51 sity.require :the acquisition of the real property hereinafter des-
6 cribed ', for the opening'up,'widening and extending an alley between
7 Ninth and Tenth Streets, in.the City of Newport Beach.
$ NOW, THEREFORE, BE ICI'RESOLVED; by the City Council of
9 the City of Newpor:t,Beaeh, that the public interest and necessity
10 require, and it.is.hereby ordered that.the following acquisitions
11 for, the purpose of widening, opening and extending of a certain
12 alley between Ninth and Tenth Streets in the City of .Newport Beach,
13 be made,:to -wit:
.14 -The right of way, for alley purposea.and public
utility purposes C.ver;:upon,.under and across all of
15 the south one-half of that certain alley twenty feet
in width adjoining Lot. 6 in „Block 109,. Section. - -'.B'

16 Yeort.Beach, as shown upon a map recorded in Book 4,
}gage 27 of Miscellaneous.Maps., records of Orange County,

18 HE IT FURTHER RESOLVED: That the City .Attorney of the
19 City of Newport Beach be, and.-he is hereby ordered and directed to

20.bring,an action in the name of the city of Newport Beach in the
-21 Superior Court in and for Orange County, California, for the con-
22 demnation of the property necessary to be taken 'for the acquisition
23 herein ordered, and heretofore described, and to do ;all things
24 `necessary to prosecute said action to final determination.
BE IT FURTHER RESOLVED; That the public interest and con-

renience require; and it is hereby ordered.that the city of Newport

27 each, a municipal Corporation of the sixth class, plaintiff in
28. said condemnation.aotion, take immediate possession and use of the
roperty herein ordered to be acquired, upon complying with the

equirements of law applicable thereto, and that the said City Ate
