3 WHEREAS, there has this day been presented to the City
• 4 Council of the city of Newport Beach a certain easement dated the
5 26th day of April, 1938, wherein the PACIFIC ELEOTRIC RAILWAY
6 COMPANY, a California Corporation, is the party of the first
7 part, and the CITY OF NEWPORT BEACH, a Municipal corporation,
8 is the party of the second par$; and
9 WHEREAS, said easement provides that the first party
10 grants to second part an easement for pedestrian crossing
11 purposes, across that part of the right of way of the party
12 of the first part in the city of Newport Beach, Orange County,
13 California, described as follows:
14 A strip of land l0 feet in width, the centerline of
which is described as follows:

Beginning at the point of intersection of the south -
16 westerly line of that certain parcel of land conveyed by
the Southern Pacific Railroad Oompany, et al to the Pacific
17 Electric Railway Company by deed recorded in Book 785, page
457, Official Records of the County of Orange, with a line
18 which is parallel to and 5 feet distant measured at right
angles southeasterly from the northeasterly prolongation of
19 the northwesterly line of 22nd Street (50 feet in width), as
shown on Map of Newport Beach, recorded in Book 3, page 26,
20 Miscellaneous Maps of Orange County; thence northeasterly
along said parallel line to its intersection with the south -
21 westerly line of a strip of land of irregular width first
22 described in that certain Easement for highway purposes con-
veyed by the Pacific Electric Railway Company to the city of
23 Newport Beach, recorded in Book 453, page 229 of Deeds,
Records of Orange County.
24 And WHEREAS, The City Council of the City of Newport
25 Beach deems that it is for the best interests of said city that
26 said Easement be accepted upon the terms and conditions therein
27 more particularly set forth.
28 NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
29 City Clerk of the City of Newport Beach be, and they are hereby
30 directed, authorized and instructed to execute said Easement
31 in the name of and on behalf of the city of Newport Beach, and
32 that the City Clerk deliver a duly executed copy thereof to the
