WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a certain agreement
dated the 1st day of May, 1939, by and between City of Newport
Beach and J. A. Beek as first parties, to Southern Counties Gas
Company of California, second party, granting to said second
party the right to excavate for, install, maintain and replace on
the real property hereinafter described, situated in the County
of Orange, State of California, gas pipes and mains for the purpose
of conveying gas for heat, light and power or other purposes and
to use the same for such purpose. Said real property is described
as follows:
A strip of land 40 feet in width lying 20 feet on
each side of a center line described as follows: beginning
at a point in the U. S. Bulkhead line between U. S. Stations
136 and 137, as shown on Record of Survey Map recorded in
Book 9, pages 42 and 43 of Records of Surveys, County of
Orange, California; said point of beginning lying North
390 48' west 377.89 feet from U. S. Station 137; thence on
a curve concave to the northwest and having a radius of
151,63 feet through a central angle of 320 231, 85.70 feet;
thence North 180 031 4511 East 37.69 feet to an intersection
with the decree line as establised by Superior Court Case
No. 24026, Orange County, California. The side lines of the
above described strip of land are to be extended or shortened
as necessary to intersect with the property lines at each end
of said strip.
And WHEREAS, the City Council of the City of
Newport Beach deems that it is for the benefit and best interests
of said city that said grant be made to the Southern Counties
Gas Company of California, upon the terms and conditions in said
agreement set forth.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor
and City Clerk of the City of Newport Beach be, and they are
hereby directed, authorized and instructed to execute said
Agreement in the name of and on behalf of the City of Newport
Beach, and that the Clerk deliver a duly executed copy thereof
to the Southern Counties Gas Company of California.
