WHEREAS, there has this day been presented to the City
3
Council of the city of tewport Beach a certain agreement dated
'
4
the 17th day of March, 1941, by and between the American Concrete
5
and Steel Pipe Company, a corporation, party of the first part,
6
and the City of Newport Beach, party of the second part; and
7
WHEREAS, said agreement provides that the party of the
8
second part hires and retains the party of the first part for the
9
furnishing of all materials (exclusive of pipe and fittings), lab03
10
transportation and services in the installation of approximately
11
2320 lineal feet of 20" diameter Hume Cement Concrete Pressure Pip4
12
in accordance with the plans and specifications prepared by the
13
City Engineer of the city of Newport Beach and on file with the
14
City Clerk of said city, for the doing of said work of improvement,
15
a copy of which specifications is attached to said agreement and
16
made a part thereof; and
17
WHEREAS, said agreement specifically sets forth the
18
terms, conditions and price for the doing of said work; and
19
WHEREAS, the City Council of the city of Newport Beach
20
deems that it is for the best interests of said city that said
21
agreement be executed, and that the work therein specified be done
by the first party upon the terms and conditions therein set forth
22
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
23
City Clerk of the city of Newport Beach be, and they are hereby
24
directed, authorized and instructed to execute said agreement in
25
the name of and on behalf ofthe city of Newport Beach, and that
26
a duly executed copy thereof be delivered by the City Clerk to
27
the party of the first part in said agreement named.

I hereby certify that the above and foregoing resolution

was duly and regularly passed and adopted by the City Council of
