NEWPORT BEACH DECLARING ITS INTENTION TO ORDER
4 THE CLOSING UP AND ABANDONMENT OF A PORTION OF
A CERTAIN STREET, AND PORTIONS OF CERTAIN ALLEYS,
5 AND CERTAIN ALLEYS IN THE CITY OF NEWPORT BEACH,
AS FOLLOWS: A POR�ION OF CARNATION AVENUE: A
6 PORTION OF ALLEY IN BLOCK "B" TRACT 470: AN ALLEY
IN BLOCK R TRACT 323; AN ALLEY IN BLOCK V, TRACT
7 323; DECLAING IT TO BE FOR THE PUBLIC INTEREST
AND CONVENIENCE, AND FIXING THE TIME AND PLACE
8 FOR HEARING OBJECTIONS TO SAID PROPOSED IMPROVE-
MENT, AWD SPECIFYING THE EXTERIOR BOUNDARIES OF
9 THE DISTRICT OF LANDS TO BE AFFECTED OR BENE-
FITED BY SAID 1IORK OR IMPROVEMENT AND TO BE
10 ASSESSED TO PAY THE DAMAGES, COST AND EXPENSES

14 The City Council of the City of Newport Beach, pur-
15 suant to the provisions of an act of Legislature of the State
16 of California, known as "Street Opening Act of 1989," approved
17 March 6, 1889, and amendments thereto, does resolve and de-
18
clare as follows:

2011 SECTION 1. That the public interest and convenience
21 requires the closing up and abandonment of a portion of a cer-
22 tain street, and portions of certain alleys, and certain
23
24 alleys in the City of Newport Beach, and it is the intention
25 of the City Council of the City of Newport Beach, to order the
26
27 following described portion of a certain street, and the fol-
28 lowing portions of certain alleys and certain alleys in said
29
30 City to be closed up and abandoned, to -wit:

Carnation Avenue
That portion of Carnation Avenue, 50 feet wide,
adjoining Lot 1 in Block "C" of Tract No, 470,
as per map recorded in Book 17, page 25 of Mis-
cellaneous Maps, records of Orange County,
California, described as follows:
Beginning at an angle point in the northwester-
ly line of said Lot 1, said angle point being
the northeasterly terminus of that certain course,
shown on said map as having a bearing of North
390 351 East, and a length of 60.25 feet; thence
390 40' 30" East along the northeasterly prolon-
gation of said course, a distance of 45.53 feet;
thence northeasterly, easterly and southeasterly
along a tangent curve, concave southeasterly,
southerly and southwesterly and having a radius
of 10 feet, thru an arc angle of 1120 00, 16"
an arc distance of 19.55 feet to a point of com-
pound curve, said point of compound curve being
on the southwesterly line of the 100 foot State
Highway right of way; thence southeasterly along
said southwesterly right of way line, along a
curve concave southwesterly and 'having a radius
of 1550 feet thru an angle of 00 49, 41" an arc
distance of '22.40 feet to a point on the norther-
14 of said Lot 1, distant thereon, South
740 35' 30" West, 26.79 feet from the northeaster-
ly corner of said Lot 1; thence South 740 351 30"
West, along said northerly line 60.11 feet to the
point of beginning.
PORTION OF ALLEY IN BLOCK "B ",TRACT 470
All that portion of that certain alley, 14 feet
in width, in Block 730, as laid out and shown
upon a mapp of Corona Del Mar, recorded in Book
3, pages 41 and 42 of Miscellaneous Maps, re-
cords of Orange County, Califo mia, lying between
the southeasterly prolongation of the northeaster-
ly line of Lot 10 in said Block 730, and a line
parallel to and 16 feet southwesterly of said
southeasterly prolongation of the northeasterly
line of said Lot 10, and all of that certain alley,
14 feet in width, lying southwesterly of and ad-
jacent to Lots 1, 2 and 3 in Block "D" as laid
out and shown upon a map of Tract No, x+70, re-
corded in Book 17, page 25 of Miscellaneous Maps,
records of Orange County, California.
ALLEY IN BLOCK "R", TRACT 32
All of that certain alley, 14 feet in width, .
lying northeasterly of and adjacent to Lots 3,
4 and 5-in Block "R", as laid out and shown upon
a map of Tract No. 323, recorded in Book 14, pages

40 and 41 of Miscellaneous Maps, records of
Orange County, California, and extending be-
tween the northwesterly line of Marguerite
Avenue and the southeasterly line of Lot 2 in
said Block "R", and all that portion of that
certain alley, 14 feet in width, in Block 438,
as laid out and shown upon said map of Corona
Del Mar, recorded in Book 3, pages 41 and 42,
of Miscellaneous Maps, records of Orange County,
California, extending between the northwesterly
prolongation of the southwesterly line of Lot 5
in said Block 438 and a line 16 feet northeaster-
ly of and parallel to the northwesterly prolonga-
tion of the southwesterly line of Lot 7 in said
Block 438.
ALLEY IN BLOCK "V ". TRACT
All of that certain alley, 14 feet in width,
lying northeasterly of and adjacent to Block "V ",
as laid out and shown upon a map of Tract No. 323,
recorded in Book 14, pages 40 and 41 of Miscel-
laneous Maps, records of Orange County, California,
extending between the northeasterly line of Pansy
Avenue and the southeasterly line of Orchid Avenue,
as said Pansy Avenue and Orchid Avenue are laid
out and shown upon said map of Tract No. 323, and
all that portion of that certain alley, 14 feet
in width, in Block 442, as laid out and shown
upon a map of Corona Del Mar, recorded in Book
3, pages 41 and 42 of Miscellaneous Maps, records
of Orange County, California, extending between
the northwesterly prolongation of the southwester-
ly line of Lot 1 in said Block 442 and a line 16
feet northeasterly of and parallel to the said
northwesterly prolongation of the southwesterly
line of said Lot 1.
All portions of streets and alleys to be closed up
and abandoned are more clearly shown on a certain map ap-
proved and adopted by the City Council of the City of Newport
Beach for said closing up and abandonment, by Resolution
dated the day of 1939, and designated
Resolution No.
SECTION 2.
That the exterior boundaries of the district or

lands to be affected or benefited by said work or improvement
and to be assessed to pay the damages, cost and expenses there-
of, are particularly described as follows, to -wit:
Beginning at the most easterly corner of Block
"AA ", as shown upon a map of Tract No. 323, re-
corded in Book 14, pages 40 and 41 of Miscel-
laneous Mans, records of Orange County, Calif-
ornia;
Running thence northwesterly and northerly along
the southwesterly and westerly line of Coast
Boulevard, as said Coast Boulevard is laid out
and shown upon said map of Tract No. 323 to the
most easterly corner of Block "C ", as shown upon
a map of Tract No. 470, recorded in Book 17, page
28 of Miscellaneous Maps, records of Orange
County, California;
thence westerly along the northerly line of Dahlia
Avenue (formerly 31st Avenue), as laid out and
shown upon said map of Tract No. 323 to an inter-
section with the northeasterly line of Fourth
Avenue (formerly 56th Place), as shown on said
map of Tract No. 470;
thence northwesterly along the said northeasterly
line of Fourth Avenue to an intersection with the
southeasterly line of Begonia Avenue (formerly
29th Avenue), as laid out and shown upon said map
of Tract No. 470;
thence northeasterly along the said southeasterly
line of Begonia Avenue to the most northerly cor-
ner of Block "B ", as shown upon said map of Tract
No. 470;
thence southeasterly in a direct line to the most
westerly corner of Block "B", as shown upon said
map of Tract No. 470;
thence southerly along the easterly line of said
Coast Boulevard, as laid out and shown upon said
map of Tract No. 470 and said map of Tract No.
323, to the most westerly corner of Block "R ", as
shown upon said map of Tract No. 323;
Thence easterly and northeasterly along the souther-
ly and the southeasterly line of Larkspur Avenue
(formerly 37th Avenue) to the intersection with
the southwesterly line of Second Avenue (formerly
54th Place), as said 54th Place is laid out and
shown upon a map of Corona Del Mar, recorded in
Book 3, pages 41 and 42 of Miscellaneous Maps,
records of Orange County, California;
thence southeasterlyalong the said southwesterly
line of Second Avenue to an intersection with the

formerly Pier Avenue, as said Pier Avenue
is laid out and shown upon said map of
Corona Del Liar;
thence southwesterly along the said south-
easterly line of Marguerite Avenue to the
most westerly corner of Block "S", as shown
upon said map of Tract No. 323;
thence southeasterly along the northeasterly
line of said Coast Boulevard to the most
southerly corner of Block "U ", as shown upon
said map of Tract No. 323;
thence northeasterly along the northwesterl '
line of Orchid Avenue (formerly 41st Avenue;
as said Orchid Avenue is laid out and shown
upon said map of Tract No. 323 to an inter-
section with the southwesterly line of said
Second Avenue;
thence southeasterly along the said south-
westerly line of Second Avenue to an intersec-
tion with the northwesterly line of Pansy
Avenue, formerly 42nd Avenue, as said 42nd
Avenue is laid out and shown upon said map
of Corona Del Mar;
thence southwesterly along the northnvvesterly
line of said Pansy Avenue to the point of
beginning.
SECTION 3. That said proposed work or improvement
is for the closing up and vacating of a portion of a certain
street, portions of certain alleys and certain alleys herein -
above more particularly described, and it appears to the said
City Council of the City of Newport Beach, that no assessment
is necessary.
SECTION 4. That the proceedings for the closing up
of the aforesaid portions of streets and alleys, shall be
had and taken under and in accordance with an act of the
Legislature of the State of California, designated and known
as "An Act to Provide for Laying Out, opening, extending,
widening, straightening or closing up in whole or in part any
street, square, lane, alley, court or place within municipal-
ities, and to condemn and acquire any and all land and pro-

perty necessary or convenient for that purpose," approved
March 6, 1889, and amendments thereto.
SECTION 5. The Street Superintendent of the City
of Newport Beach shall cause to be conspicuously posted along
the line of said contemplated work and improvement and at not
more than three hundred (300) feet in distance apart, but not
less than three (3) in all, notices of the passage of this
resolution, in the form and manner as required by law; and he
shall also cause a notice similar in substance, for a period
of four successive weeks, to be published in the "Newport
Balboa News - Times" a weekly newspaper published and circulated
and of general circulation in the City of Newport Beach,
California, which said newspaper is hereby designated for that
purpose by the said City Council of the City of Newport Beach,
containing a statement of the fact of the passage of this
resolution of intention, the date hereof, and briefly de-
scribing the work or improvement proposed and referring to
this Resolution for further particulars.
SECTION 6. That any person interested,_ objecting
to said work or improvement or to the extent of the district
or lands to be affected or benefited by said work or improve-
went, and to be assessed to pay the cost and expenses thereof,
may make written objections to the same, within ten (10) days
after the expiration of the time of the publication of said
notice mentioned in Section 5 hereof, which objections shall
be delivered to the Clerk of the City Council, who shall en-
dorse thereon the date of its reception by him, and at the
next meeting of the City Council, after the expiration of
said ten (10) days, lay said objections before said City
Council who shall fix a time for hearing said objections, not
less than one (1) week thereafter. The City Clerk shall

thereupon notify the persons making such objections of the
time and place of the hearing of said objections by the City
Council and notice of said hearings shall be given by deposit-
ing a notice thereof in the post office of said City of Newport
Beach, postage prepaid thereon, addressed to said objector.
I hereby certify that the foregoing Resolution was
duly and regularly introduced, passed and adopted by the
City Council of the City of Newport Beach, at an adjourned
regular meeting thereof, held on the 13th day of March, 1939,
by the following vote, to -wit:
