CITY OF NEWPORT BEACH TAX SALE NO. 7

WHEREAS, Section 3897d of the Political Code of
the State of California, provides among other things, that when-
ever any property has been deeded for delinquent taxes and/or
assessments to the State of California, and said property has
also been deeded for delinquent taxes and/or assessments to any
municipality, the governing body of said municipality may enter
into an agreement with the Board of Supervisors in the County in
which said property is situated, subject to the approval of the
State Controller, for the purchase of, or for the option Nto pur-
chase the property so held by the State, or any part or parts
thereof; and
WHEREAS, all of the one hundred and thirty —two (132)
lots or parcels hereinafter mentioned and described in an
agreement of "Sale and Purchase ", dated August 5th, 1940, (Exhibit
"B ") hereto attached, are wholly within the city limits of the
City of Newport Beach, in the County of Orange, State of Californ
and are now delinquent for City taxes and for County taxes, and
for public Improvement Assessments of the City of Newport Beach,
and further, all of said lots hereafter described in said agree-
ment, have been deeded to the State ofCalifornia, for non — payment
of County taxes, and have been deeded to the City of Newport
Beach for non — payment of City taxes and/or assessments. All of
said taxes, City and County, as well as said assessments, are
past due for more than five (5) years; and
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a plan dated August let,
1940, (Exhibit "A ") under which it is expected to return to the
City Tax rolls and to the County Tax rolls all that certain real

property situated in the city of Newport Beach, County of Orange,

State of California, and being more particularly described and
set forth in said agreement dated August 5th, 1940 (Exhibit "B ")

hereto attached and made a part hereof; and
WHEREAS, there has also been presented to the City

Council of the city of Newport Beach, an agreement of "Sale and
6
Purchase ", dated August 5th, 1940, (Exhibit "B ") wherein the Board
7
of Supervisors of the County of Orange, State of California,
8
acting under the authority granted to it by Section 3897d of the
9
Political Code of the State of California, therein designated as
10
the Seller, and the City Council of the City of Newport Beach,
11
acting under the authority granted to it by Section 3897d of the
12
Political Code of the State of California, is designated as the
13
Buyer, wherein said Buyer agrees, among other things, to purchase
14
said delinquent tax lots heretofore mentioned and more particular -
15
ly described in said agreement, for the sum of One Hundred Thirty -
16
two Dollars ($132.00) cash, lawful money of the United States of
17
erica, said agreement however, to be subject to the approval
18
of the State Controller of said State, and subject and pursuant
19
in all respects to Section 3897d of the Political Code of the
20
State of California.

NOW, THEREFORE, BE IT RESOLVED: That the City Council of
22
the City of Newport Beach approves the Plan No. 7, dated August
23
let, 1940, (Exhibit "A") submitted to it for the purpose of placin
24
said delinquent tax property back on the tax rolls of the city of
25
Newport Beach, and orders the same to be attached to this resolu-
26
tion and filed as a permanent record with the City Clerk of the
27
City of Newport Beach; and
28
BE "IT FURTHER RESOLVED: That the City Council of the
29
City of Newport Beach be reference thereto, makes said plan and
30
the whole thereof, a part of this resolution to the same extent
31
and purpose as if the same were herein set out in full; and

BE IT FURTHER RESOLVED: That the agreement heretofore
mentioned (Exhibit "B ") be, and the same is hereby approved
as written, and the Mayor of the City of Newport Beach, and the
City Clerk of said City, are hereby directed and authorized to
sign and execute the same on behalf of the city of Newport Beach,
and the Clerk is directed and instructed to deliver a duly execut
copy thereof to the Seller therein named.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the City
Council of the City of Newport Beach at a regular meeting thereof

15LAN OF THE CITY OF NEWPORT BEACH COVERING THE SEVENTH
PURCHASE OF TAX DELINQUENT PROPERTY
Plan of the City of Newport Beach, Orange County, California,
to return to the City Tax Rolle and to the County Tax Rolle,
132 lots, or parvele of property, all within the city limits
of'the City of Newport Beach, and being the property as
listed in an "Agreement of Sale and Purchased, dated August
5th, 1940, between the Board of Supervisors of Orange County,
California, and the City Council of said City of Newport
Beach, California.

At the present time all such lots or parcels of property as
shown in said agreement have been deeded to the State of
California and are, at present, completely off of the assess-
ment rolls of the City of Newport Beach and the County of
Orange and will produce NO TAX REVENUE until some effective
plan is worked out to get the taxes and assessments paid up
to date and the property back in the hands of new owners
who will pay the current taxes and assessments as they become
due.

The 132 lots, or parcels of property, included in this plan
are located approximately as follows:
Group No. 1 Corona Del dies 50 lots

Group No. 1 - The lots in Corona Del Mar District are all
under very heavy assessments under 1915 Act Bond issues
placed in 1925 and 1927 to cover water and paving. The
City is at present making three ten cent levies for a total
of 30¢ per hundred on the assessed value of the entire
City to take care of the defaults under these bonds.

Group No. 2 - The lots in this group are scattered through-
out the City and most of them are encumbered with 1915 Act
8 ewer and Paving Bonds. It is necessary that the City
protect its liability under these bonds and, at present,
a five cent levy over the entire City is being made to take
care of the defaults under these bonds.

Seller agrees to cause its Tax Collector to execute
and deliver to Buyer a Deed for said property as provided in
said Section 3897d of the Political Code of California.
That in the event said property or any part thereof is
redeemed, as provided for by the law, prior to the completion
of this agreement, then this Agreement shall become null and
void as to the property so redeemed.
That upon request of Buyer after the execution and
delivery of said Tax Deed Seller agrees to cancel any and
all taxes levied by the County of Orange upon said property
prior to the date of said Deed.
Time is hereby declared to be the essence of this
Agreement.
