.
2. That the boundaries of the district or lands to be
specially assessed to pay a portion of the cost of said proposed

improvement are more particularly described as follows:
Beginning at the northeasterly corner
of Lot 1, Collins Isle, as shown upon a map
of Re- subdivision of Section 1, Balboa Island,
recorded in Book 6, Page 30 of Miscellaneous
Maps, Records of Orange County, California;
running thence northeasterly in a direct line
to a point in the northerly prolongation of
the westerly line of Lot 12, Block 2 of said
Re- subdivision of Section 1, which point is
110 feet northerly of the northwesterly corner
of said Lot 12, Block 2; running thence east-
erly in a direct line to a point in the north-
erly prolongation of the westerly line of

Lot 1�+, as shown on a map of Tract No. 742,
recorded in Book 23, Page 42 of Miscellaneous
Maps, records of said county, which point is
150 feet northerly of the most northerly
corner of said Lot 14; thence southeasterly
in a direct line to a point in the easterly
prolongation of the northerly line of Park
Avenue, as said Park Avenue is shown on a map
of Section 5, Balboa Island, recorded in Book
S, Page 9 of Miscellaneous Daps, records of
said county, which point is 350 feet easterly
of the southeasterly corner of Lot 13 in
Block 5 of said Section 5; thence southwesterly
in a direct line to a point in the southerly
prolongation of the easterly line of Lot 7,
Block in said Section 5, which point is 140
feet southerly of the southeasterly corner of
said Lot 7, Block 4; thence westerly in a direct
line to a point in the southwesterly prolonga-
tion of the southeasterly line of Topaz Avenue,
as said Topaz Avenue is laid out and shown
upon the map of said Re- subdivision of Section 1,
which point is 210 feet southwesterly from the
southwesterly corner of Lot 1 in Block 13 of said
Re- subdivision of Section 1; thence northwest-
erly in a direct line to a point in the south-
westerly prolongation of the southeasterly line
of Emerald Avenue, as said Emerald Avenue is
laid out and shown on a map of said Re- subdivision
of Section 1, which point is 320 feet south-
westerly of the southwesterly corner of Lot 1
in Block 3 of said Re- subdivision of Section 1;
thence northerly in a direct line to the point
of beginning,
excepting from said district all public streets,
avenues, alleys, public ways, tide, submerged
and overflowed lands.
A map of said district, No. 405, indicating by a
boundary line the extent of the territory included within the
proposed assessment district, is on file in the office of
the City Engineer of the City of Newport Beach. Reference is
hereby made to said map for a further, full and more complete
description of the said assessment district, and the said
map so on file shall govern for all details as to the
extent of the said assessment district.
3. That the entire cost of said proposed improvement
shall be assessed against the lands to be benefited thereby
and herein described.
4. That the said proposed improvement shall be made
under the provisions of the "Improvement Act of 1911,11 approved
April 7th, 1911, and amendments thereto. And that serial
bonds bearing interest at the rate of seven per cent (79) per

annum, shall be issued to represent each assessment of
Twenty -five Dollars (25.00), or more, remaining unpaid for
thirty (30) days after the date of the warrant. Said serial
bonds shall extend over a period ending nine years from the
second day of January next succeeding the next October fifteenth
following their date. Said bonds to be issued under and
pursuant to the provisions of the said nImprovement Act of 1911."
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a re g ar adjourned meeting
thereof held on the -10 day of , 1937, by the
