RESOLUTION NO.
WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach a certain agreement
wherein the city of Newport Beach is referred to as the Optioner,
and Ralph P. Maskey is referred to as the Optionee; and
WHEREAS, said agreement provides that certain
properties in West Newport have been deeded to the city of
Newport Beach for non - payment of city taxes and assessments;
and
WHEREAS, said agreement further states that because
of the tax moratoria enacted by the city of Newport Beach it
will be difficult to clear title to said real property prior to
the expiration of the calendar year 1938; and
WHEREAS, Ralph P. Maskey and Irene Maskey, his wife,
legal owners of said property above mentioned, have deeded
said property to the city of Newport Beach in consideration
of the said city of Newport Beach executing said agreement; and
WHEREAS, said agreement provides that the city of
Newport Beach shall derive certain benefits from said transfer,
which said benefits are specifically set forth in said agreement;
and
{' WHEREAS, said agreement further provides that in
consideration of the Optionee transferring said properties to
the Optioner, that the said Optioner will grant to Optionee
the right to purchase certain properties at the prices set
forth in said agreement, for a period of 42 months from and
after the date of said agreement; and
WHEREAS, the City Council of the city of Newport Beach
deems that it is for the best interests of said city that said
agreement be entered into with the said Ralph P. Maskey, upon
the terms and conditions and for the consideration therein set

And WHEREAS, the City Council of the city of Newport
Beach deems that the considerations for the making and execution
of said agreement are in all respects fair, just and adequate
and that it is for the best interests of said city that said
agreement be executed.
NOW9 THEREFORE, BE IT RESOLVED; That the Mayor and
City Clerk of the city of Newport Beach be, and they are hereby
directed, authorized and instructed to execute said agreement
in the name of and on behalf of the city of Newport Beach, and
that the City Clerk deliver a duly executed copy thereof to the
Optionee therein named.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council
of the city of Newport Beach an an adjourned regular meeting
thereof held on the 16th day of May, 1938, by the following
vote, to —suit;
