WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach a certain Deed of
Easement dated the 31st day of March, 1938, wherein the Townsend
Land Company, a California corporation, is referred to as Grantor,
and the city of Newport Beach is referred to as Grantee; and
WHEREAS, said Deed of easement provides that the Grantor
transfers and conveys to Grantee, its successors and assigns,
a certain easement for sanitary sewer pipe line and water pipe
line purposes over, along and across that certain strip of land
twenty feet in width, in a portion of the Rancho Santiago de
Santa Ana, situated in the County of Orange, State of California,
being ten feet on either side of the following described center-
line:
Beginning at a point in the southerly line of that
certain ten acre parcel of land acquired by the City of
Newport Beach by Case No. 34747 of the Superior Court of the
State of California, in and for the County of Orange, recorded
in Book 910, page 19 of Official Records of Orange County,
California, which point of beginning is South 760 35' East,
250 feet from the southwesterly corner of said parcel of land;
running thence south 270 091 1511 West, 884.3 feet, more or less,
to an intersection with the centerline of the Santa Ana River,
as said centerline is described in Decree of Partition, Case
No. 22797, of the Superior Court of the State of California,
in and for the County of Orange, recorded February 21st, 1930,
in Judgment Book 25, page 297, Records of said County,
together with the right to maintain, operate, repair and replace
a pipe line or pipe lines for sanitary sewer purposes and for the
flow of water, and other rights and privileges, allas in said
Deed of Easement set forth; and
WHEREAS, the City Council of the city of Newport Beach
ldeems that it is for the best interests of said city of Newport
Beach that said Deed of Easement be accepted upon the terms and
conditions therein set forth.

WTI THEREFORE, BE IT RESOLVED: That the City of
Newport Beach accept said Deed of Easement upon the terms and
conditions therein set forth.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council of the city of Nei -port Beach at a regular meeting
thereof held on the 4th day of April, 1938, by the following
