1 RESOLUTION NO.

3 WHEREAS, a certain Agreement of Lease dated the
4 2nd day of September, 1940, by and between the City of Newport
5 Beach as party of the first part, and Newport Harbor Post No.
6 291, as party of the second part, has this day been presented
7 to the City Council of the City of Newport Beach; and
8 WHEREAS, said Agreement of Lease provides that the
9 City leases to the party of the second part certain harbor
10 frontage and tide lands in the city of Newport Beach, together
11 with certain uplands abutting thereon, described as follows:
12 All that certain real property situated in the city
13 of Newport Beach, County of Orange, State of California, and
14 more particularly described as follows, to -wit:
15 A parcel of land situated in the City of Newport
Beach, California, being a portion of Lot 4, Section 33, Town -
16 ship 6 South, Range 10 west, S. B. B. & M., a portion of Lot
4, Section 34, Township 6 South, Range 10 West, S. B. B. & M.,
17 and certain filled tide lands described as follows, to -nit:

Beginning at a point in the northerly prolongation
of the westerly line of 15th Street, as said 15th Street is
laid out and shown upon a map of Tract No. 234, recorded in
Book 13, pages 36 and 37, Miscellaneous Maps, Records of
Orange County, California, said point of beginning being 160
feet northerly from the northeasterly corner of Lot 4, Block
115 of said Tract No. 234; running thence North 90 43' 30°
East along the Northerly prolongation of the Westerly line of
said 15th Street, a distance of 109.79 feet to an intersection
with the United States Government bulkhead line between
Station No. 118 and Station No. 119, as said bulkhead line

Newport Harbor, California", approved May 2nd, 1936, by the
Secretary of War and on file in the office of the U.S. District
Engineer, 751 South Figueroa St., Los Angeles, California;
thence westerly along said bulkhead line a distance of 349.9
feet to an intersection with the northerly prolongation of
the easterly line of Lot 13, Block 115 of saldTract No. 234;
thence south 90 431 33" West along the said northerly prolonga-
tion of the Easterly line of Lot 13, a distance of 249.79 feet
to an intersection with a line 20 feet northerly of and parallel
with the northerly line of said Block 115; thence south 800
161 30" East along the said line 20 feet northerly of and
parallel with the northerly line of Block 115, a distance of
203.9 feet;; thence North 90 431 30" East, a distance of 140
feet; thence south 800 16' 30" East, a distance of 146 feet
to the point of beginning.
RESERVING for street purposes a strip of land 50
feet in width, lying 25 feet on each side of the following
