RESOLUTION NO.
DECLARING RESULT OF ELECTION
WHEREAS, a general municipal election was held
and conducted in the city of Newport Beach, Orange County,
California, on Tuesday, the 9th day of April, 1940, as required
by law; and
WHEREAS, it appears that notice of said election
was duly and regularly given; that voting precincts were properly
established; that election officers were appointed and election
supplies furnished and that in all respects said election was held
and conducted and the votes cast thereat received and canvassed
and the returns thereof made and declared in time, form and
manner as required by the laws of the State of California, govern-
ing elections in cities of the sixth class; and
WHEREAS, the City Council of the city of Newport
Beach met at the Council chambers ofthe City Council on Monday,
the 15th day of April, 1940, at the hour of 7:30 o'clock P. M.
of said day, to canvass the returns of said election and install
the newly elected officers as a result of which the City Council
of said City finds and determines that the number of votes cast,
the names of the persons voted for, the propositions voted upon,
and other matters required by law to be as hereinafter stated.
NOW, THEREFORE, BE IT RESOLVED: That said
general municipal election was held and conducted in the city
of Newport Beach on Tuesday, the 9th day of April, 1940, in time,
form and manner as required by law; that there were ten (10)
voting precincts established for the purpose of holding said
election, consisting of the regular election precincts for holding
general state and county elections, as follows, to -wit:

municipal election herein mentioned, to -wit:
PROPOSITION NO. 1
.Shall the City Council of the city of Newport
Beach enact an ordinance prohibiting dancing in
public dance halls, cafes, restaurants, dinirg
rooms and other public places in the city of
Newport Beach, between the hours of twelve
o'clock midnight and nine o'clock A. M.;
fixing the penalty for the violation thereof;
defining dance halls; repealing all ordinances
or parts of ordinances in conflict with this
ordinance?
PROPOSITION NO. 2
Shall the City Councilmen who take office
subsequent to the canvass of the returns of this
election receive compensation in the sum of $25
per month in lieu of $50 per month as heretofore
voted by the people in full for their services
as such councilmen, excepting that any member
of the City Council who may be appointed or
elected to fill a vacancy shall receive the same
compensation as that payable to such member whose
office was vacated?
That the number of "Yes" votes and the number of
"no" votes received in each precinct in said city on said
propositions, together with the total number of "Yes" votes and
"No" votes received on said propositions were as follows:

RESOLVED FURTHER that at said general municipal election
Irvin George Gordon was elected to the office of City Councilman
of the City of Newport Beach for the full term of four years.
That Robert Allen was elected to the office of City
Councilman of the city of Newport Beach for the full term of four
years.
That 0. B. Reed was elected to the office of City
Councilman of the city of Newport Beach for the full term of
four years.
That Frank L. Rinehart was elected to the office of
City Clerk of the city of Newport Beach for the full term of four
years.
That J. A. Gant was elected to the office of City
Treasurer of the city of Newport Beach for the full term of
four years.
RESOLVED FURTHER that Proposition No. 1 failed to carry
and that Proposition No. 2 fa.ed to carry.
I hereby certify that the foregoiing Resolution was duly
and regularly passed by the City Council of the city of Newport
Beach at an adjourned regular meeting thereof held on the 15th
