3 WHEREAS, a certain Deed - Highway Easement, dated the
4 day of September, 1938, from the City of Newport Beach,
5 a Municipal corporation of the State of California, to the State
6 of California, granting, conveying and, dedicating to the State of
7 California for public highway upon, over and across all that
8 certain real property situated in the City of Newport Beach,
9 County of Orange, State of California, and more particularly
10 described as follows, to -wit:
11 A strip of land 20 feet wide, being the Westerly
20 feet of the Southerly 34 feet of Lot 5 in Block
12 000 of Tract No. 323 as per map recorded in Book 14,
pages 40 and 41 of Mig3cellaneous Maps in the office
13 of the County Recorder of said County.
14 was presented to the City Council of the city of Newport Beach,
15 California; and
16 WHEREAS, the City Council of the city of Newport Beach
17 deems that it is for the best interests of said City that
18 said easement be granted upon the terms and conditions therein

set forth, and other valuable considerations, including the widen-
ing of Highway No. 101 through that portion of the City of Newport
Beach known as Corona Del Mar.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Clerk of the city of Newport Beach be, and they are hereby
authorized, directed and instructed to execute said deed - Highway
Easement, in the name of and on behalf of the City of Newport Beach
and that the City Clerk deliver a duly executed copy thereof to
the State of California, Division of Highways.

Resolution was duly and regularly passed and a opte by the
