WHEREAS, the City Council of the City of Newport Beach
6
on the 7th day of September, 1937, passed its Resolution of
7
Intention No. 1197 to order the herinafter improvement to be
8
made and public work to be done in the City of Newport Beach;
9
and
10
WHEREAS ,after the passage and adoption of Resolution
11
of Intention No. 1197, the Street Superintendent of the city
12
of Newport Beach caused to be conspicuously posted along the
13
line of the contemplated work and improvement at not more than
14
three hundred feet (3001) in distance apart, and 14 in all,
15
notices of the passage of said Resolution of Intention, headed
16
"NOTICE OF PUBLIC WORK ", in the manner, form and substance as
17
required by law, and said Street Superintendent also caused a
18
notice similar in substance to be published for four (4)
19
successive insertions, in NEWPORT NEWS, a semi - weekly newspaper,
20
printed, published and circulated in the city of Newport Beach,
21
and named by said City Council in said Resolution of Intention
22
as the paper in which said notice should appear, all as appears
23
from the affidavit of S.A. Meyer, of the printers and publisher
24
of said semi - weekly newspaper, and which affidavit was filed in
25
the office of the Clerk of the city of Newport Beach on the lst
26
day of October, 1937, and is not on file therein; and
27
WHEREAS$ the Street Superintendent of the city of Newport
28
Beach commenced the posting of the notice hereinbefore referred
29
to on the 28th day of September, 1937, and fully completed the
30
posting thereof on the 28th day of September, 1937, as appears
31
from the affidavit of -John A. Siegel, Assistant Street Superin-

tendent of the city of Newport Beach, and more than ten (10)
days having expired after the expiration of the time of the
publication of said notice within which.protests or objections
to the proposed work or improvement might be made by any person
interested objecting to said work or improvement, or to the
extent of the district or lands to be affected or benefited by
said work or improvement and to be assessed to pay the cost and
expenses thereof; and
WHEREAS, at the next meeting of the City Council after
the expiration of said ten days after the expiration of the
time of the publication of said notice, no objection to said
work or improvement having been made or on file, why said pro-
posed improvement should not be carried out in accordance with
said Resolution of Intention, the City Council of the city of
Newport Beach having now acquired jurisdiction to order the
said improvement:
IT IS HEREBY RESOLVED AND ORDERED: That the public
interest and convenience requires the work hereinafter des-
cribed and the City Council of the city of Newport Beach hereby
orders the following work to be done and improvement made in the
City of Newport Beach, as follows:
That that certain portion of a certain alley in Block 10,
East Newport Addition, as.shown on a map recorded in Book 3,
Page 37 of Miscellaneous Plops, Records of Orange County, Calif-
ornia in the City of Newport Beach as hereinafter described be
closed up and abandoned, to -wit:
All that portion of that certain alley 10t in width in
Block 10, as shown on a map of East Newport Addition, recorded
in Book 3, Page 37 of Miscellaneous Maps, records of Orange
County, California, lying easterly of and adjacent to Lot 6
of said Block 10 and extending from the easterly prolongation
of the southerly line of said Lot 6 to the easterly prolongation
of the northerly line of said Lot 6,

All of which is more clearly shown on a certain map

approved and adopted by the City Council of the city of Newport
3
Beach for said abandonment by Resolution No. 1198, on the 7th
4
day of September, 1937.

The public work ordered and the improvement b be made
6
is for the purpose of closing up and abandoning a portion of
7
Ocean Boulevard in the city of Newport Beach as hereinbefore
8
described, and for that reason no district is chargeable for
9
costs in connection therewit#.

All of the herein proposed work shall be done in pur-
11
suance of an Act of the Legislature of the State of California,
12
designated "Street Opening Act of 1889" and amendments thereto.

For further particulars reference is hereby made to said
14
Resolution of Intention No. 1197, which is dated the 7th day of
15
September, 1937, and on file with the Clerk of the city of
16
Newport Beach.

The Clerk of the city of Newport Beach is herewith in-
18
structed to record a copy of this Resolution Ordering Improve -
19
ment, in the office of the County Recorder of the County of
20
Orange, State of California.

I hereby CERTIFY that the foregoing Resolution ordering
Improvement No. 12-33 was duly introduced and regularly
passed and adopted by the City Council of the city,of Newport
each at a regular meeting thereof held on the �l day of
19, by the following vote, to-wit:
