RESOLUTION NO.

WHEREAS, there has this day been presented to the City
• 3
Council of the city of Newport Beach an agreement dated the let
4
day of November, 1937, by and between the City of Newport Beach,
5
as party of the first part, and 0. E. McFarland, as party of
6
the second part; and
7
WHEREAS, said agreement specifies that the party of
8
the first part is the owner of two certain piers or wharfs
9
extending out into the Pacific Ocean, one being at Newport Beach
10
and the other at Balboa; and
11
WHEREAS the party of the second part is the owner of
12
stationary fishing barges anchored ordinarily within the three
13
mile limit of the shore line of the city of Newport Beach; and
14
WHEREAS the party of the first part desires to
15
regulate the loading and unloading of passengers and patrons
16
going to and from said fishing barges anchored in the Pacific
17
Ocean aforesaid, in so far as said loading and unloading of
18
passengers is done on said piers or wharfs; and
19
WHEREAS said party of the first part desires to grant
20
to the party of the second part the exclusive license for a
21
period of three years from and after the let day of December,
22
1937, to load and unload passengers and patrons as aforesaid,
23
from said piers or wharfs to said fishing barges, upon the terms
24
and conditions in said agreement set forth; and
25
WHEREAS, it is for the best interests of the City of
26
Newport Beach that said license be granted.

NOW, THEREFORE, BE IT RESOLVED: That said agreement
28
be, and the same is hereby approved as written by the City
29
Council of the city of Newport Beach, and the Mayor of said
30
City and the City Clerk of said city of Newport Beach shall, and
31
they are hereby authorized and directed to sign the same on

behalf of the City of Newport Beach, and the Clerk is directed
to have the party of the second part execute said agreement
within five days from date hereof, and said agreement shall
thereupon be filed and become a valid and binding agreement
as between said parties,
I hereby certify that the foregoing resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at an adjourned regular meeting thereof held on
the 4th day of November, 1937, by the following vote, to -wit:
