RESOLUTION NO.

3 WHEREAS, a certain Deed - Highway Easement, dated the
4 day of September, 1938, from the City of Newport Beach,
5 a Municipal corporation of the State of California, to the State
6 of California, granting, conveying and dedicating to the State of
7 California for public highway upon, over and across all that
8 certain real property situated in the City of Newport Beach, Coun
9 of Orange, State of California, and more particularly described
10 as follows, to -wit:
11 A strip of land 20 feet wide, being the Westerly
20 feet of Lot 1 in Block 'IN" of Tract No. 323,
12 as per map recorded in Book 14, pages 40 and 41
of Miscellaneous Maps in the office of the County
13 Recorder of said County,
14 was presented to the City Council of the city of Newport Beach,
15 California; and
16 WHEREAS, the City Council of the City of Newport Beach
17 deems that it is for the best interests of said city that said
18 Easement be granted upon the terms and conditions therein set
19 forth, and other valuable considerations, including the widening
20 of Highway No. 101 through that portion of the City of Newport
21 Beach known as Corona Del Mar.
22 NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
23 II City Clerk of the city of Newport Beach be, and they are hereby
24
authorized,
directed and
instructed to execute said Deed - Highway
25
Easement, in
the name of
and on behalf of the City of Newport
26
Beach, and
that the City
Clerk deliver a duly executed copy
27
thereof to
the State of
California, Division of Highways.
