WHEREAS, Section 3897d of the Political Code of the
State of California, provides among other things, that whenever
any property has been deeded for delinquent taxes and /or
assessments to the State of California, and said property has
also been deeded for delinquent taxes and /or assessments to any
municipality, the governing body of said municipality may enter
into an agreement with the Board of Supervisors in the County
in which said property is situated, subject to the approval
of the State Controller, for the purchase of, or for the option
to purchase the property so held by the State, or any part or
parts thereoft. and
WHEREAS, all of the five hundred three (603) lots or
parcels of property hereinafter mentioned and described in
exhibit "A" dated August 2nd, 1937, hereto attached, are
wholly within the city limits of the City of Newport Beach, in
the County of Orange, State of California, and are now delinquent
for city taxes and for county taxes, or for public improvement
assessments of the City of Newport Beach, and further, all of
said lots or parcels of land hereafter described in Exhibit "A"
aforesaid, have been deeded to the State of California, for non-
payment of County taxes, and have been deeded to the City of
Newport Beach for non — payment of City taxes and /or assessments.
All of said taxes, city and county, as well as said assessments,
are past due for more than five (5) years; and
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a plan dated July 15th,
1937, under which it is expected to return to the City tax rolls
and to the County tax rolls all that certain real property
situated in the City of Newport Beach, County of Orange, State

of California, and being more particularly. described and set
forth in Exhibit "A ", dated August 2nd, 1937, hereto attached
and made a part hereof; and
WHEREAS, there has also been presented to the City
Council of the City of Newport Beach, an agreement dated the

2nd-day of August, 1937, wherein the Board of Supervisors of the
County of Orange, State of California, acting under the authority
granted to it by Section 3897d of the Political Code of the
State of California, therein designated as the Seller, and the
City Council of the City of Newport Beach, acting under the
authority granted to it by Section 3897d of the Political Code
of the State of California, is designated as the Buyer, wherein
'the said Buyer agrees, among other things, to purchase said
delinquent tax lots heretofore mentioned and more particularly
described. in said agreement, for the sum of Five Hundred Mn P'
Dollars ($800.00), cash, lawful money of the United States of
America, said agreement, however, to be subject to the approval
of the State Controller of said State, and subject and pursuant
in all respects to Section 3897d of the Political Code of the
State of California.
NOW, THEREFORE, BE IT RESOLVED: That the City Council
of the City of Newport Beach approves the Plan No. 5, -dated
July 15th, 1937, submitted to it for the purpose of placing
said delinquent tax property back on the tax rolls of the City
of Newport Beach,.and orders the same to be attached to this
resolution and filed as a permanent record with the City Clerk
of the City of Newport Beach; and
BE IT FURTHER RESOLVED: That the City Council of the
City of Newport Beach by reference thereto, makes said plan and
the whole thereof, a part of this resolution to the same extent
and purpose as if the same were herein set out in full; and

1 BE IT FURTHER. RESOLVED: That the agreement heretofore
2 mentioned be, and the same is hereby approved as written, and
3 the Mayor of the City of Newport Beach, and the City Clerk of
4 said City are hereby directed and authorized to sign and execute
5 the same on behalf of the City of Newport Beach, and the Clerk
6 is directed and instruoted to deliver a duly executed copy
7 thereof to the Seller therein named.

10 Resolution was duly and regularly passed and adopted by the
11 City Council of the City of Newport Beach at.a regular meeting

r/ PLAN OF THE CITY OF NEWPORT BEACH COVERING
THE FIFTH PURCHASE OF TAX DELINQUENT PROPERTY
Plan of the City of Newport Beach, Orange County,
California, to return to the City Tax Rolls and to the County
Tax Rolls, 503 lots all within the city limits of the said City
of Newport Beach, and being the property as listed on Exhibit "A"
as attached to a proposed agreement dated August 2nd, 1937,
between the Board of Supervisors of Orange County, California,
and the City Council of said City of Newport Beach, California.

At the present time all such lots or parcels . of
property as shown on said Exhibit "A" have been deeded to the
State of California, and are at present completely off of the
assessment- rolls of the City of Newport Beach and the County of
Orange, and will produce NO TAX revenue until some effective
plan is worked out to get the taxes and assessments paid up to
date and the property back in the hands of new owners, who will
pay the current taxes and assessments as they become due.

The 503 lots included in this plan are located
approximately as follows:
Group No. 1, Corona Del Bear District - - - - - -- 175 lots
Group No. 2, Newport Heights District - - - - -- 180 lots
Group No. 3, Various tracts in Newport proper 1148 lots

Group No. 1. The lots in Corona Del Mar District, are
all under very heavy assessment, under 1915 act bond issues placed
in 1925 and 1927 to cover water and paving. The City is at
present making various ten cent levies over the entire city to
take care of the defaults under these bonds.

Group No. 2. The lots in Newport Heights District,
particularly those located in the easterly portion of this tract,
have ungraded streets, the curbs and sidewalks are not installed,
and water, gas, lights, etc., have not been placed. The
westerly portion of this tract has 1911 Act bonds for paving
assessed against the lots and these bonds are nearly all more
than five years delinquent.

Group No. 3. The lots.in this group are-scattered
throughout the city and most of them are encumbered with 1915
Act Sewer and Paving bonds. It is necessary that the city
protect its liability under these bonds.

This plan in general is as follows:
(a) The City of Newport Beach will purchase from the
County of Orange, under Section 3897d of the Political Code, and
amendments thereto, the tax title now held by the State of
California, subject, however, to the approval of the State
Controller. At this point the state tax title and the city tax
title will both be vested in the Oity of Newport Beach.
(b) The City of Newport Beach proposes to offer to `.-
record owner of each lot so purchased from the County, a small
sum of money in cash, for a quitclaim deed to such lot. If, the
amount offered is not accepted, then the city proposes to quiet
title on all properties acquired under this plan.

(c) Where quitclaim deeds to the lots involved
in this group are not seoured quiokly and at a very small cost,
the City will - immediately institute a court action to quiet title
to such lots.
(d) Upon the Court'deoree', granting title to the
city (it is expected that most parties will default, by failing
to answer the city"s complaint) 'the City will then hold good
title and:will then canoel all taxes and penalties outstanding
against these lote,.and will then offer said lots for sale at
the reasonable.market value thereof, and on suoh terms as will
eventually .place all of said lots on the tax rolls of the city
and e'ounty.
(e) It is not too early to start now to have this
group of lots ready for sale to-the public at the earliest
possible time. Any -and all lots owned by the city may be
offered for sale at any time hereafter at a prime whereby they
may be sold on the open market. If it is found that some of
these lots cannot be sold for the full amount of the improvement
bonds against them, it is the present intention of the City of
Newport Beaoh to make suoh sales at the best prices obtainable
at the then- present market, in order that said property, may be
planed on the assessment-rolls of both -the city and county.•.
