RESOLUTION ORDERING IMPRO`IEMENT
1.'7REREAS, the City Council of the City of Newport Beach
on the 13th day of March, 1939, passed its Resolution of Intention
No. 1579, to order the hereinafter improvement to be made and pub-
lic work to be done in the City of Newport Beach; and
T?HEREAS, after the passage and adoption of Resolution
of Intention No. 1579, the Street Superintendent of the City of
Newport Beach caused to be conspicuously posted along the line of
the contemplated work and improvement at not more than three hun-
dred (300) feet in distance apart, and 114_ in all, no-
tices of the passage of said Resolution of Intention, headed
"NOTICE OF PUBLIC TTORK ", in the manner, form and substance as re-
quired by law, and said Street Superintendent also caused a notice
similar in substance to be published for a period of four (4)
weeks, in NEWPORT BALBOA NEVIS TIMES, a semi - weekly newspaper,
printed, published and circulated in the City of Newport Beach,
and named by said City Council in said Resolution of Intention as
the paper in which said notice should appear, all as appears from
the affidavit of S. A. MEYER, of the printers and publisher of
said weekly newspaper, and which affidavit was filed in the office
of the Clerk of the City of Newport Beach on the 4th day of
April , 1939, and is now on file therein; and
i7HEREAS, the Street Superintendent of the City of
Newport Beach commenced the posting of the notice hereinbefore
referred to on the 29th day of March , 1939, and fully
completed the posting thereof on the 29th day of March
1939, as appears from the affidavit of John A. Siegel, Assistant
Street Superintendent of the City of Newport Beach, and more than

ten (10) days having expired after the expiration of the time of
the publication of said notice within which protests or objections
to the proposed work or improvement might be made by any person
interested objecting to said work or improvement, or to the ex-
tent of the district or lands to be affected or benefited by said
work or improvement and to be assessed to pay the costs and ex-
penses thereof; and
WHEREAS, no written objections were filed to the work
or improvement or to the extent of the district of lands to be
affected or benefited by said work or improvement and to be
assessed to pay the costs and expenses thereof within the ten (10)
days provided for by law after the expiration of the time of the
publication of said notice above mentioned or at all, and there
being no objections to the work or improvement or to the extent
of the district of lands to be affected or benefited by said work
or improvement either written or verbal, and the City Council of
the City of Newport Beach having acquired jurisdiction to order
the work of improvement to be done.
IT IS HEREBY RESOLVED AND ORDERED, that the public
interest and convenience requires the work hereinafter described
and the City Council of the City of Newport Beach hereby orders
the following work to be done and improvement made in the City of
Newport Beach, as follows;
That the following portion of a certain street, and
the following portions of certain alleys and certain alleys in
said City of Newport Beach as hereinafter described be closed up
and abandoned, to -wit;
STREET
Carnation Avenue
That portion of Carnation Avenue, 50 feet wide,
adjoining Lot 1 in Block "C" of Tract No. 470,
as per map recorded in Book 17, page 28 of Mis-
cellaneous daps, records of Orange County,
California, described as follows;

of Orange County, California, lying between the
southeasterly prolongation of the northeasterly
line of Lot 10 in said Block 730, and a line
parallel to and 16 feet southwesterly of said
southeasterly prolongation of the northeasterly
line of said Lot 10, and all of that certain alley
14 feet in width, lying southwesterly of and ad-
jacent to Lots 1, 2 and 3 in Block "D ", as laid
out and shown upon a map of Tract No. 470, re-
corded in Book 17, page 28 of Miscellaneous Maps,
records of Orange County, California.
Alley in Block "R ", Tract 323
All of that certain alley, 14 feet in width,
lying northeasterly of and adjacent to Lots 3,
4 and 5 in Block "R ", as laid out and shown upon
a map of Tract No. 323, recorded in Book 14, pages
40 and 41 of Miscellaneous flaps, records of Orange
County, California, and extending between the
northwesterly line of Marguerite Avenue and the
southeasterly line of Lot 2 in said Block "R ",
and all that portion of that certain alley, 14
feet in width, in Block 438, as laid out and
shown upon said map of Corona Del Mar, recorded
in Book 3, pages 41 and 42, of Miscellaneous
Maps, records of Orange County, California,
extending between the northwesterly prolongation
of the southwesterly line of Lot 5 in said Block

438 and a line 16 feet northeasterly of and
parallel to the northwesterly prolongation
of the southwesterly line of Lot 7 in said
Block 438.
Alley in Block "V ", Tract 323_
All of that certain alley, 14 feet in width,
lying northeasterly of and adjacent to Block "V ",
as laid out and shown upon a map of Tract No. 323,
recorded in Book 14, pages 40 and 41 of Miscel-
laneous Maps, records of Orange County, California,
extending between the northeasterly line of Pansy
Avenue and the southeasterly line of Orchid Avenue,
as said Pansy Avenue and Orchid Avenue are laid
out and shown upon said map of Tract No. 323, and
all that portion of that certain alley, 14 feet
in width, in Block 442, as laid out and. shown
upon a map of Corona Del liar, recorded in Book
3, pages 41 and 43 of Miscellaneous 2-Taps, records
of Orange County, California, extending between
the northwesterly prolongation of the southwester-
ly line of Lot 1 in said Block 442 and a line 16
feet northeasterly of and parallel to the said
northwesterly prolongation of the southwesterly
line of said Lot 1.
All portions of streets and alleys to be closed up and
abandoned are more clearly shown on a certain map approved and
adopted by the City Council of the City of Newport Beach for said
closing up and abandonment, by Resolution dated the 13th day of
March, 1939, and designated Resolution No. 1579.
The public work ordered and the improvement to be made
is for the purpose of closing up and abandoning portions of cer-
tain streets and alleys in the City of Newport Beach as hereinbe-
fore described, and for that reason no district is chargeable for
costs in connection therewith.
All of the herein proposed work shall be done in pur-
suance of an Act of the Legislature of the State of California,
designated "Street Opening Act of 188911, and amendments thereto.
For further particulars reference is hereby made to
said Resolution of Intention No. 1579, which is dated the 13th
day of Harch, 1939, and on file with the Clerk of the City of
Newport Beach.
The Clerk of the City of Newport Beach is herewith
