A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, APPROVING OF THE SUBSTITUTION OF THE
LA HABRA SANITARY DISTRICT IN THE PLACE AND STEAD
OF THE CITY OF LA HABRA AS CONTRACTING PARTY IN
JOINT OUT —FALL SEWER AGREEMENTS.
WHEREAS, there has been filed in the office of the
City Clerk of the City of Newport. Beach, a certified copy of an
Agreement entered into under date of August 17, 1938, between the
City of La Habra and La Habra Sanitary District, pursuant to the
provisions of which s aid City of La Habra has agreed to convey t o
said Sanitary District, all of it's right and control over the
interest and rights of said City under the various Agreements
with the parties interested in the ownership, operation, and
maintenance of the Orange County Joint Out —Fall Sewer, and
WHEREAS, said Contract is supported by certified copies
Iof Resolutions authorizing it's execution, and
WHEREAS, there has also been filed with the Clerk of
said City of Newport Beach, certified copy of a Resolution adopted
by the members of the La Habra Sanitary District Board, pursuant
to the provisions of which said Sanitary District has assumed the
obligations theretofore imposed upon said City of La Habra,
pursuant to the various existing agreements relating to the
construction, operation, and maintenance of said Out —Fall sewer
in conjunction with the other parties interested therein, and
WHEREAS, it appears to be for the best interest of all
parties that said substitution, pursuant to said Agreement, dated
August 17, 1938, between said City of La Habra and said La Habra
Sanitary District, be approved;
NOW, THEREFORE, the City Council of the City of
Newport Beach resolves as follows:

That the substitution of La Habra Sanitary District in
the place and stead of the City of La Habra, as the party heretofore
contracting with the various member cities and Sanitary Districts
interested in the ownership, operation, and maintenance of the
Orange County Out —Fall Sewer, be and the sane is hereby approved
and accepted.
The foregoing Resolution was duly introduced and adopted
by the Members of the City Council of the City of Newport Beach at
the regular meeting of said City Council held on the 41Y& day of
]a 0 ef- , 1938, by the following vote:
