WHEREAS, there has this day been presented to the City

Council of the city of Newport Beach, an agreement dated March 3,
4
1941, wherein Byron Jackson Co., a corporation, is referred to as
5
the party of the first part, and the City of Newport Beach is
6
referred to as the party of the second part; and

WHEREAS, the first party agrees to sell and the second
8
party agrees to purchase from first party, at the prices herein -
9
after stated, the following equipment, to -wit:

Byron Jackson Deepwell Pump with 20 HP, 1460 RPM,
11 440 volt, 50 cycle, 3 phase, General Electric,
Westinghouse or U. S. Motor; also pumping plant
12 panel with starter, etc.
13 Price delivered and installed in well...$ 1065.97
14 Less 3 %, or $30:98, for cash in thirty days;
plus California Sales tax of $29.58.

16 And WHEREAS, in the opinion of the City Council of the
17 City of Newport Beach, said agreement is in all respects Just and
18 fair, and said agreement was made pursuant to written notice
19 inviting bids, and the award of bid made thereafter.
20 NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
21 City Clerk of the city of Newport Beach be, and they are hereby
22 directed, instructed and authorized to execute said agreement on
23 behalf of the city of Newport Beach.
