RESOLUTION NO. 1 0 3
WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach a certain agreement
between the.city of Newport Beach as party of the first part,
and CARL SCHILLING as party of the second part; and
WHEREAS, said agreement provides that the party of
the first part will construct and erect for the use and occupancy
of the party of the second part, for his yacht, the INVADER, a
certain dock, roadway, water pipe lines and landing float in
Newport Harbor, said dock to be rented by the party of the second
part from the city of Newport Beach for the period of one year,
for a yearly rental of $480.00, all as in said agreement provided;
and
WHEREAS, the City Council of the city of Newport Beach
deems that it is for the best interests of said city that said
improvements be made for the use and benefit of said party of the
second part, upon the terms and conditions as in said agreement
set forth, and for the consideration in said agreement set forth.
NOVI, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the city of Newport Beach be, and they are hereby
directed, instructed and authorized to execute said agreement in
the name of the city of Newport Beach, and the City Clerk is
directed to deliver a duly executed copy thereof to the party
of the second part.
I hereby certify,that the above and foregoing resolution
was duly and regularly paased and adopted by the City Council of
the city of Newport Beach at a regular meeting thereof held on the
4th day of November, 1940, by the foll g te, to —wit:
